This regular adjourned meeting of the Common Council is called to
order by His Honor Mayor George C.l~ilias,Jr.
PresentjCouncilmen George A.Martin,George M.Mason,Nat Heiner,
J.H.Wentworth,David V.Stout. Absent:Councilmen James Battersby.

Motion by Counc iIman Wentworth, seconded by Counc ilman Stout and
carried that H.E.Robinson and Ormond Rector be appointed members of
th e Gilr oy City Planning Commission for a term 0 l' four years end ing
January 15,1946.
I/lot ion by Councilman He iller, se conded by Councilman Wentworth and
carried that James S.Byers be appointed City Attorney for the ensuing
two years.
Mr.E.E.Eustice now appears before the Council to discuss the city's
fire insurance as the result of a recent survey made by a committee
of the League of California Cities. The matter of appraisal of the
city'S property is discussed. I~.Eustice is instructed to to secure
the services of the insurance company's engineers to appraise the
city buildings and the department heads are instructed to make an
inve ntory 0 l' their equipment to present to the Finance Committee
te fore the next meeting of the Council.
Councilr~n Heiner announces that the Volunteer Fire Department
have abandoned their annual dance due tb<< the emergency and askS4
that the city make its annual donation to the dance fund.
Motion by Councilman Martin, seconded by Councilman stout and

carried that the sum of $50.00 be donated to the Gilroy Volunteer
Fire Department's Dance Fund.
The matter of salaries of several city employees is now discussed.
The Mayor instructs the Finance Committee to reportx its findings
to the Council after they have made a thorough study of salaries of
all city employees.
The Mayor now calls on the City Inspector to ~eport on his in- ~
vestigation of the danger of fire from a motor located on property ~
of Byers Brothers, located on the east side of Eigleberry street
between Second and Third Streets. The City Inspector reports that
he could see no danger from fire as the r esul t of the 100 ation 0 l'
the electric motor.
~~.Edward Naughton now appears before the Council and reports
that Byers Brothers have cleaned up the lot ( a portion of Lot 3,
Block 4, North Range I West) that he had complained of but the
wi. ngs of the fence along the north and south lines of their property
proje cted beyond the fi fty foot mark, measured from the east line of
of their property, a portion of Lot 3, Block 4, North Range 1 West.
Wrr.Naughton states that he would be satisfied if the wings of the
fence were taken down back to the fence running north and south
across the property and the lot was completely cleaned up. Mr.
Nalghton now complains about the noise made by an air compressor

1x..Tustin Byers now appears before the Council to discuss the
fence complained of. IvIr.Byers now canplains about the condition of
the Naughton property with particular reference to a building on the
rear of the lot and weed growth.
Motion by Councilman Stout, seconded by Councilman Kelnerand carried
that t his matter be placed in the hands of the City Inspector and
tl~t in the future he shall make regular inspection of all property
with reference to fire hazards and thosethings that are detrimental
to the city and present his report to Council at regular meetings.

Motion by Councilman Stout,seconded by Councilman Mason and
carried that Byers Brothers conform to the fifty foot restriction
on the extension of the fence, this distance to be measured from
the Carrey property line,and keep the lot free of rubbish.
The Clerk is requested by Mr.Naughton to read a portion of the
City Charter with reference to nusiances.

l~s.Naughton is now called on to discuss the noise complained of
by her husband said noise emanating from the air compressor located
on the Byers Brothers prop erty. Mrs . Naught on sta tes that the noise
from the compressor disturbs her very much.
The Mayor now instructs the City Insepctor to vis it the Naughton
home for the purpose of investigating the noise complained of and df
he is unable to make a decision,cbl' is,An doubt, to call the Mayor.
Officer Ernest Barozzi ~ow ap~ars before the Council at the request
of the Mayor. The Mayor instructs Officer Barozzi to make complete
reports of all activities during his night shifts and sign his name
on the police blotter which will be provided soon. The Mayor also
ins tructs Officer Barozzi to follow the instruct ions of the City
Marshal ani asks his complete cooperation.
Councilman Martin inquires about gas masks. The Mayor states that
inquiry has been made to the Ninth Regional Office of Civilian Defense
in regard to this matter.
The matter of re.meving,weeds from lots that have not been cleaned
off by their owners is discussed. The 1~yor states that the City
Inspector is making his final investigation and a report will be
ready for lihe next regualr meet ing of thl! Council.
