This regular monthly meeting of the Common Coun.il is .alled to ~~
order by His Honor Mayor George C.Milias.
Present:Councilmen George A.Martin,George M.Mason,.J.H.Wentworth,
Henry J.Schilling. Absent:Councilmen Nat Heiner,David V.Stout.
Min~tes of the meetings of August 7th and 31st are read and
approved.
A co~nunication is read from Annette L.Brooks and children
calling attention to the courtesy of the Police Officer on duty,
.July 2,1944, The Clerk is instructed to ascertain the name of
the officer on duty and show the letter to him.
A communication is read from the Gilroy City Planning CO~llission
recommending that the application of Mr.Gabriel Chaviria, 39 South
Rosanna Street, to open a tire repair shop at this address,be
rejected.
The request of La Sociedad ~uneraria to hold a street dance
and two dances a month in a local hall is discussed.
A communication is read from Iflr..Joe Silveria asking for a permit
to operate a Night Patrol formerly operated by Chris Maze and
Euge ne Fra ke s .
Motion by Councilman Mason, seconded by Councilman WentTIorth and
carried that the application of Kr.Gabriel Chaviria,39 South Ros-
",~nna Street, to open a tire repeir shop at this address, be rejected,
as recomn~nded by the Gilroy City Planning Comruission.
I~otion by Councilman Martin, seconded by Councilman Wentworth and
carried that the application for a permit to hold a street dance
and two additional danc,s per month,made by La Sociedad Funeraria,
be denied and the Clerk instructed to notify the organization
officials of the action taken.
It is unanimously agreed that Er.Joe Gilveria circulate a petition
among the merchants; those favoring the estalblishment of a laght

Motion by Cou ncilman L:Lartin, seconded by Councilman Mason and
carried that the permit of l:Ir.Eugene Frakes to operate a Llerchants
Patrol be extinguished as of September 1,1944.
This being the time specified in a legal a(lvertisement clllling for
bids to refinish and recondi tion riheeler Civic Auditorium, the Clerk
is instructed to proceed with the opening of the bids.
The Clerk announces that one bid has been presented.
The bid of Mr.George C.Henz to recondit ion and refinish \';heeler
Civic Auditorium,as per specifications of Binder and Curtis,archit-
ects,for the sum of $3,500.00 is presented and read.
I,lot ion by Councilman l.Iartin, seconded by Councilman Mason and
carried that the bid of George C.Renz,contractor, of $3,500.00 to
recondition and refinish riheeler Civic Auditorium as per specific-
ations of 3inder and Curtis,architects,be accepted as read.
Motion by Councilman Vientworth,seconded by Councilman Martin and
carried that an emergency exists, that the city purchase from the
Culwell Chevrolet Company one 134 inch wheel base Chevrolet truck

equipped with 700 x 20-10 ply tiresfar the sum of ~1,450.51 for the
caassis plus ~400.00 for a dump body and ~50.00 for installation of
the dump body.
r~otion by Councilmam Kartin,seconded by Councilman Wentworth and
carried that Elmer J.Chesbro be appointed a member of the Gilroy
City Planning Conrrnission for a term of 4 years,effective August 3,
1944.
Motion by Councilman r~son, seconded by Councilman I~artin and
carried that Logan and Frazer, certified public acoo untants ,American
Trust Building, San Jose,California, be appointed city auditors for
the period,.July 1,1944 to June 30,1945, for the sum of $250.00 per
year, payable quarterly, audits to be made quarterly and a final
audit report to be presented at the end~ of the fiscal ,ear.
The Mayor now presents a summary of estimated receipts and expend-
itures for the fiscal year 1944-194&Bs prepared by the City Clerk.
I'lOt ion by Councilman Martin, seconded by Councilman Schilling and
carried that the tax rate for 1944-1945 be ~1.00 on the ~100.00 of
assessed valuation,distributed as follows:

The Clerk is instructed to notify the 1.'iater Department and the Fire
Department to take an inventory of all property in their departments
for insurance purposes.
Councilman Mason reports that ~ new septic tank is need at the golf
course along with wi til Berta in re pai rs to the caretakers house.
The matter of repairs and imlJroveraents at the golf course is placed
in the hands of the Water Committee with power to act.

Councilman Mason is instructed to investigate the possibility of
purchasing from the War Department the two inch pipe line from the
reservoir to the old C.C.C.Camp on Burchell Hoad.
A lease from the City of Gilroy to the State.of California for
Wheeler Civic Auditorium is now presented and discussed.
The City Attorney lis instructed to write to the Adjutant General
of the State of California giving him the cost figures of the aud-
itorium building and the additional cost to the city to add certain
features reQuested by the l';ational Guard; that the Council l)elieil':~s
that the State should maintain the interior and exterior of the
building and pay the "city $75.00 per month as rent; that the lease
should specify the rent to be charged for the building when used for
commercial and for non-commercial purposes.

Reports of the city officers are presented and read.

Motion by Councilman Martin, seconded by Councilman Wentworth
and carried that the reports of the city officers be accepted as
read and placed on file.
The Mayor reports that the suit of the City of Gilroy vs..J.V.
Oliveria re; an alley from 7th Street to 8th Street between Eigle-
berry and Church streets~ is scheduled for trial September 7,1944.
The Mayor also states that he understands that Mr.Oliveria is willing
to settle this matter for $100.00.
It is unanimously agreed that the City Attorney proceed with the
trial.
