This regular monthly meeting of the Comnon Council is called ~o
order by His Honor Mayor George C.Milias.
Present: Councilmen George A.Martin,George M.Mason,Nat Heiner,
J.H.Wentworth,David V.Stout. Absent:Councilmen Henry .J.Schilling.
Minutes of the meeting of .July 2nd and meetings of the Board of
Equalization of July l3th,20th and 24th are read and approved.

A communication is read from Logan and Frazer,city auditors,
stating that they had completed their final audit for the fiscal
year 1944-1945 and submitted their annual report,which was read,
and made the offer to audit the city's books for the fiscal year
1945-1945,under the same conditions as previously submitted, for

the sum of $250.00.
The monthly report of Health Department on water samples taken is
presented and read and ordered pla.ced on file.
The July report of the City Poundmaster is presented and read and
ordered placed on file.
Two bills from Mr.George C.Renz,contractor, are presented, one for
the final payment on the Wheeler Auditorium CDntract for the sum of
,~ $987.80 and one for refinishing of Wheeler Auditorium gor the sum of
$3,500.00. The Clerk was instructed to advise Binder and Curtis,
architects, that these bills had been received and request that they
make an insepction of the building to ascertain if all provisions
in the contract and specifications had been met.
A notice of Application for and Off Sale Beer and Wine License
for the French-American Bakery,77 North Monterey Street, is presented.
No objection is made.
Mr.Carroll Wentz representing a committee of the Gilroy Chamber of
Commerce,now appears before the Council to invite the Uayor and
Council to attend the meeting of the board of d irectors,August 27th,
for the purpose of discussing the possibility of the city purchasing
prospective industrial sites. Mr.Wentz also suggests that the Council
ascertain what the Division of Highways intends to do respecting the
high curbs on Monterey Street in the event the resurfacing proj ect
agreed upon in the Memorandum of Agreement with the Divison of High-
ways for the biennium 1945-1947, is carried out; also, if the Div-
ision still has as a project the widening of Monterey Street. The
Clerk is instructed to write to Colonel .Jno.Skeggs ana inform him
of the two matters discussed.
Motion by Councilman Stout,seconded by Councilman Heiner and
carried that the annual report of Logan and Frazer,city auditors,
be accepted and placed on file; that theL~irm of Logan and Frazer'
be granted a new contract to audit the City's books for the fiscal
year 1945-1946, under the same terms and conditions as previous
contracts, for the sum 0 f $250.00.
CouncilmaIil Heiner reports that the Ordinance'Committee did not
favor the lowering of the licease ~f $25.00 per day for palmists,
claravoyants,etc. The Council unanimuusly agrees to accept the
report of the Ordinance Committee.
Mr.H.E.Robinson now appears before the Council to discuss the
proposed alley from Third Street to Fourth Street between Monterey
and Eigleberry streets. Mr.Robinson states that he discussed this

matter with Mr.Andrew Battagin,one of the property owners along the
proposed route of the alley,and Mr.Battagin stated that he wants
$3,880.00 for severance damages. Mr.Robinson suggests that a comm~~tee
of the Council discuss this matter with Mr.Battagin.
Mr.H.S.Hersman now appears before the Council to discuss the open-
ing of thi salley.
It is unanimously agreed that the Council meet with Mr.Battagin,

Mr.Robinson and Mr.Hersman and any other property owners interested,

on Monday,August 13th, to discuss this matter.
The Mayor now states that the City Clerk has been asked to serve
as secretary of the South Santa Clara Valley Water Cwnservation
District. The City Attorney states that the acceptance of this
position by the City Clerk would be sa~isfactory if the Council
approved it.
Motion by Councilman Stout,seconded by Councilman Heiner and c
carried that City Clerk P.A.Cox be allowed to accept the position
of Secretary of the South Santa Clara Valley Water Conservatiob
District.
A communication is presented from the Gilroy City Planning

Commission making certain recommendations respecting the Gurries
Addition to the City of Gilroy:

"That the property West of Church Street,fronting on First Street,
exoept Lot 46, be dedicated to single dwellingSjthat the property on
the North and South sides of Bueadway-lots 27 to 32 inclusive and
Lots 23 to 26 inclusive-be dedicated to multiple or single dwellings
and Lots 8 to 12 inclusive and Lots 14 to 17 inclusive-be dedicated
~or]single\_or"multiplfF;.dwell:ings~all other lots in this addition to;
be dedicated to single dwellings. "
That a restriction on total cost of dwellings in this area de~-
icated to single dwellings on First Street be a minimum of $6,000.00
for the dwelling only, accessory buildings to be an additional cost
and not to be considered in the cost of the dwellingjall other lots
dedicated to single dwellings shall have a minimum cost of $4,500.00,
for dwelling only."
Mr.Sydney Johnson now appreas before the Council to discuss thet
Gurries Addition.

Edward Hanna,surveyor, now appears before the Council to discuss
the George Renz purchase of the M.J.B. ranch and states that Mr.
Renz is anxious to extend Welburn Avenue through to Hanna Street.
This matter is laid over for future discussion.
Councilman Stout discusses the oiling of alleys. Councilman Martin,
chairman of Street Committee, states that all alleys have been oiled

that his committee felt needed oiling.
Councilman Stout states that he has received several complaints
in regard to the back streets being too dark. Mayor Milias suggests
that this matter be discussed with the Coast Counties Gas and Electric
Compa ny.
Councilman Stout suggests that the Police Judge be asked to sentence
all so-called "zoot-sui ters It ,arrested within the city);
to a hair-cut. The Mayor states that the Juvenile authorities have
improved their method of handling this matter and that less trouble
is expected in the future.
Motion by Councilman Martin,seconded bp Councilman Stout and carried
that the city purchase from Norman B.Goodrich- 1 red spot light and

be d.nstalled on the car owned by Traffic Officer James Sturla,but to
remain the property of the city.
Councilman Wentworth discusses the parking of trucks on north
Eigleberry Street. The Clerk is instructed to prepare an advertisement
for the newspaper calling attention to the provision of Ordinance No.
325 which forbids the parking of trucks and cars on the streets from
the hours of 2 A.M. to 5 A.M.
Councilman Martin states that Jack Thomas would like to enter into
an agreement with the city whereby he would rent Wheeler Auditorium
one night a week for a month at a lower rental fee than is charged
at present. It is unanimously agreed that the rent of the building
remain at $45.00 per night for commercial use.
Councilmam Martin discusses the purchase of a new pick-up truck for
use of the Street Department. A bid is presented by Culwell Chevrolet
Company for a new 1945 Chevrolet pick-up for the sum of $1,053.52.
Motion by Councilman Stout,seconded by Councilman Martin and carried
that the Clerk be instructed to prepare the necessary notice for
publication calling for bids for l-l945,Chevrolet 6,i tmn pickup
truck;
The matter of an extra tire and tube was discussed and it was
determined that these would have to be obtai ned through'. the local
rat ion board.
Reports of the city officers are presented aad read.
Motion by Councilman Stout,seconded by Councilman Martin and carried
that the re ports 0 f ci ty 0 fficers be acce pted as read and ordered
placed on file.

Motion by Councilman Heiner,seconded by Councilman Stout and carried
that bills as presented be allowed and warrants ordered drawn on the
Treasurer.
