This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George C.Milias.

J.H.Wentworth,David V.Stout. Absent: Councilmen Henry J.Schilling.
Minutes of the meetings of September 3fd,4th,12th and 25th are
read and approved.
A communication is read from the Division of Highways stating
that upon the signing of an agreement for the e.xpendi ture of
$250.00 from the funds allocated from the gasoline tax for State
Highways a traffic study would be made to decide whether or not
traffic signals should be erected on Monterey Street at the Fifth
and Sixth street intersections.
City Engineer W.J.Hanna saates that he has the agreement drawn
and the Mayor instructs him to send it to the Division of Highways.
A communication is read from the Gilroy Business and Professional
Women's Club requesting permission to use the Villeeler Civic Auditorium
for a portion of the annual BallolJeMsCli'1i:dlfren's Parade and Party.
Permission is unanimously granted.
A communication is read from George C.Renz agneemgg the spray the
chairs of Wheeler Auditorium with lacquer as soon as lacquer is
available.
The letter is referred back to Mr.Renz with the suggestion that
he add to the agreement a statement to the effect that this agreement
is a part of the origi.al contract between the city and himself for
refinishing Wheeler Auditorium and that the spraying of the chairs
would be done without additional cost to the city.
N~.Sydney S..Johnson now appears before the Council to discuss the
proposed ordinance concerning the erection of so-called "shacks"
and unsightly buildings in the residence districts of the city.
The Mayor now read the proposed ordinance.

ORDINANCE NO.445
AN ORDINANCE AMENDING ORDINANCE NO.436 OF THE CITY OF GILROY ADDING
A NEW SECTION TO BE KNOWN AS SECTION 201a TO THE UNIFORM BUILDING
CODE, 1940 EDITION, HERETOFORE ADOPTED PROHIBITING THE ERECTION OR
ESTABLISBMENr OF SHACKS, UNSIGHTLY STRUCTURES AND OTHER BUILDINGS
DETRIMENrAL TO THE PUBLIC WELFARE; PROVIDING FOR 'lEE ISSUANCE OF
PERMITS AND APPEALS RELATING THERETO, AND REPEALING ALL ORDINANCES
AND/OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.
Motion by Councilman Stout,seconded by Councilman Heiner that ORDIN-
ANCE NO.445 be adopted.

BE IT RESOLVED by the Mayor and Common Council of
the City of Gilroy, at regular session assembled, that:
Four cents (4~) of each and every one dollar ($1.00)
collected for general municipal taxes for the current fiscal
7ear 1945-1946 be set aside as a special fund for the purpose
of keeping and maintaining the Wheeler Civic Auditorium in
Gilroy; said fund shall be known as the Municipal Auditorium
Maintanence Fund and a separate and special account shall be
kept thereof in the books of said City.

Five cents (5~) of each and every one dollar
($1.00) collected for ~e~eral municipal taxes for the curren~
fiscal year 1945-46 be set aside as a special fund for the
purpose of making, constructing and drilling a new water
well in said City of Gilroy and for the further purpose of
acquiring all necessary personal property as may be proper
to effect a new water well in said City of Gilroy.
Said fund shall be known as Water Well Construction

Mr.H.S.Hersman now ap~ars before the Council and states that an
agreement had been made with Mr.Andrew Battagin regarding the open-
ing of an alley from Thi~d Street to Fourth Street,between Monterey
and Eigleberry streets and the property owners directly effected by
the opening of the propesed alley have agreed to pay ~~.Battagin
the severance damages asked and that the alley could now be opened
without cost to the city other than grading,gravelling and oiling.
Motion by Councilman Martin,seconded by Councilman IJason and carried
that it be the sense of this meeting that an alley be opened from

from Third Street to Fourth Street,between Monterey and Eigleberry
streets, that the City Engineer be instructad to secure the necessary
deeds,secure the necessary abstracts for the' p~operty and act as right-
of-way agent.
Councilman Heiner now dtscusses the heating plant at the Fire House.
Motion by Councilman Martin,seconded by Councilman Mason and carried
that the city purchase fer installation in the Fire House- 1-#120
Gas Fired Clipper Furnace from the California Fresno Supply Company,
for $384.86 installed.
Councilman Heiner announces that the annual Firemens banquet will
be held Friday,October l2th,7i:o'olock P.M. at Hotel Milias and all
city employees are invited.
Councilman Stout now discusses the future development of the city
water system.
It is unanimously agreed to appropriate the sum of $75.00 to be
used the pay a portion of the expense of a drainage survey in the
Renz Addition.
Councilman Mason discusses the water plat book and the City
Engineer is directed to secure this book and bring it up to date.
The report of the Poundmaster is presented and read and ordered
placed on file.
Reports 0 f the ci ty officers are presented and read.
Motion by Councilman Stout,seconded by Coubcilman Heiner and carried
that the reports o~ the city officers be accepted as read and placed mn
file.

that bills as presented be allowed and warrants ordered drawn on the
Treasurer.
The Mayor discusses the sale of pro];E rty for delinquent taxes and
the possibility of a sale of a portion of the sewer farm property.
