Minutes 1946/03/04 I 896 Gilroy, California March 4, 1946. Thi. regular monthly meeting of the Common Council was called to order by His Honor Mayor George Milias. Present Councilmen: George A. Martin, George M. Mason, Nat Heiner and David V. Stout. Absent Councilmen: J. H. Wentworth and Henry J. Schilling. The minutes of the last regular meeting of February 4, 1946 were read and approved. A communication was read calling attention to the large number of stray dogs running loose in the city and the damage and nuisance caused by them, and calling on the council to take action in the matter. A copy of a warning notice issued to the Pacific Cafe from Thomas ~.l~ Gruell of the County Health Dept. was read, ordering that the premises t be cleaned up or that the Health Dept. would recommend that it be closed. A report on water samples taken by the County Health Dept., with the notation that the Coli Index from Uvas Creek was not satisfactory and that the Plate Count from the tap at the Fire House was question- able, was read, discussed and ordered filed. The matter of the cleaning up of the Pacific Cafe was discussed and 827 and it was decided to instruct the City Inspector and he was so in- structed to call and inspect the place and if not in good order. to 'or- der it cleaned up immediately and if the order is not complied with to instruct the City Marshal to take away his liscense and close the place up. The matter of the great number of stray dogs at large in the city was discussed by the Council. It was decided to place the matter in the c: hands of the City Inspector to hire a man full time for the next two or three months to pick up stray dogs, his wage to be at or near the hourly rate of 85)1, now paid by the city for other labor. An application for the transfer of an On Sale Beer & Wine liscense from J. L. Harrigan to Clarence H. & Vera F. Pyle and an application for a Beer & Wine Importers liscense from the Gilroy Bottling Works were read. No objection was made. An application from a Filipino music instructor to rent a room in the auditorium for one day a week was not granted. It was the opinion of the Council that the auditorium was for the benifit of the people of Gilroy and not a commercial enterprise. Mayor Milias announced that the Gilroy High School Band had asked for r~ the use of the auditorium for a concert to be given by it at an undeter- ~ mined date in the near future. Permission was granted at no charge. Mayor Milias announced that the Santa Clara County Cattlemens' Ass'n. had requested the use of the auditorium for a convention to be held on April 20, 1946. Permission was granted at no charge. Senate Resolution No. 38 from the Legislative Department of the State of California was read. The resolution explained the conditions under which state monies were to be allocated to cities and counties under the Construction and Employment Act for public works and facilities. It was the opinion of the Council that the conditions set forth in the resolu- tion were agreeable to the situation in Gilroy. Senate Resolution No. 33 from the Legislative Department of the state i~~ of California was read, authorizing the taking of a special census by lJ Cities in order that cities might receive gasoline and in lieu tax allo- cations on the basis of the new population and explaining the procedure of making application to the Director of the Bureau of Census. On motion by Councilman Stout, seconded by Councilman Martin anddarried, , the City Clerk was instructed to write to the Director of , the Bureau of Census that Gilroy would like to have a census taken under the conditions set forth in the Resolution. Deedsfrom the property owners for property for a proposed alley running 828 from Third Street to Fourth Street between Monterey Street and Eigle- berry St~eet were presented. Resolution No. 153 was presented and read. Motion by Councilman Martin; seconded by Councilman Heiner that resolution No. 153 be adopted. Ii I I I - 829 Mr. James Wilkerson appeared before the Council concerning the er- ection of a residence building on his property on the corner of Fourth and Dowdy streets. He stated that he had been told that he could not obtain a permit because there was not room to place the house on the lot and observe the required set back and distances from neighboring prop- erty. He stated that there was room and that the required set back and distances could be observed. The council asked him to submit a plan showing outside dimensions of the building, the position it would occu- py on the lot and make application for a permit; also to submit the deed to the property for inspection by the City Attorney. The application would then be acted upon by the Council. The matter of the proposed alley in the Renz subdivision was discussed and in view of the fact that the alley was not necessary for power lines, sewer and water facilities and due to the objection of Mrs. Serpa~' one of the proper~y owners affected, it was decided to drop the matter for the present. Mr. Ed Hanna appaarea and suggested that a deposit be required from those wishing grade stakes set for sidewalks and curbs. He stated that two weeks to complete the work, unless granted further time in writing by the City Inspector and that the $25.00 be refunded to the applicant on satisfactory completion of the work. Mr. Hanna then called attention to the fa.ct that the new rolled type curb being used in the newer subdivisions.of the'City were in conflict with the present ordinance on curbs and sidewalks. The Council decided that the ordinance should be amended to permit the use of the new type curb in the newer subdivisions. It was brought to the attention of the council by the City Inspector i . that repair work had been started on a building on the old Fowler prop- -...J erty on North Monterey Street, now belonging to the McAlpine Estate, and that no permit had been granted them to make repairs. It was agreed by the Council that the work should be stopped and no permit granted. Dis- cussion of instituting condemnation proceedings against this and other properties on Monterey Street followed, it being the opinion of all mem- bers present that some other buildings were also unfit for occupancy and that. it is to the best interests of the City that these building be torn 830 down. The Mayor appointed councilman Reiner to inspect properties on Monterey street with this in view. The bill for work done by the City in cleaning up the Fowler lot . following the fire was discussed. The l1ayor instructed the City Clerk to write Mr. Sydney Johnson, lawyer for the McAlpine Estate, and re- quest that the bill be paid. Reports of the City officers were presented and read. Motion by councilman Heiner, seconded by councilman Martin and carried, that the reports be accepted as read and placed on file. Motion by councilman Stout, seconded by councilman Martin and carried, that the bills as presented be paid and warrants be drawn for their sev- eral amounts.
