This regular monthly meeting of the Comnon Council is called to
order by His Honor Mayor George C.Milias.
Present:Councilmen George A.Martin,George M.Mason,Nat Heiner,J,H.
Wentworth,Davld V.Stout. Absent:Councilmen Henry J.Schilling.
A communication '~gnedcby. Dan Lemos representing local residents,
of Portuguese descent requesting permission to hold a parade on
Sunday,May 26th, is read.
A communication is read from the Gilroy City Planning Commission
recommending a building permit be gran ted to J.A. Wilkerson to erect
a dwelling at the northwest corner of Fourth and Dowdy streets.
A oommunication is read from the Division of Highways relative to
a recent resolution by the Council naming certain streets as streets
or major impportance, stating that Railroaa Alley from Old Gilroy
~treet to Depot Street; Depot Street from Monterey Street to Rail-
reed Alley and Seventh Street from Monterey Street to Railroad Alley,
should not be included.
A communication is read frGm the Division of Highways stating lhat
in accordance with action taken the following streets are now Streets
of Major Importance ,Resolution No.154 being oorreoted to inolude:xk.
Tenth Street from Eigleberry Street to Monterey Street;Ninth Street
from Monterey Street to easterly City Limits;Sixth Street from west
City Limits at Princevalle Street to Monterey Street;Carmel Street
from Sixth Street to First Street;Hanna Street from Sixth Street to
First Street;Eigleberry Street from Tenth Street to First Street;
Forest Street from Ninth Street to Leavesley Road.
A communication is read from the Governor of the State of Calif-
ornia stating that legaltsteps are completed to assist city and
county officials in establishing locally directed disaster planning
programs.

A communication is read from the Santa Clara County Cattlemen's
Association thanking the Mayor and Council for use of Wheeler Audit-
orium for their recent meeting.
A communication is read from the Department of Commerce,Bureau of
Census, acknOwledging receipt of information that $390.00 had been
deposited in the Bank of America to the credit of the Su~rvisor of
L.
Census.
A communication from DOdge's Greater Shows and Thrill Circus
requesting a permit to conduct a carnival in Gilroy starting ~ay
21st, is presented and read.
A communication is read from the Gilroy Pub~ic Schools requesting
the Common Council to authorize the closing of the extension of
Forest Street from the southern boundary 0 f t he nigh school premises,
beginning at the intersection of Forest Street and 1. O. O. F.Avenue and
extending north to the northern boundary of the same property.
A communication is read from the Gilroy Public Schools requesting
the Common Council to authorize the closing of Second Street from
Carmel Street east to the Alley between Hanna Street and Carmel Street;

Motion By Councilman Stout,seconded by Councilman Martin and carried
that the action of the Gilroy City Planning Commission recommending
the granting of a building permit to J.A.Wilkerson to erect a dwelling

Mr.Sydney Johnson,member of the Gilroy Higb School board, now appears
before the Council to discuss the closing of Forest Street as requested
in the board's letter.
Mr.Albert Gurries,member of the Gilroy High School board now appears

before the Council to speakm on the matter ot olosing ot Forest Stre~t
and suggesting that a meeting of the Council and the school board be
held in the near future at which time this matter can be discussed.

The Mayor suggests that the school board set the date for the meeting.
This is unanimously agreed upon the the Council.
Mr.Willlam Werner now 8p~ars before the Council to discuss the
closing of Forest Street and urging a public hearing be held before
any action is taken.
Mr.D.E.cipperly representing Dodge's Greater Shows and Thrill Circus
now appears before the Council to discuss his request for a permit to
show in Gilroy for 6 days commencing May 21st.

Motion by Councilman Stout,seconded by Councilman Heiner and carried
that no permit be granted to IDadge's Greater Shows to hold a carnival
in Gilroy.

GRANTING TO SOUTHERN PACIFIC COMPANY A PERMIT FOR THE CONSTRUCTION,'
MAINTENANCE AND OPERATION OF A SPUR TRACK IN AND ACROSS LEAVE SLY ROAD
IN THE CITY OF GILROY.

W~REAS, it appears to this ~ouncil that the Southern Pacific
Company, a corporation, has applied for and is desirous of procuring
a permit to oonstruct,maintain and operate a spur traokacross Leavesly
Road in the City of Gilroy and the description of the center line of
the proposed track across said Leavesly Road is as ltollow.,to wit:
Beginning at a pOint on the southerly line of Leavesly
Road distant thereon 30 feet,more or less,measured in
an easterly direction from the intersection of said sou~
herly line of Leavesly Road with the westerly line of
Southern Pacific Company's right of way;thence in a
northerly lirection over and across Leavesly Roadfor a
distance of 60 feet,more or less, to a point in the nort
herly line of Leavesly Road ,said point being distaat 33
feet,more or less,measured in an easterly direction alo~
said northerly line of Leavesly Road from its intersect-
ion with the westerly line of the Southern Pacific Comp-
a~ts right of way;thence continuing on into pDivate
property.
It further appearing that the construction of said spur track
is necessary and conveniene for the proper operation of said Southern
Pacific Company in providing service for industrial concerns;
And it further appearing to this Council that the construction of an
additional track aoross said Leavesly Road in the location above
described will not materially interfere with the public travel upon
said' road there being three tracks across said raod at approximately
the same location at the present time.
NOW,THEREFORE, BE IT RESOLVED by thas Council that the said Souther.
Pacific Company be and it is hereby granted a revocable permit to
construct,maintain and operate a spur track across Leavesly Road in
the location above desctibed.
Said spur track shall be constructed with upper surf~ce rails flush
with the existing surface of said Leavesly Road and grantee shall
improve such road lying between the rails of said traok and two feet
outside thereof in the same manner and with the same materials as shall
be used in the adjacent portions of said road.
Said spur shall be used for industrial purposes and the transportation
of freight only, and not as a main line.
This resolution shall be in force and effect from and after its
passage.

Notification of alcholic beverage license applications-transfer
from Francis S.Cronan,50 N.Monterey St. to John B.Casella and Joseph

The matter of the parking of trucks belonging to the DeWitt Trucking
Company,on North Eigleberry Street is discussed and the Clerk is
ins tructed to tell the Traffi c Officer to investigate this matter. by
Councilman Heiner states that he will prepare a written report on
his investigation of buildings which should be condemned.

RESOLPTION OF THE COMMON COUNCIL OF THE CITY OF GILROY
APPROVING SECOND SUPPLEMENTAL MEMORANDUM OF AGREEMENT FOR
EXPENDITURE OF 1/4 CENr GAS TAX ALLOCATED FOR STATE HIGHWAYS.

WHEREAS, the State of California,through its Department of Publi~
Works,Division of Highways,has presented a second sup)lemental memo-
randum or' agreement in accordance wi th a projeot statement submitted
by the City for expenditure of the 1/4 cent gas tax for the 1945-47
biennium allocated for State highways in the City of Gilroy;and
WBEBEIS, the Common Council has heard read said agreement 1n full
and is familiar with the contents thereof;
THEREFORE, be it resolved by the Common Council of the City of
Gilroy that said agreement for expenditure of the 1/4 cent gas tax
allocated for State highways be and the same is hereby approved aDd
the Mayor and City Clerk are directed to sign the same on behalf of
the said City.
