This regular monthly meeting of the Common Council is called to
order by His Honor Mayor Beorge C.Milias.
Present:Councilmen George A.Ma:rtin,George M.Mason,J.H.Wentworth,
Ray L.Stevens,James B.Thomas. Absent: Councilmen Nat Heiner.
Minutes of the meetings of JUly 1 and 29th and Board of Equal-
ization meetings of July 5th,12th and 17th are read. Minutes of
the meeting of July 1st are corrected to reas (page 851,paragaph
7) that the pipe be laid through the city reservoir property---.
With this correction noted the minutes are approved as read.
A communication is read from the Gilroy Chamber of Commerce
asking that consideration be given to installation of electric
stop signals at 6th & Monterey streets and that theY2zecemme~d
ph.e':in$talht:!ion of parking meters.
The letter of transmittal and the report and accounts fram Logan
and Frazer,city auditors, for the fiscal year 1945-1946 are presented,
the letter of transmittal being read.
A communication is read from Logan and Frazer,certified ~b11c
account ants, submi tt ing an offer to audit the books and recor ds 0 f
the CJi ty 0 f Gilroy for the fiscal year 1946-194'1, und er the same
terms and conditions of the previous year, for the sum of $250.00.
A communication is read from the Gilroy War Memorial Association
requesting a donation of $25.00 for certain expenses with the under-

standing that this money would be returned upon sale of the bonds
of the d1s trict.
The annual report of the Gilroy Public Library is presented and
read.
A Sale Agreement between Edmund H.Piedmont and Anthony Rubino,
James S.Rubino and Jesse A.Rubino, relative to the garbage
franchise, is presented and read.

A communication is read from Byers Bros. relative to the care of
the Police car.
A Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax for
Streets of Major Importance is presented and read.

Motion by Councilman Martin,seconded by Councilman Mason that

ADOPTING BUDGET AND APPROVING MEMORAIDUM OF AGREEME:N'r
FOR EXPENDITURE OF 1/4 CENT GAS TAX ALLOCATED FOR
STREFrS OF MAJOR DrPORTANCE.

WHEREAS, a memo rand um. of agreement has been p: esented
to be entered into with the State of California and acccr dance
with a project statement for expendinre of the 1/4 cent gas
tax for t he fiscal year 1947 allocated for street of major
importanoe other than state highways in the city of Gilroy;and
WHEREAS, the Common Council has heard read said agree-
ment in full and 1s familiar with the contents thereof;
THEREFORE, be 1t resolved by~ the Common Council of
the City of G11~oy that Baid project statement be and is hersbJ
adopted as the budget of proposed expenditures of the 1/4 cent
gas tax allocated for streets of major importance other than
state highways ,and said agreement be and the same is hereby approved
and the Mayor and the City Clerk are directed to sign the same on
behalf of said City,sa1d agreement to be binding upon the City
upon its execution by the autl:)orized officials of the State.
ADOPTED AND PASSED this 5th day of August,1946 by the

Mr.Anthony Rubino now appears before the Council and states that
he and his b~others will endeavor to carry out the provision of the
LJ garbage franchise con&raot of Mr.Piedmont the same as in the past.
Motion by Co~ncilman Thomas,seconded by Councilman Wentworth and
carried that the City accept the assignees of Mr.Edmund Piedmont-
the Rubino Brothers-as per assignment of the garbage franchise
contract on file with the City Clerk.
Motion by Councilman Mart in, seconded by Co~ncilman Stevens and
carried that the audit report of Logan and Frazer,city auditors,
be accepted as read and placed on file.

Motion by Councilman Mason, seconded by Councilman Martin and
carried that the offer of Logan and Frazer to audit t~e city's books
and recD~ds for. the fiscal year 1946-1947, under the same terms and
conditions of the fiscal year 1941-1946, for the sum of $250.00, be
accept ed.
Motion by Councilman Wentworth, seconded by Councilman Stevens and
carried that the annual report of the Gilroy Public Library be
accepted as read and placed on file.
The Mayor instructs Councilman Mason,chair.man of the Finance
Committee,to consult with the Library Board relative to the all18w-
ance for Pealfl G.Lavin.
A letter from the Senate Committee on State and Local Taxation is
presented and read. The letter is discussed and it is unanimously
agreed to have the City Clerk reply to the communication.
Motion by Councilman Mart in, seconded by Councilman Thomas and
carried that the city donate the sum of $25.00 to the Gilroy War
Memorial Association,with the understanding that this money be
re"..ed to the city when *he bond issue is carried.
The matter of servicing of the police car is discussed and it
is agreed that this matter be discussed further upon the return
of the eJi ty Marshal from hi s vacation.
The matter of the survey made by the Traffic and Safety Committee
of the Division of Highways is discussed. Mr.Gus Brodersen now
appears before the Council 'and states that he had a discussion of
the survey with one of the men engaged in the survey,the latter
stating that another survey may be justified.
The matter of parking meters is discussed. It is unanimously
agreed that the traffic officers should continue tagging cars and
the Street Committee seek infor.mation on the subject of parking
meters from cities of comparable size.
The Clerk is ins tructed to advise the ChJlamber 0 f Commerce f1
the action taken on traffic s jgnals and ];a rking meters.
-Mr.Ernest Harrison now appears before the the Council with a
petition signed by 14 residents and property owners residing in
tre four hundred block on Northe Eigleberry street and on Second
Street between Monterey Street and Church streets asking that
trucks be prevented from parking at and near the junction of First
and Eigleberry streets.
The City Sttorney is instructed to check the city ordinances
in regard to vehicles parking on the streets after certain hours

and if the provisions of the ordinanoes are being violated the
Traffic officers are to be notif1ed.
Applications for One Sale Beer & Wine by Louis De Lorenzo and
Victor Rizz1,144 Lewis Street and and On Sale Beer license for
Sam Nishikawa,153 S.Monterey Street, are presented. No objection
1s made.
Councilman Mason states that he has had an offer to p*rchase
the building looated on the city reservoir property and used for
an a1r raid lookout station. Councilman Mason is instructed to
investigate the offer further.
Mr.Gus Brodersen now appears before the Council ~.r~ej1ng to
purchase the property on whioh the 0 ity coprorat ion yard is located.
Reports of the city officers are presented and read.
Motion by Councilman Martin,seoonded by Counoilman Mason anQ
carried that the reports of the city offioers be accepted as read
arid placed on file.
Motion by Councilman Martin, seconded by Councilman Thomas and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
