This regular adjourned meeting of the Common Counoil is called
to order by His Honor Mayor George C.Milias.
Present:Coun.~1men George A.Martin,George M.Mason,Nat Heiner,
J.H.Wentworth,Ray L.Stevens,James B.Thomas. Absent:Councilmen
None.
RESOLUTION NO.163 is presented and read.
Motion by Councilman Heiner,seconded by Councilman Mason that
RESOLUTION NO.163 be adopted.

BE IT RESOLVED by the Mayor and Common Council of the City of
Gilroy, at regular session assembled, that
WHEREAS, the Southern Paci~lc Company raised its main line
tracks within the said City of Gilroy, under and pursuant to the
permission of the Common Council of said City~ and

WHEREAS, the said Southern Pacific Company, by and through
its duly authorized agents agreed with the Common Council of the
City of Gilroy, by and through its duly authorized agents, to
maintain the crossings within their right of way in said City at

such crossings where said main tracks were raised and to improve
the approaches to said main line tracks to the end that street
crossings over said main line tracks would have a uniform and
gradual g~~de over sa~d main line tracks, and

vVHb"REAS, s'aid Southern Pacific Company have permited and
allowed its drill or spur tracks running parallel to said main
line tracks to be and remain below the grade of said main line
tracks, thereby causing vehicles to encounter an abrupt or sudden
change of grade between said main line tracks and said spur or
drill tracks.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Gilroy, that the said Southern Pacific Company so improve
and maintain its right of way in said City of Gilroy at street
crossings so that the approaches over its tracks are gradual, and
that the thoroughfare between the main line tracks and the spur
or drill tracks be gradual and not abrupt as they now exist.

Mr.C.Davison now apperas before the Council to discuss the matter

of the Ci ty giving him a QuitClaim Deed to a portion of an unopened
alley lying in Block 5 North,Range 2 West.
The City Attorney is instructed to draw up the necessary Resolution
with reference to the city quit claiming its right to a right of way
for an alley in Block 5 North,Range 2 West.,reserving to the city its
present sewer easement.
The Mayor now discusses the matter of a Building Permit for Sam
Newton to erect a building on his lot known as described as Lot 7,
Blook 1 South,Range 2 East.A drawing'presented by MrnNewton shows
all buildings on the lot,their size and location and includes the

! building for which he is requesting a permit.
U !vIr. Newton now appears before the Council and is asked by the Mayor
what further building he intends to do on this lot ,providing the
Council grants him a permit to erect the building he is applying for.
Mr.Newton answers that he intends to build a small dwelling on the
front Dart of the lot,to be set back from the outside line of the

property the average of the other houses in the blook,and th!t the
dwelling will be used by himself,and after completion of this dwelling
he does not intend to build any more buildings on this lot.

I~otion by Councilman Stevens,seconded by Councilman Martin and
carried that a Building p~ermit be granted to Sam Newton to ereot
the building,shown in his drawing, on his lot, known and described
as Lot 7,Block 1 So~th,Range 2 East.
Mr.Harold Holden,representing Mr.Morse of the Palace Motor Lodge,
North Monterey Street, now appears before the Council to discuss the
the proposed erection of a truck service station on property oppmsite
the Palace Motor Lodge, stating the the owner haS. a oons idera ble inv-
estment and thattrucks driving in and out of the proposed service
station would be detrimental to his client's business.

The City Attorne7:" calls to the attention of the Council the prov-
isions of the Zoning Ordinance wh~Qh would require the securing of
a Use Permit from the Gilroy City Planning Commission before any
building could be done and that the issuing of a Use Permit would be
preceded by a public hearing called by the Planning Cormnission.
Mr.Ed.Hanna presents a map of the MCAlpine SUbdivision,Tract 401,
in Lot 5,Block 3 & 4 North,Range 1 East, for acceptance by the Council.
The City Attorney calls to the attention of the Council that I.,Ir..T.
Kenneth McAlpine has a suit on file against the 6ity of Gilroy and
that it should be dismissed by Mr.MaAlpihe to allow clear title to __

pheralley'aldilg:the east end of the property, to be passed.
The matter of the use of the McMullen property,located on the west
side of Forest Street between Old Gilroy and Sixth streets, for play-
ground purposes is discussed. The City Attorney is instructed to
llI:t::tBm;l!1t: to make an agreement with the County of Santa Clara on their
delinquent taxes against this property.
The matter of the use of a portion of the Old Septic tank property,
currently under lease to George C.Renz, for ho.sing some of the city
equipment is discussed and Councilman Wentworth is instructed to
discuss this matter with Mr.Renz.
The City Clerk is instructed to request the insurance ,~en~ carrying
insurance on the city vehicles to submit an over-all covering note ..
on the maintainer. ~
Councilman Martin discusses his investigation of lighting conditions
at the Gilroy Public Library and is instructed to have the Coast
Counties Gas & Electrio Compmy draw up specifications that can be
submitted for bids.
Mr.Frank Leef,ohairman of the Recreation Commission, now appears
before the Council to give an outline of the activites of the
Conooission during the past year and to request an appropriation of

$300.00 to oarry on the program. Mr.Leef also presents a sketoh of
his ideas on the developing of a recreation center around the Vfueeler
Auditorium and is requested to submit a larger drawing to scale.
Motion by Oouncilman Stevens,seoonded by Oouncilman Thomas and
carried that the Recreation Commission be given the sum of $300.00 to
carryon their activities.
ORDINANCE NO. 450 is presented and read.
Motion by Councilman Wentworth,seconded by Oouncilman Stevens that
ORDINANCE NG. 450 be adopted.

TAXICABS AND RENT CARS IN TEE CITY OF GILROY,PRESCRIBING TERMS
AND OONDITIONS UNDER WHICH SUCH OPERATIONS NIAY BE CONDUCTED,
PROVIDING PENALTll';S FOR THE VIOLAT ION OF THIS ORDINANCE AND
REPEALING CONFLICTING ORDINANCES.
