Minutes 1947/02/03 .,..- 88a Gilroy,California February 3,1947. This regular monthly meeting of the Common Council is called to order by His Honor Mayor Ge orge C.Milias. Present: Counc ilmen George A.:Martin,George M.Mason,Nat Heiner ,J.H. Wentworth,Ray L.Stevens,.James B.Thomas. Absent:Councilmen None. Minutes of the meetings of January 7th and 20th are read and approved. A comruunication is readfrom Chesbro & Eustice with referenoe to insurance on the city's new maintainer. A communication is read from Loggn & Frazer,city AUditors, stating that they had exarnned the city books and recrods for the period ended December 31,1946 a_d had found them in good order. A communication is read from Mrs.Edna Lord, member of the Board of Trustees of the Gilroy Public Library, submitting her resignation. A report dated .Tanuary 20th from the Santa Clara County Health Department,setting forth the results of water samples taken, is read. A communication is read from the Division of Highways relative to a form resolution and a letter from the Superintendent of Streets 88,1 with respect to certain grade crossings over the Southern Pacifio Company's right of way, is read. The matter of a lease to the City for maintenance of a driveway in Block 3 & 4 North,Range 1 East, from the Southern Pacific Company, is discussed and it unanimously agreed to hold this matter over to a future date. Motion by Councilman Thomas,seconded by Councilman Martin and carried that the maintainer be insured on a contractors Equipment Floater vovering Fire, Theft and Collision with a $50.00 deductible applying to the Theft and Collision-rate It% per year-or coverage for $3,000.00- $45.00 fer one year-all ~S3 per letter from Chesbro ...., ..... & Eustice and that they be awarded this insurance. The report of water samples and the communication from Logan & Frazer are ordered filed. Motion by Counoilman Martin,seconded by Councilman Mason and carried that the resignation of Mrs.Edna Lord be acoepted and the Clerk instructed to write a letter to her thanking her for her many years of servioe to the city. RESOLUTION NO. 164 is presented and read. A letter addressed to the Council and signed by the Superintendent of Streets relative to grade crossings is read. ...... .... Motion by Councilman Stevens,seconded by Councilman Heiner that RESOLUTION NO. 164 be adopted' am the letter from the Superintendent Of Streets be forward to the Division of Highways: RESOLUTION NO. 164 BE IT RESOLVED by the Mayor and Common Council of the City of Gilroy,at regular session assembled, that: WHEREAS, the Southern Pacific Company has reised its main line tracks wihtin the said City of Gilroy,under and pursuant to the permission of the Common Council of said City, and ~~EREAS, the said Southern Pacific Company,by and through its duly authorized agents agreed with the Common Council of the City of Gilroy, by and through its duly authorized agents, to maintain the crossings within their right of way on said City at suoh cross- ings where said main tracks were raised and to improve the approaches to said maine line tracks to the end that street crossings over said main line tracks and drill or spur tracks would have a uniform level grade and the approach roadway to said crossings would have a gradual easy grade to said orossings of the above-mentioned tracks, and ~ ~ ~~REAS, said Southern Pacific Company have permitted and allowed its drill or spur tracks running parallel to said maine line tracks to be and remain below the grade of said main line tracks,thereby causing vehicles to encounter an abrupt or sudden ohange of grade between said main line tracks and said spur or drill tracks; NOW,THEREFORE,BE IT RESOLVED, by the Common Council of the City of Gilroy, that the said Southern Pacific Company so improve and maintain it right of way in said City of Gilroy at street cross- ings so that the ~pproaches over its traoks are gradual,and that the thoroughfare between the main line tracks and the spur or drill ~ I ' i i I....... .~ I 885 tracks be level and not abrupt and uneven as they now exist. Said Quit Claim Deed is hereto attached and made a part of this ~ resolution. ~.. The Mayor states that he will appoint the members to the Recreation Commission at the next regular meeting. Councilman Wentworth now discusses the purchase of a supply of water bills for the Water Department. This matter is placed in the hands of the Water Committee for action. Councilman Heiner states that the new license ordinance is ~aady to present to the Council for discussion and it unanimously agreed that the Council meet,Monday,February 10th, for discussion on this subject. As this is the date and time specified in a legal notice-ORDINANCE -- No.449- published in the Gilroy Evening Dispatch-giving notice that '.. any and all persons interested could appear before the Council and protest the closing of the alley known as Baldocchi Alley and located in Block 2 North,Range 1 East, the Mayor announoes that the Council is now ready to hear any and all pwotests. No person appears to make any objection to the olosing of the alley :' .; ,?, J~ known as Baldoochi Alley,located in Block 22North,Range 1 East. l'ilotion by Councilman Martin,seconded by Councilman Mason and carried that the alley known as Baldocchi Alley,located in Block 2 North, Range 1 East, be closed at the west entrance. The Superintendnet of Streets is instructed to erect a fence,four feet in height,paint the fence white and place red reflectors o~ the fence,said fence to erected at the West or Monterey entra~e ~ ~ to the alley. The City Attorney now discusses Ordinance No.450-Taxicab Ordinance- and answers several questions relative to the ordiaance asked by taxicab operators present; suggests that a resolution should be drawn up allooating parking places for the several taxioab stands and that a list of stands be presented to the Cou~oil by the oper- ators. , 887 It is unanimously agreed that ODRINANCE NO. 451 shall be published in the Gilroy Evening Dispatch. Motion by Councilman Wentworth,seconded by Councilman Thomas and carried that the salary of Graydon B.Carr, Deputy Tax Collector,be increased from $15.00 per month to $&0.00 per month effective Feb- ruary 1,1947. The matter of ths;"parking of cars on I'v1:artin Street ,5th Street and Sixth Street is disoussed and the Traffic Offioer in instructed to cheok this matter. Reports of the City Officers are presented and read. Motion by Councilman Heiner,seoonded by Councilman Stevens and carried that the repo rts 0 f the city off'icers be ac cepted as read and plaoed on file.
