This regular meeting of the Common Council of the City of
Gilroy was called to order by His Honor, George c. Milias.
Councilmen present: J. H. Wentworth~ Ray L. Stevens, J. B.
Thomas, George A. Martin, George M. Mason and Nat Reiner.
Absent Councilmen: None.
The minutes of the regular monthly meeting of December 1,
1947 were read and approved.
Mayor Milias announced that due to the large amount of bus-
iness to be taken up at this meeting the appointments to be made
in the Fire Department would be taken up at a special meeting
on M:onday, January 12th, at 8:00 P. M.
The Deputy City Clerk informs the Common Council that I~.
G. A. Filice of the Filice & Perrelli Canning Co. would like to
meet with the Council on Wednesday, Jan. 7th. at 8;'P. M. Mayor

Milias announced that the Common Council would meet at that time
to discuss the sewage problem with him.
A letter from the Filice & Perrelli Canning Company express-
ing the regrets of Mr. G. A. Filice at not being able to meet
with the Council at a previous date, due to illness, and stating
that in a few days he would be available to meet with members of
of the Council was read and ordered filed.

A letter from ~~. August Piedmont, stating that a picture
had been taken of the spot at the intersection of Fifth &
Monterey Streets where l~s. Jack Scherrer fell and that the
City might now proceed with repairs of the cross walk, was read
and ordered filed.

A letter from the Division of Highways, stating that cross
walks would be painted on the highway at I.O.O.F. Ave. and at,

St. Mary's Convent, as requested in our letter of December 5th.,
was read and ordered filed.
A letter from the International Association of Maohinists,
Local 504, thanking the Common Council for the use of the City
Hall as a polling place, was read and ordered filed.
A request from Mr. Arthur Alves for use of the Wheeler
Auditorium on February 19, 1948, for a Pot Luck Supper and
Court of Honor for the Boy Scouts was read.
A letter from the Community Welfare Association soliciting
funds for it's campaign was read.
A letter from the League of California Cities announcing
a raise from $150.00 to ~~l90. 00 in the annual servioe charge

and explaining the reason for the raise, was read.
Motion by Councilman Reiner, second by Counoilman Wentworth
and carried that the City of Gilroy re-enter the League of
California Cities for the annual servioe charge of $190.00.
Motion by Councilman Stevens, second by Councilman Thomas
and carried that the Boy Scouts be allowed the use of The
Wheeler Auditorium on February 19, 1948 for their Pot Luck
Dinner and Court of Honor, free of charge. The Deputy City
Clerk was instructed to so notify Mr. Alves.
The Deputy City Clerk was instructed to look up the amount
donated by the City of Gilroy to the Community Chest last year
and report the amount to the COTIlli~on Council at the next meeting.
This being the time specified in letters sent to the several
~ Oil Companies, requesting bids on the gasoline requirements of
the City of Gilroy for the period January 15, 1948 to January
15, 1949, Mayor Milias directed the opening of the bids. Before
the bids,cwere opened it was unanimously agreed by the Common
Council that bids would receive consideration from only those
companies who were tax payers in the City of Gilroy.
The bids were opened and read as follows: Tidewater Associ-
ated Oil Co., regular grade gasoline, 19.4~ per gallon, Seaside

Oil Company, Silver Gull Gasoline, 17.6t per gallon, Shell Oil
Company, Shell Non Premium Gasoline, 19.4t per gallon, General
Petroleum, L~obile Gasoline, 19 .l~ per gallon, Richfield Oil
Corporation, Hi-Octane Gasoline, 19.4~ per gallon, Union Oil Co.,
76 Gasoline, 19.4~ per gallon, less.Ol~ per gallon, and Standard
Oil Company, Chevron Gasoline, 19.4t per gallon. All bids were
based on present posted tank wagon prices, subject to change and
including State tax of 04~t per gallon but excluding Fedral tax
of .0Jt~ per gallon.

Motion by Councilman Wentworth, second by Councilman Mason
and carried that the contract to furnish the gasoline require-
ments for the City of Gilroy for the period January 15, 1948 to
january 15, 1949, be granted to the Seaside Oil Company at 17.6t
per gallon.
This being the time specefied in an advertisement calling
for bids on comprehensive liability, fire, theft and collision
insurance, bids from the Pacific Indernnity Company, represented
by Chesbro & Eustice, and bids from the Travelers' Insurance Co.,
represented by Mr. August Piedmont, TIere read and referred to
the Finanoe Committee and the City Attorney for study and recom- ~
mendation...
Bids for replacing concrete floor in the Fire House were
opened and read. George C. Renz submitted a bid of $575.00 for
laying a 6" floor, with wire mesh throughout and cutting off doors
to fit the new floor, V~. Radtke submitted a bid of $747.40 for
remooving 628 sq. ft. of concrete floor and replacing approximat-
ely 10'68 sq. ft. of 6" floor, reinforced with 6x6xlO mesh. The
Deputy City Clerk was instructed to oall ]~. Renz and inquire of
him if his bid included the taking up of the old floor. Mr. Renz
was called and he informed the Common Council through the Deputy
Clerk that his bid included the taking up of the old floor.
Motion by Councilman Stevens, second by Councilman Heiner and
carried that George Renz be granted the contract for replacing
the concrete floor in the Fire House and cutting off the doors to
fit the floor for his bid of $575.00

City Attorney Byers informed the Common Council that he had
received complaints on the culvert in front of the Stationery
Store on North Monterey Street and that it presented a hazard to
pedestrians. It was also brought to the attention of the Common
Council that there was another culvert of the same type in the
oross walk on Fifth & Eigleberry Sts.
Motion by Councilman Thomas, second by Councilman L~rtin and
carried that the two culverts be immediately remooved. Council-

man Martin was directed to order the oulverts remooved the follow-
ing day.

Mr. E. E. Eustioe appeared before the Council to discuss fire
insurance on City buildings and contents and handed schedules to the
Councilmen showing new Reproduotion and Insurable values. Mr.

Eustice was requested to present a schedule of insurance now carried
on City buildings that it might be compared with the new values and
was asked to present the proposition at a later date.
Resolution No. 195, accepting from Paul Kuehling a Grant Deed
to a portion of Lot l6, Block 6 North, Range 5 West, necessary to
straightening of the highway near First & Hanna Streets, was presen-
ted and read;
Motion by Councilman M:ason, seoond by Councilman I!'homas, that
Resolution No. 195 be adopted.
ADOPTED this 5th day of January, 1948 by the following vote:

BE IT RESOLVED by the l:1ayor and Common Counc il of the City of
Gilroy as follows:
That all travel shall proceed in a southerly direction on that
certain alley from Fourth to Seventh Streets in the City of Gilroy,
said alley being between Monterey Ilighway and Eigleberry Streets; and

BE IT FURTHER RESOLVED that all travel shall proceed in a
northerly direction on that certain alley from Old Gilroy Street to

Lewis Street, in the City of Gilroy, said alley being between the
Monterey Highway and Southern Pacific Railroad.
Passed, approved and adopted this 5th day of January, 1948, at
a regular meeting of the Common Council of the City of Gilroy.

Councilman Martin was directed to have the one way alleys properly
posted at both ends.
Councilman Martin announced that Supt. of Streets & Sewers, Carl
Weppener,had requested a thirty day leave of absence.
Motion by Councilman Martin, second by Councilman Heiner and
carried that Carl Weppener be granted a thirty day leave of absence
with pay.

RESOLUTION NO. 197.
rffiEREAS it has been proposed that the City of Gilroy initiate pro~ ·
ceedings to annex oertain territory lying outsid of, but adjacent
to and contiguous with, the Corporate Limits of said City, and
WHEREAS the Planning Commission of said City of Gilroy has made a
study of said proposal to annex, and has recommended to said Com-
mon Council of the City of Gilroy that the herein described terri-
tory be annexed to the City of Gilroy with The provision that the
owners of property situated therein first pay, or arrange to pay,
to the City of Gilroy, a, sum of money sufficient to pay their pro-
rata share of the cost of installation of sewer and water mains,
fire hydrants and fire alarm boxes, grading and graveling of unim-
proved streets, and the installation of curb and gutter when re-
quired, and
WHEREAS the City of Gilroy desires to annex 'said lands to said
City in order to provide additional tax revenue with which to im-
prove and expand its services to the taxpayer, and by such an-
nexa tion will be enabled to provide the owners and res ident.s of
property situated therein with the protection services of its Pol-
ice and Fire Departments, street lights, reduced utility and in-
surance rates which always follows when annexation to a City is
accomplished, and all of the priveleges of its Free Public Library,
together with the general benefits of service accruing by being an
intregral part of the Municipal Corporation;

NO~ TJIEREFORE BE IT RESOLVED that the Common Council of the City
of Gilroy, acting under the authority of Chapter 297, statutes of
1939 and amenfunents therto, proposes to annex to said City as
"Uninhabited Territory" under the requirements set forth above, the
aforementioned lands, which are more particularly described as
follows:
"BEGImUNG at the intersection of the southerly line of the
Recker Pass Highway (Bod:fish Mill Road) with the Westerly
Limit Line of the City of Gilroy and running thence west-
erly along the southerly line of Hecker Pass Highway 84.64
feet to the easterly line of Miller Avenue; thence along
said easterly line 1826.99 feet to the intersection with
the southerly line of Third Street; thence easterly along
said southerly line 727.48 feet to the westerly line of
~incevalle Street, being also the westerly Corporate Limit ~
Line of the City of Gilroy; thence northerly along said
Limit Line 1637.90 feet to the point of beginning." .-
BE IT FURTllliR 'RESOLVED that said lands proposed to annex be
known as the "First Western Addition", and
BE IT FURTHER RESOLVED that the 2nd day of February, 1948
at 8:00 o'clodk P.M. at the City Hall, Gilroy, California,
be set as the time and place when and where any persons
owning real property within such territory so proposed to
Q' anneXed and having any objections to the proposed annex-
atLon, .ay appear before the COL1mOn Council and show written
Dauae why such territory should not be annexed.

Attorney Byers stated that it would be necessary to publish
the resolution twice that those who may have objections to the
. .
annexqtion may appear and show cause.
Mr. Skillicorn and Itr. Kramm, representing the Shell Oil Co.
appeared before the Council concerning an application for a
permit to tear down an old and rebuild a new service station at
the corner of Monterey and Old Gilroy Streets. They were direct-
ed to meet Councilman Heiner and City Engineer W. J. Hanna the
following morning to discuss any change in plans which might be
necessary to the granting of a permit.
tmyor Milias asked Mr. Ed Hanna what was delaying the instal-
lation of the traffio signals. !~. Hanna stated that the lids to
the junction boxes were not available. Iv:layor Il/lilias directed Mr.
Hanna to get the work started and if necessary to have the lids
made locally.
Councilman Mason asked for discussion on the manner of col-
lection of payments due for recent curb and gutter installations.
It was unanimously agreed that each property owner should be bil-
led for the amount due and those balances which were unpaid at
the beginning of the next tax period should be added equally to
the first and second installments of the 1948 - 1949 taxes, no
interest to be charged until becoming delinquent on the 1948 -
1949 tax roll and then to take the same rate of penalty as del-
inquent taxes.
A proposed Resolution was discussed to close certain streets
and alleys running through school property between Hanna and
Carmel Streets and First and Third Streets. Mayor I.1ilias stated
that the School Board had expressed themselves as willing to
compensate the City of Gilroy in the amount of $1000.00, for clos-
ing these streets and alleys and that it would be better to
present the resolution at alat.er date.

Mr. Ed Ranna stated that he had been asked by the Federal
Housing Administration if the City o~ Gilroy would accept the
streets in the Renz addition after they were properly graded
and graveled. It was unanimously agreed by the Councilmen pres-
ent that the City of Gilroy would acoept the streets after they
had been properly graded and graveled.
The Deputy City Clerk requested an interpretation of the
liscense ordinance oonoerning the liscensing of local plumbers
and electrical contractors, stating that he had been lisoensing
them on a volume basis and that there had been some dissatis-
faction among them concerning the manner in which they were
liscensed. It was unanimously agreed that local electrical and
plumbing contractors should be liscensed on a volume basis.
Reports of the City officers were presented and read.
Motion by Councilman Heiner, second by Councilman Thomas that
the reports be accepted as read. Motion carried.
Motion by Councilman Wentworth, second by Councilman Thomas
and carried that the bills as presented be allowed and warrants
drawn on the treasury for their respective amounts.
Notification of applications for off sale beer and wine
liscenses.from Mathew J. Ramazane and from John R. Clark and
Alfred Ubtiok were presented. No objeotion was made.
Mayor !'i1ilias stated that there were many traffic violations
on Fifth Street and other back streets. The COL~aon Council
unanimously agreed that the traffio officers should be instructed
to spend more time on the back streets and Mayor Milias said that
he would so instruot them.
