The minutes of the last regular meeting ot Karch 1, 1948 were read and approved. t' Letters from the Southern Pacific 00. regarding a hazard created by the location of a stop sign at the S. P. Crossing on Leavesly were were Road w.s read and lit referred to the City Engineer to contaot the Division ot Highways to see i~ the le.ation of the sign could be changed 80 as to eliminate the the hazard. A letter from the District Attorney's Otfice announcing a Homicide ~ I l.... - 1 i I l.... i'"'", L 987 Investigation Course and urging attendance of experienced City Police Officers was read. The Deputy C1ty Olerk was instructed to refer the matter to the City Marshal and to intorm him th~t the a1ty would pay the expenses of those members ot the police torce who wished to attend. A letter was read from the District Attorney.s tttice concer- ning a meeting to be held on Drtmken Driving. Mayor ;f11ias announced that he would attend. A letter from Mr. Vernon Gwinn, act1ng President of the Gilroy Community Oenter, stating that Mr. W. B. Stuart, owner ot the bu1lding in which the Community Cent.er is housed had raised the ~. . ~ rent from ilPl5.00 per month to $37.50 per month was read. The war- rant tor $15.00,payment ot the rent tor the month ot ~rch, was returned with the letter. Motion by Counc1lmand !.!artin, second by Oouncilman Mason and carried that the City pay the monthly rental of $37.50 for the rooms used by the Community Center. A letter from the Santa Clara County Yar.m Bureau was read ask- ing that a member ot the Common Oouncil be appoin~ed to meet with -t ~e. Farm Bureau's Committee on Water Conservation. Mayor Mi1ias appointed Councilman Mason to represent the Council at the meeting of the Qo_ittee. A letter trom the State Compensation Insurance Fund which accompanied a check for t579.l4, a refund on the prem1um tor C~ pensation insuranoe, was read and ordered tiled. A report trom the County Health Department on the &Dal7~is of water samples was read; the report being satist~otory it was ordered tile d. A letter from Mrs. Duns requesting the Common Council tQ condemn a dwelling on her property on First Street because of 1ts lack ot aanitary faoilities and because it was unfit for human habitation was read. A lettertrom the Oounty Health Department was also read concerning the s~e property. The matter was referred to the Cl~7 Attorney's Otfice with directions to serve notice on the owner. A letter trom Mr. & Mrs. Harry Soholten, asking that the City fulfill its agreement in laying a 4- water main to his property on South Monterey Road was read and referred to Councilman Mason, chairman of the Water Committee. A letter from t~. Stephen Martin requesting a change in the lis- cense ordiXl,2lnce regarding the Motor ifransportation of Merchandise 988 was referred to the City Attorneys Office to see if it could be amended to cover unusual circumstances such as those claimed by Mr. Martin. 1he Deputy Oity Olerk was directed to inform Mr. Martin that the matter was being taken under advisement. A letter trom. Mr. August Piedmont -regarding a surety bond for all bonded employees of the City which was proposed by his Company at the regular meeting of the Common Council in March was read. The Finance Committee in Whose hands the matter had been ~ , ..." placed recommended that the proposal be not -accepted because the saving over the present method: of individual bonds was not great enough to warrant a change. It was unanimously agreed by all Oouncilmen present to accept the recommendation of the Finance Gommittee~and it was so accepted by motion of CouncIlman Stevens, seconded by Councilman Martin and carried. A letter was read from the Assembly Interim Committee on water Polution. Mayor Milias stated that a like letter kad bee~ received by the Water Supt. and that the City Clerk had forwarded to the Oommittee all the information requested in the letter to the Common Council. was read A letterAfrom the ~uality Furniture Co. requesting that a tree on the East side of Monterey Street, north of I.O.O.F. Ave., be remooved because it obstructed the view of the'companytssign from the south. It was unanimously agreed to refer the matter of the remooval of the tree to the Forestry Board :for recommendation. A letter was read from D. V. Stout referring to a former re- .. 1 ....i quest to rededicate a portion of Gurries Drive through property to be sold to st. Mary.s Parrish. Acting aity Attorney Bobert Byers stated that he had the ordinance prepared to accomplish this. _ Mr. Ernest Camino appeared before the Common Oouncil and ex- pressed dissatisfaction with the manner in which plumbers are liscensed by the City and also wIth the manner of inspecting the work of outside plumbers. It was agreed by the Common Council ~ that a meeting could be arranged at which the local plumbers and ~ electricians could meet with the Common Council and discuss the matter. Mr. Camino called attention to the fact that part of the alley in back of Bettancourt's Market is taken up with refrigeration equipment belonging to Mr. ~ttaD.1)ourt. Mayor Milias directed the building inspector to investigate the matter and report back to the Common Council. 9gB Mr. Anthony Alvers appeared before the Council requesting a change in the ordinance on regulation and control 01' dogs. The Deputy Oity Clerk was directed to ~e.d.the ordinance. It was the opinion at the acting City Attorney that property rights were in- volved and that the ordinance could not be changed as requested. Oouncilman Wentworth announced that the Becreation Oommission - ~ I 1 had requested that the City lay the pipe for water on the lot to ~ be used tor a playground and also, that the Commission would need some money soon. 'lbe laying of the pipe was placed in the hands 01' the Water Superintendent. Acting City Attorney Byers asked if ~itle Insurance should be taken on the McMUllen property which 1s to be used tor a playground, and he was instructed to do so. An on sale beer liscense application from Navarro, Guadalupe and - Henry Plata at 81 S. Monterey Street was read. No action was taken. Reports of the city officers were presented and read. Motion by Councilman Martin, second by Councilman Mason and carried that the reports be accepted as read and placed on file. Motion by Oouncilman Martin, second by Councilman Stevens and carried that bills as presented be allowed and warrants drawn on. the Treasurer for their respective amounts. Councilman Martin was directed to ascertain if George Benz wished to renew his lease on the old sceptic tank property. Ordinance No. 457 was presented and read. Motion by Councilman Mason, second by Counc ilman Martin that Ordinance No. 457 be adopted. o. ORDINANCE NO. 457 AN ORDINANCE OF INTENTION OF THE CITY OF GILROY TO PROCEED UNDER THE STBEE'l VACAlfION ACT OF 1941 AND VACATE CER'I'AIN STREETS AND ALLEYS IN THE JORDAN SCHOOL AREA OF THE CITY OF GILROY. --- Vote on motion to adopt ordinance No. 457. ORDINANCE NO. 458 .AN ORDINANCE OF INTENTION OF THE CITY OF GILBOY TO PROCEED UNDER THE STREET VACATION ACT OF 1941 ABD VACATE CERTAIN STREETS AND ALLEYS IN THE SO CALLED GURBIES TRACT AREA OF THE CITY OF GILROY. Vote on motion to adopt Ordinanoe No. 458. ~ Ayes: Councilmen Bay Stevens, George Martin, George Mason and .... J. H. Wentworth. Noes: Councilmen Bone. Absent: Councilmen J. B. Thomas and Hat Heiner. A proposed agreement between the City of Gilroy and the Dept. of Public Works concerning the maintenance ot public highways was discussed. Resolution No. 198 was presented and read. Motion by Councilman Martfn, second by Councilman Mason that Resolution No. 198 be adopted. RESOLUTION NO. 198 A RESOLUTION ADOPTING AND APPROVING A PROPOSED AGREEMENT BETWEEN THE CITY OF GILROY AND THE DEPARTMENT OF PUBLIC WORKS OF THE STATE OF CALIFORNIA ACTING BY AND THROUGH TEE DIVISION OF HIGHWAYS. THE COMMON COUNCIL OF THE CITY OF GILROY DO RESOLVE AS JroLLOWS: ... ... wBEREAS, the Gity of Gilroy, by and through its Gommon Council, said Common Council being the legislative and governing body of said City of Gilroy, desire to approve and adopt a certain prop- osed agreement providing for joint highway maintenance so offered to it by the said Depart.ment of Public Works ot the State ot California acting by a~d through the Division of Highways, the same being on tile with the City of Gilroy. THEREFORE, the Common Oouncil of the City of Gilroy, being the Legislative and Governing body of said muniCipality, do hereby adopt and approve the proposed agreement tor joint highway main- tenance, such agreement covering the first half of the calendar year 1948, and a c9PY thereof being on tile with the Clerk of the Oity of Gilroy. 991 ADOPTED AND PASSED this 5th day ot April, 1948, by the following votes: .&.res: Councilmen J.
