Minutes 1948/05/04 991 Gilroy, California May 4,1948. This regular monthly meeting of the Common Council is called to order by Ris Honor Mayor George C.Milias. Present Councilmen:George A.Martin,George M.Mason,Nat 1:1einer,J.H. Wentworth,Ray L.Stevens,James B.Thomas. Minutes of the meeting of April 5,1948 are read and approved. A communication is read from t he Forestry Board recommending that the tree in the parking area in front of t he Busy Bee Restaurant on North Monterey street be left where it is as it is in good con- dition and provides shade for the restaurant. A communication is read from the Safeway Store,15l N.Monterey Street, requesting a parking zone' in front of the store. A communication is tead from the Division of Highways relative to the STOP sign located at the intersection of Leavesley Road and Monterey Street t recommending the remcival of the sign. A cornmubication is read from Miss.Victoria Hugo,director of the A Cappella choir, thanking the Council for the use of Wheeler Auditorium for t heir recent concert. A card of thanks from Kearney Byers is read. Motion by Councilman Martin,seconded by Councilman Heiner and carried that the reconmendation of the Forestry Board- thattfile tree located in the parking area in front of the Busy Bee Restaurant be left where it is- be acc'epted and the Quailty Furnit.ure be advised of this action. Motion by Councilman stevens, seconded by Councilman Wentworth and carried that the report of Logan and Frazer be accepted and placed on file. Motion by Councilman Heiner,seconded by Councilman Thomas and ~ carried that a donation of $50.00 be made from the l:ieneral Fund ... to the Gilroy Volunteer Fire Department. Councilnlan l1ason discusses the Poundmaster situation stating that Henry Pierce, the present Poundrnaster, is difficult to locate when needed and that J:a.eCllas not worked with the street department for several months. It ia unanimously agread that Mr.Pierce be notified to contact the chairman of Street ~ommittee and if a satisfactory arrangement cannot be reached over employment that the chairman can dismiss Mr.Pierce. Application for transfer of liquor license-On Sale Beer and Wine- from Joe Leonardini to Don Gomes,595 Old Gilroy Street; application for an On Sale Beer license from Atts.C.DeCar11,57 W.7th Street and an application for an Off Sale Beer and Wine license from Michael ~ and William Pirozzoli,29 S.Monterey Street, are presented and read..J ~~objection is made. Councilman Mason discusses making a charge for making connections for water customers located outside the city limits and it is unan- imously agreed t hat in t he future any connections made for water customers outside the city limits the total c:ost of the installation must be paid by the customer. ~.,..... I ~ ....... ...... - g9a Councilman Yason also discusses the development of Castle.oad Park No.l subdivision which is ]bocated west o~ Miller Avenue and will be opened soon and the r'equest of M.J .Filice, OVlner of the subdivison for city water service. The use of transite pipe in the area is suggested due to the scarcity of cast iron and considerable discussion is had on the expansion of the water distribution system aldlng Miller Avenue and the First Western Addition. Councilman Wentworth discusses the extension of the city's sewer system into the First Western Addition and it is unanimously agreed that he proceed at once with procuring the necessary sewer pipe,manholex rings and covers.. Councilman WentvLOrth discusses the possibility of the city acquiring the property housing the Gilroy Rural Fire Department equipment from the heirs of the late H.E .Robinson. It is unanimously agreed that Councilman Martin contact the proper persons and report back to the Council. The Mayor states that the Street Department needs a water wagon and that JIi!r.Wentworth has me that he will sell. to the city for $700.00. It is unanimuusJ..y agreed that the Street. Conmittee investiga:te the equip- ment and report back to the Council. Mr.William Werner now appears before t he Council and s.tates that the Truck Owners Association is complaining about the lack of coordination of the traffie control lights. The City Engineer reports that the Div- ision of Highways has charge of the coordination and he will discuss this matter with them. Resolutions numbered 13,14,15 and 16 from the Gilroy City Planning Commission recommending original zoning for the First Western Addition and re-zoning of certain property located in the southwest section of the city, are presented and read. The i~ting City Attorney is instructed to prepare the necessary notices forfue Council on this matter. RESOLUTION NO.199 is now presented and read. WHEREAS, the Common Council os the City of Gilroy submitted the franchise or privelege for garbage and refuse disposal within the City~ Gilroy to bid pursuant to notice thereof published January 22,1948, and January 29,1948, as shown in the records in the office 994 of the City Clerk o~ said City of Gilroy; and WHEREAS, the City of Gilroy received a sealed,.written bid in the prescribed time,together with the proper certified check as a guarantee from Anthony Rubino and Jesse Rubino, doing business as Rubino ts Gilroy Garbage Disposal of Gilroy,California; and WHEREAS, the said bid was s ati sfactory. NOW, THEREFORE, BE IT RESOLVED: THAT the following bod of Anthony Rubino and Jesse Rubino be and is hereby a~Fepted and approved. .Anthony Rubion and Jesse Rubino will collect and dispose of all garbage aDd refuse within the City of Gilroy for a term of five (5) years from and after December 12,1949, and comply with all the terms and conditions of Ordinance No.428 of said City of Gilroy,on the same terms and under the same conditions provided for in "their present fran- chise or privelege agreement with the City of Gilro~. RESOLVED, further, that this Resolution take effect ~ and after it passage and approval.. Motion by Councilman Martin,seconded by Councilman Heiner and carried that the dompensation for election officials for the May 3rd election be $15.00 eaCh instead of $8.00 as originally voted. Motion by Councilman Mason, seconded by Councilman Stevens and carried that the sum of $5,160.00 be transferred from the Water Fund to the 1934 Water Bond Fund. Reports of the city officers are presented and read. Motion by Councilman Stevens, seconded by Councilman Thomas and carried that the reports of the city officers be accepted as read and placed on file.
