Minutes 1948/06/07 998 G ilro y, Ca Ii forn:1a June 7,1948. . This regular monthly meeting of t he Common Counc il is called to order by His Honor Mayor George C.Milias. Present:Councilmen George M.Mason,Nat Heiner,J.H.Wentworth,Ray L.Stevens,James B.Thomas. Absent:Counailman George A.Martin. Minutes of the meetings of May4th and May 10th are read and approved. The report on water samples taken and tested by the Santa Clara County Health Department is presented and read and o~dered placed on file. A list of uncollectible water acaounus is now presented by the Water Department. Motion by Councilman Stevens,seconded by Councilman Thomas and carried that the summ of $2l.00 in uncolleatlble water accounts as presented by the water department be written off. .' Councilman Heiner responds and thanks the Mayor for his kind words and thanks all members of the various departments far- their cooperat ion ll't1ring hi s years as a member of the Council. The Mayor inst- ructs the City Clerk to del iver the city's 8ift to Counci.lman Martin. Motion by Councilman Heiner,seconded by Counc iIman Thomas am carried that this session of the Common Council adjourn sine die. Acting City Attorney Robert K.Byers now thanks the Council for the opportunity given him to serve out the unexpired term of his late father,James S.Byers. The Mayor thanks Mr.Byers for his eooperation and Mr. Byers retires from this meeting. The Mayor now welcomes the new members of the Council-David V.Stout and Dale Daniels. The Mayor' announces the following vacancies on the following commissions and conmittees-Flanning Commission-A.W.Brown,Elmer Weymouth,Carroll Wentz; Library Board Mrs.Mabel Schemel; Forestry Board-Harold Crow ,Kirby McAtee, Carroll Wentz. Councilman Stout asks that appointments to the vacancies on the commission a and boards be laid over until a later date and the Council agrees unan- imously. . The Mayor now presents the name of Police Judge Leon Thomas to serve 1000 for the ensuing two years. Motion by Councilman Stevens,seconded by Councilman Thomas and carried that Leon Thomas be appointed Police Judge fo r the City 01" Gilroy for the ensuing two years. The Mayor now ask how the Councilmen how they would prefer to vote of the appointment of' City Attorney. Counciliban Stout suggest vote by roll call and the other Councilman agree. A communication is read from the Gilroy City Planning Commission stating that the commission has been discussing the empansion of " f,,!,,O,./' the business district ~ both sides of Eigelberry Street from ~ird Street to Seventh Street ani asks the Council for their reaction, Slggestions and thoughts for or U6.1nst the proposal. It is unan- imously agreed that this letter be held for further consideration. A communication is read from the California Mission Trails Assoc- iation asking for a donation. Motion by Councilman Stout,seconded by Councilman Thomas and carried that the sum of' $25.00 be donated to the California Mission Trails Association. A communication is read from the local Portuguese Society asking p9 rmiss ion to hold a parade on June l3th. Motion by Councilman Stevens,seconded by Councilman Thomas and carried thatthe local Portuguese Society be granted permission to hold 8 parade on Sunday, June l3th. ~ U " A communication is read frcm the League 0 f California Cities relative to the use of garbage disposal units attached to sinks. This canununication is turned CNrer to the Sewer Committee for study. r, I i I....... ~/ 1001 A communication from tife resident of Monterey with reference to the regulation of traffic lights,is read. The City Englineer is asked what progress is being made in the regulating of the lights and he states that they are being worked on by engineers of the Division of Highways. The City Marshal now appears before the Council and asks that all problems the Coucil or Councilman have in regard to the Police Depart- ment be presented to him,also stating that he would like to remove certain officers from the department; that he has a man in mind for appointment to the department andthat he would like to meet with the Council in a closed session to discuss the police department. The Mayor reques ts that City Marshal"t.O inform him when he would like to have the meeting and he will call the meeting. A petition against holding the carnival during GymkahaDaweek on property 10 cated at the nor~h end of Church Street in th e GJurries Addition ,signed by 27 residents of the area,is presented. As the::\J carnival will show in another location the petition is ordered filed. No objection is made. The matter of advertising for bids for improvement of certain streets is discussed and it unanimously agreed that this matter be turned over to the new city attorney for approval before voting on the matter of advertising crClJr bids.,:Amemodandum of agreement for expend- iture of ! cent gas tax funds is also referred to the city attorney I' to draw up the necessary resolut ion. It unanimously agreed to meet MondaY.l.June 14th at 1 p.m. to pass upon the advertis ing f(l)lr bids. The ulerk states that the General Fund will not have enough money n LJ to complete the fiscal year and recommends the transfer of $lQQOOO.OO from the Water Fund the General Fund. Motion by Councilman Stout,seconedd by Councilman Daniels and carried that the sum of $10,000.00 be transferred fi'an the la"tmFund to the " < . ' Gene ral Fund. The Clerk nw. announoes the dates for meeting of the Board of Equalization for taxes for July 9th,12th and 16th and presents a 1002 proposed schedule for Counc~n for their approval; July 9th- Counc ilmen Wentworth and Stout; July 12th-Counc ilmen Thomas and Daniels; July 16th-Counc ilmen Mason and Stevens. Motion by Councilman Stout, sec onded by Councilman Stevens and ~aarried that the the Clerk be instructed to advertise meetings of the Board of Equal i zat ion of the Council for July 9th ,18th and 16th. The Fire Chief now reports that there is considerable dry grass ~ on vacant lots and would like to meet with the chaiKman of the ~ Fire Committee to discuss the matter of burning gzass this year. Councilman Stevens reports that the old men's toilet located on the Gymkhana grounds iB in bad vondi tion and should be torn down. It is ordered that the building be torn down. Mr.Don IDiesbro now appears before the Council to aks it :1td 181-i possi ble to wash down Monterey Street to keep the dust down. This matter is referred to the Street Committee for investigation. Councilman Stout now requests permission to leave the state for four days commencing June 8th. Motion by Councilman Mason,seconded by Councilman Daniels and carried that Councilman Stout be granted permission to leave the the stte for l5 day'S cODUneIlOing June 8th.
