This regular monthly IllJgeting of t he Common Council is called to order
by His Honor Mayor George C.Milias.
Present:Councilmen George M.Mason,J.H.Wentworth,Ray L.Stevens,James
B.Thomas,Dale D.Daniels. Absent: Councilman David V.Stout.
Minutes of the meetings of February 7th and 21st and March 4th,1949
are read and approved.
A communiaation is read from W.J.Hanna,City Engineer, relative to the
financing of the engineering work on the proposed widening of Monterey

I'.Iotion by Councilman Daniels, sec onded by Councilman Stevens and carried
that the matter of financing the engineering work on the proposed widening
of Monterey Street be laid over until the meeting of March 14,1949.
A COlTI:lUnication from City Engineer VI. J . Hanna w-ith a resolution proposed
by the San Benito County Chamber of Commerce, the Board of Supervisors of
San Benito County and the City of Hollister relative to the coordinating
of survey and plans for the Gilroy-Hollister highway is presented and ""I
read. It is unanimously agreed to take up the proposed resolution at j
the meeting of March 14th.
A communication is read from the State Board at' Equalization rela-
tive to the city's protest agpint the issuing of an On Sale Beer and
Wine license to Josephine and Priscilla Davila,99 S.Monterey Street;
the communication stating that the cityts protest arrived one day late~

ing the Gilroy Recreation Cowilission's budget request. This cornr:1Unication

A communication is read from the Gilroy Junior Chamber of Commerce

urlng the adoption by the Council of the budget submitted by the Gilroy
Recreation COl~ission. This conmunication is ordered filed.
A communication is read from American Legion Auxiliary,Las Animas
Unit No.669 urging the Council to adopt the bu~get submitted to the
Council by the Gilra,y Recreation Commission. This communication is
ordered filed.
A communication is read from Las Animas Post NO.669,The American
Legion, urging th e Counc il to adopt the budget s ubrni t -~ed to the
Council by the Gilroy Recreation Commission. This corrrmunication is
ordered filed.
A cOlwlunication is read from the Gilroy Eagles Band requesting free
use Wheeler Auditorium for a concert and show on Marbb 10th,proceeds
to be used for purchase of additional instruments for the band.
Motion by Councilman Daniels,seconded by Councilman Thomas and
carried that the Gilroy Eagles Band be grant ad free use of Wheeler "
Auditorium, March 10th, for a concert and show, the proceeds to be j
used to purchase new instruments for the band.
The Poundmasterts reports for January and February,1949 are pre-
sented and read and 0 rdseed placed on file.
A report of water samples taken February 28,1949 by the Santa Clara
County Health Department is presented and read and ordseedplaced on
file.

The Mayor states that Mr.J.H.Jamison of the J.H.Jamison Service is ~
present to present his report on their study and analysis of the
Police Department in accordance with the terms of an agreement between
the J.E.Jamison Service and the City of' Gilroy,dated October 8,1949;
the Mayor further stating that the Council had met earlier on this date,
Marah .''7;"1949,,to,,:b.ear the report.
The Mayor now calls upon Mr.J.H.Jamison of the J.H.Jamison Service to
read his report. At the conc lusion of the reading of the report ~

obJection' pe1ng' made. the Mayor: orders the~ report filed-.
. Motion by Counc ilIilan Daniels~ seconded by Counc ilman lvlason that the
report, prepared by the J.E.Jamison Service, relating to the Police De-
partment of the City of Gilroy, made and filed with the Council,having
contained charges, statements and declarations refracting upon the
Department and upon the City 11arshal and his operation of the Depart-
ment, which are of sufficient weight and importance to require a hear-
ing thereupon. I now move that public hearing before the Council be
held upon the report and the charges therein contained and, if said
charges are found substiantially true, that the office of City Marshal
of the City of Gilroy be declared vacant. This motion is carried by
a unanimous vote.
Motion by Councilman Wentworth,seconded by Councilman Thomas that the ~
date for the public hearing on the charges,statements and declarations
made in the report of the J.E.Jamison Service relating to the Police
Department of the City of Gilroy and upon the City Marshal of the City
of Gilroy and his operation of the Department, be set for Monday, March
21,1949 at the hour of 2 o'clock P.M. in the Council chambers of the
Ci ty Hall building. This motion ~ is .carried py.unanimous. vote.
The City Marshal now appears before the Council to discuss the report
and the Mayor states that he will be given every opportunity to be heard
at the public hearing, Ivlonday,March 21,1949. .~.

Councilman Thomas,chairman of the Fire Committee now presents an
application for a building permit for the Home Gas and Appliance
Company to erect a show room and butane and propane gas distributing
plant at the southwest cor~er of Monterey Street and \'ielburn Ave:Q.ue.
Mr.J.A.Canepa, applicant for the building permit, now appears before

the Council to discuss the permit. The Fire COL~ittee is instructed

to write to the League of California Cities and ascertain what other
cities have done relative to th the establishing of butane and propane
distributing plants inside city limits.
Motion by Councilman Daniels,seconded by Councibnan Thomas and
carried that the Gilroy Schools be granted free use of Vfueeler Aud-
itorium for A public schools week program on April 26,1949.
Councilmam Bason discusses the dondition of the city finances and
urges that expenses be cut to the absmlute minimum.
Motion by Councilman Stevens,seconded by Councilman Daniels ~and
carried that in the interim between this date and the adoption of
an afuainistrative code that no purchases be made by city departments
and city employees without securing a purchase order signed by either
G.B.Carr,Purchasing Agent or P.A.Cox,Chief Administrative Officer.

Motion by Councilman Wentworth,seconded by Councilman Stevens and
carried that reports of the city officers be accepted as read and
placed on file.
Motion by Councilman Daniels,seconded by Councilman Thomas and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
