Minutes 1949/03/14 1075 Gilroy,California March.14,1949. This regular adjourned meeting of the Common Council is called to order by His Honor May~r George C.Milias. \' Present: Councilmen George M.Mason,J.H.Wentwort~ Ray L.Stevens,James B.Thomas,Dale D.Daniels. Absent:Councilman David V.Stout. The T'~ayor now discusses the proposed widening of Monterey street and the m*hhod of financing the project. RESOLUTION NO.2l6 is presented and read. Motion by Councilman Daniels,seconded by Councilman Thomas that RESOLUTION NO.2l6 be adopted: RESOLUTION NO.2l6 -- ORDERING THE ISSUANCE OF SUPOENAS TO SECURE THE ATTENDANCE OF WITNESSES IN THE HEARING ON THE REPORT FFLED BY J .H. .JAMISON SERVICE RELATIVE TO THE POLICE DEPARTMENT OF GILROY. VffiEREAS, a hearing has been ordered before the Mayor and Common Council of the City of Gilroy for March 2lst,1949, at the hour of 2 o'clock p.m. in the City Hall to inquire into charges, statements and assertions made in a report filed with the said City Council relative to the Polioe Department of the City of' Gilroy which includes grave charges against the City Marshal of the City of GilrQY and VlliEREAS it is necessary to secure the attendance of witnesses at the said hearing; NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED that subpoenas be issued in the usual form on behalf of the Mayor arrl Cornraon Counc il of the City 0 f Gilroy and said subpoenas be signed by the City Clerk with the seal of the City o~ Gilroy affixed thereto and t hat said subpoenas shall be served upon such persons or person as the City Marshal may require as well as others. RESOLUTION NO.217 GIVING WRITTEN NOTICE TO TEE CITY UARSHAL OF 'lEE HEARING TO BE HELD MARCH 21ST, 1949, UPON THE J.H.JAMISON SERVICE REPORT. WHEREAS a hearing has been ordered by the Mayor and Common Council of the City of Gilroy for March 21st,1949, at the City Hall upon charges made in the report of J.H.Jamison Service filed in the 107f; office of the City Clerk of the City of Gilroy against A.G.Goodrich, the City 11arshal of the City of Gilroy, and it is advisable that written notice of the said hearing be given the said City Marshal. NOW, TllliREFORE, BE IT RESOLVED that notice of the time and place of hearing be given the said A.G.Goodrich, City l1arshal of the City of Gilroy on or before the 16th day of Marcl1,1949, and that said notice be signed by the City Clerk of the City of Gilroy. L.Stevens, NOES: Councilmen ABSENT: Councilman ~a!x / ] AT'fEST: G-u.~ Ci ty Clerk The following notice addressed to A.G.Goodrich,City Marshal,City of Gilroy is presented and accepted by unanimous approval of the Counci 1: To: A.G.Goodrich,City Marshal, Ci ty 0 f Gilroy NOTICE IS HEREBY GIVEN to you that J.B.Jamison Service,here- tofore secured by the City of GilroyJ.{o investigate, recanmend and report upon the Police Department of the City of Gilroy, has filed its report from which it appears that serious charges are made against the operations of the Department and the Ci ty Marshal of the City of Gilroy, and the Mayor and Cormnon Council of the City 0 f Gilroy have ordered that a hearing of the said charges be held before the Mayor and Common Council in the City Hall on Monday, the 21st day of IJarch, 1949, at the hour of 2 o'clock p.m., for the purpose of inquiring into and establishing the truthfulness of the charges..J and assertions contained in the said report, a copy of which report has heretofore been delivered to you and which will form the basis of the charges against you to be investigated at the said hearing. You should produce witnesses as you may desire on your own be- half. The said hearing will be held under Section 8 of the Charter of the City of Gilroy, with a view of declaring the Office of City Marshal vacant if the charges contained in the said report are subst~ntially proven at the hearing. The City Engineer's office now reports to the Council the recent con~~ations with the Division of Highways officials and states that the estimated cost of the proposed widening of M.onterey Street is $160,000.00. 10' Mr. William ~'rerner now appears before the Council to advocate the.J issuing 0 f' revenue bonds to fina nce the ci ty' s share 0 f the work connected with'the proposed wodening of l.Ionterey Street. The City Attorney is instructed to investigate ways and means of of financing the proposed widening of Monterey Street and to report to the Council his findings on March 28,1949. Motion by Councilman Thomas ,seconded by Councilman Daniels and 1077 carried that the city hire two police officers frmn the San Jose Police Department to be present at the hearing on Llarch 21,1949 the city to pay for their services. Motion by Councilman Daniels,seconded by Councilman Thomas and carried that the services of a court reporter be secured for the hearing to be held March 21,1949. Motion by Councilman Thomas,seconded by Councilman Wentworth and carried that the request of the Red Cross for a donation be tabled for t he present.
