Minutes 1949/04/04 1078 Gilroy, Calif. April 4, 1949 This regular adjourned meeting of the Co~rron Council was called to order by his Honor George C. I\lilias. Present Councilmen: J. H. Wentworth, Ray L. Stevens, J. B.!homas, Dale Daniels, George M. 1Iason 8:: D. V. Stout. Absent Councilmen: None This being the time fixed for the hearing of the charges involving the City ,arshal as embraced within the J. H. Jamison Service report, the Layor announced that the Superior Court of Santa Clara County had not yet decided vJhether or not a writ of prohibition was allowable to the Marshal and under the alternative writ of prohibition already granted, the hearing could not be held until the major question was determined by the Court and that the hearing should be contir,.L~~;;~. It VJas mooved Councilman Thomas,.seconded by Councilman Mason and carried that the hearing of said charges be continued to April 18, 1949 at 100 'clock A. H. at the City Hall and that the Counsel for the City l.Iarshal be advised of the continuance. The City Cler': was instructed to get information :from The League . ' of California Cities and other sources concerning ordinances regu- lating the adrnission of self service gasoline stations. A communication is read from Rev.Kenneth Bomberg relative to the use of \iheeler Auditorium by the Presbyterian Churhh for a choir concert on February 11,1949. l.Iotion by Councilman Daniels, seconded by Councibnan Stevens and carried that the Presbyterian Church hot be charged for\;use o:te .L .Wheeler.Auditorium,February 11,1949 and that the Gilroy Public Schools be granted free use of Vmeeler Auditorium June 7th to June 10th,inc- I I ~ /1 lusive, for graduation exerci~es for the Elementary Schools and the Gilroy High School. A com.munica t ion is read from the Parent-rreache rs' Ass ocia tion endorsing the proposed budget for recreation submitted by the Parks and Recreation Commission. This conmunicat ion is ordred filed. A communication is read from the Soroptimist Club endors ing the proposed budget for recreation submitted by the Parks and Recreat ion 1080 Commission. This cornmunicat ion is ord:e.ed filed. A cornr:1Unicat ion is read from the Parent-Teachers' Ass oci at ion inviting the Ma~rand Council to a meeting April 5,1949. The Mayor urges attendance by Councilmen and the comnunicat ion is ordered filed. A corn.:mnicaticin is read from Mr.J.A.Skillicorn thanking the Council for the manner in which traffic was handled during the funeral services for his late father and former Councilman George Skillicorn. The matter is grading and gravelling streets and alleys in the new Glen View Tract is discussed and it is unanimously agreed that all streets and alleys, except Carmel Street between Sixth and Seventh .--.J streets shall be graded and gravelled by the subdivider. The recom- mendation of the Planning Commission with respect to the width of corner lots is nullified by a note from the chairman of the commiss- ion stating that the members of the cowaission had agreed to allow the lots to stand as is. A discussion is had on the matter of rolled curbG and gutter:.;iJilstallation throughout the city. No action is ta hen. Amending Ordinance 422 to require 7000 sq~are feet of build- a ble area instad of 5000 square feet as now required is referred to the City Attorney. The Clerk is instructed to advise Mr.C.P.Davision that his storage building in the Gurries Tract is in violation of Ordinance No.422, and, as the permit was a temporary one, the build- ~c. ing should be reomved fran. the premises. The Mayor now presents the name of Mrs.Virginia Steinmetz to serve the ensuing four years as a mernb er of the Parks ani Recreat ion Comm- ission. Motion by Councilman Stevens,seconded by Councilman Stout and carried that the recommendation of the Mayor be endorsed an([ that Mrs. Virginia Steinmetz be appointed to the Parks and Hecreation Commission for a term of four years effective March 3,1949. Application of Henry M.Cruzat,d.b.a Greyhound Coffee Shop, 210 N. Monterey Street, for an On Sale Beer license is presented. No object- ion is made. Counoilman Thomas discusses tha apnlicat ion of the Home Gas & Appliance Co. for a permit to establish a butane plant at the south- I ..... west c orenr of We lburn .&venue amd I/[onterey street. Councilman Thomas states that he and the Fire Chief have investigated the application and had visited the proposed site. Mr.Charles Pierce owner of property and a business adjoining the proposed location of the butane distributing plant now appears before the Council and states that he feels that the fire hazard would be 1081 very great if the plant were established on the proposed location. Mr.Etalo Canepa of the Home Gas and Appliance Co. now appears before the Council to discuss his plans for the establishing of the proposed butane distributing plant, statine that the danger was not as great as many persons believed. The City Attorney advises the Council that the erection of a butane distributing plant requires a Use Permit from the Planning Commission. It is unanimously agreed to refer the matter to the Planning Commission. Captain Eugene Cochrane of the local l~ational Guard unit now appears before the Council to discuss the damage done to Rosanna street by the guard company's tank. It is unanimously agreed to refer the matter of ingress and egress from the auditorium property by the guard company's tank to the Street COmJlittee and the Chief Administrative Officer. Councilman Stout discusses the use of land in the rear of the City Hall building for a parking lot for city vehicles and those calli~~ at the city hall on business. LJ:otion by Counc il.man Stevens, seconded by Counc ilman Stout and carried that the Buildings and Grounds Cormnittee proceed with the establishing of a parking lot in the rear of the City Hall building. It is unanimously agreed that property known as the Old Septic Tank property located at the northeast corner of East and Old Gilroy Street be levelled and prepared for eventual use as a corporation yard. An ordinance licensing bicycles requested by the City Marshal is presented and read. After sone discussion it is unanimously agreed that the ordinance be referred to the Ordinance Committee for revision.
