Minutes 1949/05/14 11090 Gilroy,California May 14,1949 This regular adjourned meeting of the Common Counc i1 is called to order by His Honor 1.Iayor George C.l:1ilias. Present: Counc ilmen George U.I:1ason,J .H. .:ient worth, Ray L. Stevens, Dale D.Daniels. Absent:Councilmen James B.Thomas,David V.Stout. The lIayor states that LIr.R.C.Stocknan,consulting engineer,is present to discuss the city's sewage disposal plant and recommend- ations made by the Process Engineers,Inc. to bring the plant up to the specifications set down by the State Board of Health. 1.lr.Stock- man outlines the problem as it had been explained to him and gives a general outline of the process of operation of the plant with the proposed additions. LIr. Stockrnan answers severa 1 que stions asked by the Layor and members of the Council. VIr.Stockman presents a contract and outlines,briefly, what the contract contains. It is unaninously agreed that the contract as presented by Mr.Stocknan be placed in the hands of the City Attorney for his cO:fi1Ir1ent and recommendations. The alteration of SJ) ecifications for the Improvcment of Forest ~ Street is presented and read. Change 2- Party of the Second Part agrees to repair and re work, as required by the Engineer, any faulty work done prior to this agreement at no cost to the City of Gilroy, other than the unit prices set forth in said Contract. Change 3- Section 12, paragraphs (f) and (g), are hereby removed ~rom the Contract, and all ~eference to the items of screenings and bituminous binder made therein are also removed from the Contract. the City of Gilroy does not accept any screenings in stockpile and no payment will be made fo r such screenings. Change 4- In lieu of surfacing with bituminous binder and screenings, party of t"he second part hereby agrees to complete the surfacing of Forest Street within the length and limits specified in said contract for screenings, with machine laid, dense graded plant-mix surfacing laid on accordance with the Standard Specifications, as follows: "PLA1~-MIJG!:D SURFACING" Plant-mixed surfacing sha 11 be furnished and laid in accordance with the provisions of Syandard Specifications for dense graded plant-mix surfacing. Surfacing shall be machine laid apprOXimately it" thick with a l" feather edge, making an overall width of apprOXimately 24 feet, with the full intersections surfaced as shown on the plans for the seal coating. Plant-mix surfacing shall be made with dense graded aggregate, l/2" maximum size, using SC6 Bituminous bilmder. Measurement and payment for plant-mix surfacing shall include fullIl payment for furnishing and laying complete in place together with tack coat and/or prime oil required, and any levelling course required. Unit of payment shall be tons of meterial laid in place. 1092 Item 10- 400 tons of plant-mixed surfacing laid in place complete at $7.50 per ton. Motion by Councilman Ma~on,se.conded by Councilman Vv'entworth that RESOLUTION NO.22l be adopted: RESOLUTION NO.221 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ADOPTING BUDGET AND APPROVING MEMORANDUT.:l OF AGHKEMENT FOR EXPENDITURE OF GAS TAX ALLOCATION FOR Iv1AJOR CITY STREETS. W.HEREAS, a memorandum of agreement has been presented to be entered into with the State of California in accordance with a project statement submitted to the City 0 f Gilroy for expenditure of gas tax allocation to cities for the fiscal year 1950, and ~HEREAS, the city council has heard read said agreement in full and is familiar with the contents thereof; TH~~FORE, be it resolved by the city council of the City of Gilroy that said project statement be and it is hereby adopted as the budget 0 f proposed expenditures of the gas tax allocat ion to cities, and said agreement be and the same is hereby approved and the mayor and the city clerk are directed to sign the same on be- half of said city, said agreement to be binding upon the city upon its execution by the authorized officials of the State.
