This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George C.Milias.
Present: Councilmen George M.Mason,J.R.Wentworth,James B.Thomas,
David V.Stout,Dale D.Daniels. Absent:Councilman Ray L.Stevens.
Minutes of the meeting of December 5,1949 are read and approved.
A communication is read from the Gilroy Chamber of Commerce
commending the Council on the Christmas decorations. This letter
is ordered filed and the Clerk instructed to acknowledge receipt
of the letter and to extend the thanks of the Mayor and Counc il.
A communication is read from 11r.George E.Bernier,Oakland,Calif.,
commending the Council on the Christmas decorations. This letter

A communicatinon is read from the California State Automobile
Association relative to the Council's acceptance of the associations
traffic survey. This communication is ordered filed.
A communication is read from the International Association of
Machinists thanking the Council for the use of the City Hall aud-
itorium,December 6th. This communication is ordered filed.
A communicatiOn is read from W.J.Hanna,City Engineer, requesting
that condiseration be given to the improvement of Sixth Street
between Hanna Street and the West City Limits in the 1950 street
improvement program. This communication is refer~d to the Street
Committee.
A co munication is read from the City Engineer stating that George
Augusta had completed reparing the defective work on South Ale<<ander
Street and recommends the payment of the $200.00 withheld until this
,
work was completed.
Motion by Councilman Daniels,seconded by Councilman Stout and
carried that George Augusta be paid the $200.00 as final payment
for his work under Project 15.
A report of inspection on a dwelling located at 405 East Seventh
Street,owned by rlr.Joe Pulido, 61 Wilson Street ,San Jose,California,
is presented and read.

Mr.Justin Byers now appears before the Council and states that
residents of the area between Princevalle Street and Miller Avenue
and Third Street and Fifth Street are again inserested in annexation
to the city.
The City Attorney presents and reads RESOLUTION NO.2~O.
Motion by Councilman Stout ,seconded by Councilman Mason that
RESOLUTION NO. 230 be adopted.
RESOLUTION NO.230
CONSENTING TO INSTITUTING OF PROCEEDINGS FOR ANNEXATION OF TERRITORY
TO THE CITY OF GILROY.
WHEREAS, it has been represented to the Mayor and Common Council
of the City of Gilroy that proceedings will be instituted under the
provisions of an act of the legislature of the State of California,
entitled: "AN ACT TO PROVIDE FOR THE ALTERATION OF TEE BOUNDARIES OF
AND FOR THE ANNEXATION OF TERRITORY TO MUNICIPAL CORPORATIONS,FOR THE
INCORPORATION OF SUCH ANNE:XED TERRITORY IN AND AS A PART THEREOF ,AND
FOR THE DISTRICTING,GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED
TERRITYRYft approved June llth,19l3, and all acts amendatory thereof
and supplemantary thereto, which said act is designated as referred
to as the"ANNEXATION ACT OF 1913" for the annexation to the City of
Gilroy of the following described territory adjacent thereto, to-wit:
All that certain property located in the County of Santa Clara,State
of California,and being more particularly described as follows:
"BEING a part of Ranch Lots 16 and 20 as shown on Map No.7 acc-
ompanying the report of the Referees in the Las Animas Partition
Suit,Action No.5536, had in the Superior Court of the State of
California, in an for the County of Santa Clara,and more particularly
described as follows:
Beginning at the intersection of the westerly line of Princevalle
with the Southerly line of TUird Street ,being tb the presently
westerly Corporate Limits of the City of Gilroy, and running thence
along the southerly line of Third Street to the Westerly line of
Miller Avenue;thence westerly across Miller Avenue to the point
of intersection 0:1" the westerly line of Miller Avenue with the
southerly line of Third Street as shown on Map entitled "Tract
No.506, Castlewood Park Unit No.1" as recorded in Book 18,at page
40, of Maps,Official Records of Santa Clara County;thence along
the southerly line of Third Street N. 890 13' 30" W. 150 feet
to the westerly line of said Castlewood Park;thence along the
westerly line of Castlewood Park S. 00 46' 30" W. 928.05 feet to
the southerly line of Castlewood parkl thence along the southerly
line of Castlewood Park S. 890 10' 30 E. 150 feet to the westerly
line of Miller Avenue;thence continuing on the same course 80.00
feet to the easterly line of Miller Avenue;thence along the east-
erly line of Miller Avenue 8.00 46' 30" W. to its intersection
with the southerly line of Fifth Street;thence easterly along the
southerly line of Fifth Street to the west erly line of Princevalle
Street;thence northerly along the westerly line of Proncevalle
Street to the southerly line of Third Street and the point of
beginning." and,
WHEREAS, the said act of the legislature above set forth requires
the consent of the 18sislative body of the City to which it is pro-
posed to annex territory before any proceedings are commenced

pursuant to the provisions of that act, and
w~REAS, the Common Council of the City of Gilroy is willing to
consent to the institution of such proceedings;
NOW, THEREFORE, ::BE" IT RESOLVED that the Mayor and Common Council
or the City of Gilroy does hereby consent to the. institution or pro-
ceedings pursuant to the provisions of the said enactment or the State
Legislature for the annexation or the territory hereinbefore described
to the said City of Gilroy, such consent, however, not to be construed
to be a consent to the said annexation.

The matter of new floor covering ror the room occupied by the

It unanimously agreed to refer this matter to the Buildings and
Grounds Committee with power to act.
The matter or purchasing the Christmas decorations from J.C.Warren
is discussed.
It is unanimously agreed not to purchase the Cir:tstmas decorations
from J.C.Warren. ~

Motion by Councilman Stout,seconded by Councilman Thomas and
carried that the reports of city officers be accepted as read and
ordered placed on tile.
Motion by Councilman Mason, seconded by Councilman Thomas and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
It is unanimously agreed that the 1~yor and Council meet with
the property owners residing along the west side of Forest Street
between Swanston Lane and Leavesley Road on Monday evening January
l6th,1950, to discuss the widening of Forest Street north of
Swans t on Lane.
