Minutes 1950/03/20 t151 Gilroy ,California March 20,1950. This regular adjourned meeting of the Com;~n Council is called to order by His Honor Mayor George C.Milias. Present: Councilmen George M.Mason,J.H.Wentworth,Ray L.Stevens,James B.Thomas,David V.Stout,Dale D.Daniels. The Mayor states that the purpose of this meeting is to discuss the annexation of that certain territory bounded on the north by the south line of Third Street,on the west by the west boundary of Castlewood , Park Unit No~1 on the south by the south line of Fifth Street on the east by the west line of Princevalle Street, and mates a general state- meJl'tecOnperndlng-;theJ:lciIbY~B.i.posi tion in the matter of annexat ion. The Mayor now calls upon the Chief Administrative Offioer and the City Engineer to outline the method used in arriving at the cost per front foot of $3.00. The following persons residing in the area proposed to be annexed 1152 appeared before the Council:M.Filice,C.P.Salisbury,Louis Dresti,Howard Tyler,Courtland Rush,Glenn Cleveland,Russell R.Crane and Robert Hollar. The Mayor now calls for a standing vote of thosein favor of the city proceeding with an election in the area.'\Fourteen persons voted in the affirmative. RESOLUTION NO. 232 RESOLUTION OF INTENTION TO CALL A SPECIAL ELECTION IN THE TERRITORY PROPOSED TO BE ANNEXED TO THE CITY OF GIlROY. L VffiEREAS a notice of intention to circulate a petition for the changing of the boundaries of the City of Gilroy by the annexation of certain territory adjacent thereto has been published by the proponents thereof in tha manner required in the Elections Code of the State of California, and in accordance with the provisions of Article 2 of Chapter 1 of Part~ 2 of Divison 2 of Title 4 of the Government Code, generally referred to and designated as "Annexation Act of 1913", and which sa1d~notice contains a description of the territory proposed to be annexed to the City of Gilroy, said des- cription being the same as that hereinafter contained,and VillEREAS the Common Council of the City of ~ilroy has here- tofore consented to the circulation of the said petition and the taking of annexation proceedings, and V~REAS within ten days of the date of the publishing of said notice proponents did file a copy of the notice, accompanying stat ement and an affidavit of the publishing of the notice with the City Clerk 0 f the Oi ty 0 f Gilroy, and did also thereafter and after the expiration of 21 days after the publication of the notice and statement cause to be circulated among the voters within the area proposed to be annexed for the submission of signatures in the manner prescribed in the Elections Code, a petition for the annex- ation of such territory, which petition conforms to the aforementioned provisions of the Govermaent Code designated and referred to as the nAnnexation Act of 1913", and VffiEREAS it appears that the said petition has been signed by not less than one-fourth of the qualified electorsresiding within the territory described therein proposed to be annexed to the said City of Gilroy as shown by the registration of voters of the County in wh&mh such territory is situated, and ~REREAS the provisions of said Annexation Act of 191a as Bet forth in the said Government Code require the city Council upon receiving the written petition above referred to, to pass a resolution of intention to call a special election, giving at least 50 days notice thereof, and submit to the electors residing in the territory proposed by such petition to be annexed to such city the question of whether it shall be annexed to, incorporated in and uade a part of such nunicipal corporation. BEING a part of Ranch Lots 16 and 20 as shown on LIap No.? accompanying the report of the Referees in the Las Animas Partition Suit, Action No.5536, had in the Superior Court of the State of California, in and for the County of Santa Clara, and mare particularly described as follows: Beginning at the intersection of the westerly line of Princevalle Street with the Southerly line of Third Street,being the present westerly aorporate Limits of the City of Gilroy, and I" I 1153 running thence along the southerly line of Third Street to the Easterly line of LIiller Avenue; thence westerly across Miller Avenue to the point of intersect ion of the we st erly line of Miller Avenue with the southerly line of Third Street as shown on Map entitled ftTract NO.506, Castlewood Park Unit No.1", as recorded in Book 18, at page 40, of Maps, Official Records of Santa Clara County;thence along the southerly line of Third Street N. 890 13' 30" W. 150.00 feet to the westerly line of said Castlewood Park; thence along the westerly line of Castlewood Park S. 0046 '30"W. 928.05 feet to the southerly line of Castlewood Park;thence along the southerly line of Castlewood Park S.89010'30"E. 150 feet to the westerly line of Miller Avenue; thence continuing on same course 80.00 feet to the easterly line of Miller Avenue; thence along the easterly line of Miller Avenue S.0046'30"W. to its intersection with the south- erly line of Fifth Street; thence easterly along the southerly line of Fifth Street to the west- erly line of Princevalle Street;thence northerly along the westerly line of Princevalle Street to the southerly line of Third Street and the point of beginning." and such territory is hereby designated at the Second Western Add- ition to the City of Gilroy for the purpose of identification by which such territory may be referred to an indicated upon the ballot to be used at the election at which the question of such annexation is submitted; and BE IT FURTlmR RESOLVED and notice is hereby given that s:ber.a1ng-will be held before the Common Council of the City of Gilroy at the City Hall in the City of Gilroy on the 6th day of April,1950, at the hour of 8 o'clock p.m. when and where any person owning real property within such territory so proposed to be annexed, and having any objections to the proposed annexation, may appear before such City Council and show cause why such territory should not be annexed. Protests must be in writing, and shall state in genera 1 t ems the name of the owner 0 f the property effected and the location and area of the property.
