Present: Councilmen George M.Mason,James B.Thomas,David V.Stout, DaleD.Daniels,Carl W.Pate. Absent:Councilm8n J.H.Wentworth. The Mayor announces that this is thetime specified in a legal notice for hearing protests and/or objections for the proposed original zoning ot the Second Western Addition and Castlewood Park Unit No.1 in Zone "A". The Mayor now asks it there is any person present to protest and/or object to zoning Second Western Addition and Castlewood Park Unit No.1 in Zone "A". No person appears to protest and/or object. ORDINANCE NO.484 is presented and read. Motion by Councilman Daniels,seconded by Councilman Stout that ORDINANCE NO.484 be adopted with the proposed change is description suggested by the City Attorney. No person appears to protest and/or object. ORDlNANOE NO.485 is presented and read. Motion by Councilaan Stout,seconded by Councilman Daniels that QRDINANCE NO.485 be adopted. ORDINANCE NO.485 AN ORDINANCE AMENDING ORDINANCE NO.422 OF THE CITY OF GIIBOY, GENERALLY KNOWN AS THE "ZONING ORDINANCE";PROVIDING FOR THE ESTABLISHMENT WITHIN SAID CITY CERTAIN DISTRICTS WITHIN WHICH THE CLASSES OF BUILDINGS AND STRUCTURES AND THEIR USE THEREO:r ARE LIMITED AND CERTAIN OTHER REGULATIONS ARE APPLIED;PROVIDING THAT CERTAIN TERRITORY NOW IN ZONE "B" BE RE-CLA.SSIFIED .Am) PLACED IN ZONE "Cl" DISTRICT. Vote on the motion to adopt ORDINANCE NO.485: AYES: NOES: Councilmen George M.Mason,James B.Thomas,David V.Stout, Dale D.Daniels,Carl W.Pate. Councilmen None ABSENT: Councilman J.H.Wentworth. A communication is read from the Gilroy City Planning Commission advising the Council that the commission's Resolution dated June 16,1950 recommending the same set-back in Zone "01" as required in Zone "C" was again discussed at a meeting of the Commission on August 11,1950, as requested by the Council on August 7,1950, and the recommendat ion originally made for Zone "Cl" of no. set-back is reaffirmed. The communication also requested that the Council draw up an ordinance governing the establishing of trailer courts and recommended the Santa Clara County Ordinance as a guide. The Council now discusses the matter of set-back for Zone "Cl", the matter of future street widening being discussed at length. Mr. Floyd Rhodehouse represeniing Purity Stores, now appears before the Council and states that the Purity Stores have plans to erect a small warehouse on the Eigelberry Street side of their store loc- ated at the northeast corner of Fourth and Eigelberry streets. Mr. L.Johaasen,owner of property at the northeast corner of Fourth and Eigelberry streets also appears before the Council to discuss the set-back to be established. Motion by Councilman Stout,seconded by Councilman Mason and carried 1194 that the set-baok ror Zone "01" be a minimum of four feet and the City Attorney be instructed to prepare an Ordinanoe emobodying requirements ror a four toot set-back in Zone "Cl". Proposed advertising calling for bids for the improvement of Carmel Street~Tram First Street to Fifth Street; Third Street tram Hanna Street to Miller Avenue and Chp8tnut Street fram Old Gilroy Street to Miller Slough is presented and read. Motion by Councilman Stout,seconded by Councilman Mason and carried that the City Clerk be instructed to make the necessary publioations calling for bids for the improvement of Carmel Street from First Street to Fifth Street; Third Street from Hanna Street to Miller Avenue and Chestnut Street from Old Gilroy Street to Miller Slo~~ said bida to be opened Wednesday, September 13,1950, at 8 o'clock P.M. in the Common Councilroam in the City Hall, Gilro.y,Oalitornia. Mr.J.C.Warren representing the Warren Decorating Company now appears before the Council to discuss Christmas decoxations for Monterey Street. ~ i ..... Motion by Councilman Pate,seconded by Councilman Stout and carried that the City Attorney be instructed to draw up and agreement with the Warren Deco rat 1ng Company for Christmas decorations for Monterey ~ Street,said agreement to contain the desoription of the decorations __ and that Warren Decorating Company be paid the sum of $500.00 upon execution 0 t the agreement and the remaining $500.00 to be paid when the decorations are completely installed;that the decorations be installed as of the same date as specified in the agreement of 1949; that the City Attorney also draw up an agreement with Hollen- back Electric to install the necessary lights tor the Christmas decorations for the sum of $560.00. The City Clerk now presents and discuss the proposed budget for the fiscal year 1950-1951 stating the the proposed budget contains a grant to the Chamber of Commeroe in the amount of $2,500.00 as requested by the chamber; and that requestei of city departments have been included. It is unanimously agreed that the $2,500.00 ~ j requested by the Chamber of Commerce be granted. The matter ot replacement of the outfall sewer as reoommended by Consulting Engineer R.C.Stockman is discussed and it unanimously agreed that provision be made in the tax rate for starting the accumulation of the necessary funds to do this work. Motion by Councilman Stout,seconded by Councilman Pate and carried that the tax rate for the fiscal year 1950-1951 be $1.2500 per $100.00 of assessed valuation divided as follows: GENERAL ]uND LIBRARY FUND 1927 BOND FUND 1940 BOND FUND BARKS &. RECREATION FUND RESERVE FUND OUTFALL SEWER FUND $.5800 .1200 .1703 .0488 .1101 .1104 .1104 )1.2500 The matter of the Street Department picking up rubbish <<nd.ret'ase left or piled along street curbs is discussed. It is unanimously agreed that the department does not have the necessary equipment or manpower to do this work and that the department shall confine itself to the ~icking up of leaves.
