This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George C.Milias.

Minutes ort the regular monthly meeting of March 2nd and the reg-
ular adjourned meeting of March 9th,l953 are Bea. and approved.
A eommunllcation is read from the Mayor of Los Banos inviting the
Mayor and Council to attend the annuaal. May Day celebration. This
comnlunication is ordered filed.
A commu~cation is read from the Monterey Peninsula Chamber of

Commerce inviting the community of Gilroy to participate 1n Armed
Forces D~,May 16th. The Clerk is instructed to advise the newspap-
ers of t.he invitation.

A communication is read from the County Health .1Jepartment reCOlDQ1-
ending certain changes be made in Ordinance No.,o6 relative to
rules and regulations pertaining to the, operation of restaurants,

A communication is read from the City Engineer stating ihat an exam-
ination had been made of the outfall sewer line from Old Gilroy Road
to the sewage' p!aposal plant,making certain recommendations. This
communication is referred to the Sewer Committee.
A communication is read from the City Engineer with reference to the
city joining in the formation of a drainage district. This communication
is referred to the Finance Committee.
A communicatilm is read from Stanley Karp,6l0 First Street requesting
the issuance of a Use Permit. for t he renting of the office he formerly
used as a draft.ing office. This communication is referred t.o the
Gilroy City Planning Commission.
Communications from Assemb lyman Bruce Allen and Senator John F.
Thompson with reference to change in the matter of distribution of
District Court Fines and division of proceeds from a Sales Tax to
be collected by the state ~andl.distributedSto'ithen(t1ties and counties;
and ~knGwledg1ng teeeipt. of the Council's resolution with reference to
the establishing of Divisimn of Architecture in the State Department
of Education,are presented and read.
A communication is read from the City of Santa Rosa with reference
to soliciting opposition to certain bills introduced into the Legis-
lature regardipg a Sales Tax to be collected by the State and
apportioned to the cities and counties. This communication lis ordered

A communicatiop iSl;read from the I.F.D.E.S. requesting permission to
hold their annual dance on June 13th and parade on Monterey Street on
June l4th~ .-
Motion by Councilman ~ate,seconded by Councilman Ronald and carried
that the I.F.D.E.S. be granted permission to hold their annual dance on
Saturday,June 13th and their parade- on Monterey Street on June 14th.
A communication is read from Chapter 98c,California Scholarship
Federation,Inc.requesting free use of Wheeler Auditorium to hold their
Central Regional Conference on Saturd~,May 2nd.
Motion by Councilman Kennedy, seconded by Councilman Ronald and carried
that that Chapter 98c,California Scholarship Federation,Inc. be granted
free use of Wheeler Auditorium to hold their Central .negional Conference
on Saturd~,M~ 2,1953.
A communication is read from the Gilroy Optimist Club requesting
use of Wheeler Auditorium to hold the Optimist. Circus at the minimum
rental fee.

Motion by Councilman Kennedy,seconded by Counci~an Gallo and carried
thaU the Gilroy Optimist Club be granted use of Wheeler Auditorium for
the Optimist Circus on Saturday,April l8th,the rental fee to be $1;.00.
A communication ~s read from the Union Oil Company requesting permiss-
ion to file their Sales and Use Tax return annually. It is unanimously
agreed that the Clerk notify the oil company that other companies had
made the same request and their requests had been denied and foll..ing
the ordinance and the precedent their request must be denied.
Bids for painting the inside of Wheeler Auditorium are now presented
and read.-Henry Weymouth-$6;3.75; Michael Scalmanini-$542.00;Kenneth
Young-$698.0o. The bids are presented .to the City Attorney for his

approval.
The Mayor now discusses the condition of the doors at the fire
station stating that he had noticed they were in need of paint. !his
matter is referred to the Buildings and Grounds Committee.
The Mayor now discusses the matter of job classification and after
a short tiscussion is is agreed to put this matter over until a later
date.
Councilman Kennedy discu,sses the matter of the Council adopting a ~
resolution endorsing the the water bonds to be presented to the people L-
of the South Santa Clara Valley Water Conservation District on April
28th.
The City Attorney now presents and reads RESOOOTION NO.290.
Motion by Councilman Kennedy,seconded by Councilman Pate that
RESOLUTION NO.290 be adopted.

APPROVING ACTION OF SOUTH SANTA CLARA VALLF:f WATER CONSERVATION
DISTRICT IN CALLING A BOND ELECTION TO VOTE ON PROPOSITIONS FOR THE
CONSTRUCTION OF A DAM AND RESERVOIR SITES ON THE UVAS AID LLAGAS
CREEKS,AND APPROVING BOTH PROJECTS AND URGING THE ELECTORS TO VOTE
IN FAVOR THEREOF AND STATING REASONS THEREFOR.
WHEREAS,an election has been called and will be held in the South
Santa Clara Valley Water Conservation District on April 28,1953,in
which the electors therein will vote upon propositions for the const-
ruction of a dam and reservoir upon the Uvas Creek and Llagas Creek for [
the purpose of conersving the waters thereof; and, . "
WHEREAS, ia is ot vital importance to the entire South Santa Clara
County that the waters ot said creeks be conserved and that the said
dams and reservoirs be constructed for the reason that the water rights
which the said District has acquired or is acquiring will be lost unless
prompt action is undertaken to construct works to conserve the water
and said rights,when lost,will never be r egained;and,
WHEREAS,the City of Gilroy as a municipality and the people therein
are directly interesyed in and will be greatly benefited by the const-
ruction of said dams and reservoirs for the following additional rea-
sons:
(1) The dam and reservoir on the Uvas Creek will entirely eliminate
the possibility of floods in the City of Gilroy and make unnecessary

future heavy expenditures of municipal. finds for f~oQ;d prevention:,or'_
control.
(2) The said dam and reservoir on the said Uvas Creek will provide
the people of the City of Gilroy with 1000 acre feet of water guaranteed
supply per year which is equivalent to 325,851,000 gallons against a
present need ot 190,000,000 gallons,and probably eliminate the eapensive
pumping of water from city wells, the present yearly eost of which ex-
ceeds $4,000.00.
(3) The prosperity and business interests of the City of Gilroy are
very largely dependent upon the prosperity and well-being of the farming
population occupying the fertile agricultural lands which comprise the
main area of the Water District and of whic the City of Gilroy is the
trading and business center, and an adequate underground supply ot water
procurable for irrigation at reasonable cost is indispensible to the
",' suceessful and prof'itable operation of the said farming area, and the
construction of said dams and reservoirs on said Uvas and Llagas Creeks
will insure such a supply of water for the future.
(4) The great increase in the population of the St,ate of California
including the Gilroy area has brought with it a rapid increase in the
ise of water for agricultural and industrial purposes until many sections
of the State are confronted with an acute and serious water problem,and
it appears that those areas which are farsighted enough to provide for
their inhabitants and industries an adequate and reliable supply of
water will be the districts which will progress and grow the most rapid-
ly in the future and in which it will be most desirable to live.
(5) The water supply of the area in which Gilroy is located has
been steadily decreasing in the past because of the expanding use there-
of, and unless this su,pply is augm.ented by conserving .he water in the
District which would otherwise be lost and wasted, the water levels will
rapidly sink to such an extent as to make excessive,it not prOhibitive,
in the relative near future:, the cost of pumping water from the under-
ground stratas.
(61 The surplus water of the Uvas and Llagas Creeks which annually
goes to waste will,if conserved andprecolated underground, provide the
Gilroy area with an adequate supply of water for all foreseeable future
needs and gradu.ally restore the water level.
(7) The large reservoirs of water which the proposed works on the
said creeks will provide will advertise to all the world that the south-
ern part of' Santa Clara County has provided itself with an adequate
supply of' water for its future needs,and that. industries and people
desiring a site or place in which to live can locate here secure in the
knowledge that an ample supp~y of water has been insured for the area
at a resaonable cost.
and, WHEREAS ,it. appears that it is for the best interests of the
said City of Gilroy and the inhabitants thereof that. t he said works on
the said Uvas and Llagas Creeks be construct.ed' ib accordance with the
propositions which will be voted upon at said election.
NOW,THEREFORE,BE IT RESOLVED that the Common Council of the City
of Gilroy believes that the whole future of th>e City of Gilroy and the
surrounding area may be dependent upon the adoption by the voters of
the said South Santa Clara Valley Water District of both of said prop-
ositions having for their object the conservation of waste waters of
the Uvas and Llagas Creeks,at the said election to be held on April 28,
1953, and all electors are urged to realize the very great importance of'
said election and go t..o the polls on said election day and vote in favor
of both of said projects.
BE IT FURTHER RESOLVED that copies of the resolution be delivered
to the Board of Directors of said South Santa Clara Valley Water Cons-
el!Vation Dist.rict,to the preas,and to the Secretary of the Gilroy
Chamber of Commerce.

Councilman Pate discusses the matter of condemnation of certain prop-
per~1es located on South Monterey Street by the Department of Industrial

Relations,Division of Housing,
Mr.Ernest Rusconi,attorney,representing landlords and tenants on the
prope:bt.ies under discussion, states that the tenants have no objection
to the provisions of ORDINANCE NO.506 and that.tha landlortshave
offered to paint the outside of the buildings .
The Building Inspector discusses the visit to the properties by the
fire c:hief,the Division of Housing representative and the County Health

Department representative. The matter of a meeting between the property W
owners, the Division of Housing representa-t1ve and County Health Depart-
ment representative is discussed and it is unanimously agreed that if
such a meeting can be arranged the property owners will be advised of
the date and time. Councilman Rush states that he believes the Council's
position in this matter should be clarified -that the init.iative on
this entire matter was. taken by the state.agenc:y,namely,the Division
of Housing.
The Clerk is instructed t.o arrange a meeting with Mr.Frank J.~
DeAndreis of the Division of Housing,State of California,Dr.Turner
of the County Health Department and that. as soon as the meeting date
is arranged that. Mr.Rusconi representing the property wwners concerned
be notified of the date and time of the meeting.
Motion by Councilman White,seconded by Councilman Kennedy and carried
that Michael Scalmanini be awarded tGhe painting job at Wheeler
Auditorium on his bid of $542.00,said bid being the lowest and best
bid.

Motion by Councilman Ruan,seconded by Councilman Pate and carried
that the annual donation to the Gilroy Volunteer Fire Department of
$50.00 be made.
Councilman Pate discusses an informal meeting he had with the
Police Officers about working hours, stating that on his own initiative
he visi'ted the Hollister Police Department and talked with the Chief
of Police. This matter is referred to the Finance Committee and the
City Marshal.
Councilman Pate discusses the matter of renting police cars from
local dealers. This matter is referred to the Finance Committee and

Motion by Councilman Ronald,seconded by Councilman Kennedy and
carried that the sum of $100.00 be transferred from the Water Fund
to the Petty Cash Fund of the Water Department.
The Mayor reads a letter with reference to an oil lease on city
owned land after some discussion this matter is referred to the

Buildings and Grounds Committee for investigation.
Mr.Emanuel Valent.ino now appears before t he Council to discuss t.he
matter of cannery workers parking theri cars in front of' his residence
on North Railroad St.reet.
The City Attorney now presents and Ordinance restructing parking on
Railroad Street between Mart.in and Lewis Streets to 2 hours except

agreed to make the restriction cover Railroad Street from Old Gilroy
Street to Lewis Street to 2 hour parking between the hours of 9 A.M.
and 6 P.I4.every day except Sundays and Holidays.

TIME ON CERTAIN STREETS IN THE CITY OF GILROY.

Councilman Rush now discusses the ordinance regulating the operation
of restaurants and food establishments.

The report of the Building Inspector for the month of March,1953 is
presented and read and ordered filed.
The report of the Police Department of arrests and citations issued
for the month of Karch,1953 is presented and read and ordered filed.
An application for an On Sale Beer License from Gerald n.Graham,d.b.a.
Greyhound Coffee Shop,210 N.Monterey Street, is presented and read.No
objection is made.

Reports of the city officers are presented and read.
Motion by Councilman Kennedy,seconded by Councilman Ronald and carried
that reports of city officers be accepted as read and placed on file.

that. bills as presented be allowed and warrants ordered drawn on the
Treasurer.

City Marshal Harold Sturla now appears before the Council and recommen
ds the appointment of Anthony Fisher as a Police Officer of the City
of Gilroy.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that the recommendation of the City Marshal be accepted and that
Anthony Fisher be appointed Police Officer of the City of Gilroy to
serve at t he will and pleasure of the Council, the appointment to be
effective: April 1,1953 and his salary commencing on that date to be
$307.80 per month.
