Minutes 1953/04/27 1401 Gilroy,California April 27,1953 This regulalft adjourned meeting of the Common Council is called to order by His Honor Mayor George C.Milias. Present:Councilmen Carl W.Pate,Courtland M.Rush,J.Hughes Kennedy, Charles Gallo,George W.\~ite,Jack W.Bonald. The Mayor states that the purpose of this meeting is to discuss 'the oil and gas lease presented by Mr. Archer C.Ambler. Councilman Kennedy presents the lease stating t hat he had meet with Mr. Ambler and the City Attorney and kaa deletions and additions had been made in the lease originally presented. The Mayor requests the City Attorney to read the lease and discuss the portions added and explain the deletions. A commup.ication is read from Speigel Farms,Inc. requesting a Use permit to use a portion of the land on the Hornbeck Ranch(the North- west corner) for a vining station. Motion by Councilman Kennedy,seconded by Councilm~l White and carried that a Use Permit be granted to Speigel Farms,Inc.to use the Northwest corner of t he Hornbeck property on Leavesle;y Road for a vining station, providing the bean and pea straw is removed from the property as stated in their letter addressed to Mayor George C.Milias dated April 23,1953 and that t he roadway from Leavesley Road to the machines and the road around the machines shall be oiled or kept watered to keep dust down to the minimu!Il;this permit is issued as a revocable permit and can be revoked for viblation of any of the provisions hereof; and t he Building Inspector of t he City of Gilroy is designated as the citys official inspector to enforce the provisions hereof. Councilman Vmite discusses the need for a bridge across the Llagas Creek at the sewer farm to provide ingress and egress for the party farming the 47 acre piece of land east of the creek. Motion by Councilman Vmite,seconded by Councilman Pate and carried that the City Engineer be instructed to draw up plans and specifications for a bridge across the Llagas Creek at the sewer farm. The Mayor calls upon the City Engineer to discuss the master drain- ion age plan for the city. The Engineer relates his discuss/with the County Engineer and the suggestion that a request be made to the Board of Supervisors that a drainage zone be formed within and without the city limits in the northwest section of the city. Motion by Councilman Kennedy,seconded by Councilman Pate and carried that the City Engineer be authorized to write a letter to the Board of SUfJervisors of Santa Clara County requesting that the County Engineer initiate studies pursuant to laws applicable with reference to establishing a Drainage Zone for the area northwest of the City of Gilroy. The Ci tJr Attorney now reads additional addenda'to the oil and gas lease .Mr.Ambler is present and agrees to all changes made in the form lease. RESOLUTION NO.291 is presented and read. Motion by Councilman Kennedy,seconded by Councilman White that RESOLUTION NO.29l be adopted . RESOLUTION NQ~~.2<.tl RESOLUTION OF THE C01~JON COUNCIL OF THE CITY OF GILROY AUTHORIZING THE MAYOR OF THE CITY OF GILROY TO EXECUTE ON BEHALF ON THE CITY OF GILROYjAN OIL AND GAS LEASE COVERING THE S~VER FARM PROPERTY. WHEREAS,Archer C.Ambler has requested the City of Gilroy )0 execute to him an oil and gas lease covering what is known as the "Sewer Farm Property.. ,consisting of 190 acres,and being a portion of Ranch Lot No.51 as shown on Map No.7 accompanying the final report of the referees in the partition suit of Henry Miller et al vs. Massey Thomas et al,Suit 5536,in the Superior Court of the County of Santa Clara, State of California, and have presented a form of lease for execution;and WHEREAS, the said lease has been presented to the City Attorney of the City of Gilroy for his examination and recommendation and he has requested certain changes be made in the lease and certain additions included therein,and the said changes and additions are satisfactory to the Common Council. NOW,THEREFORE,BE IT RESOLVED that the said lease with said modifications,a copy of which is attached hereto be entered into and that the Mayor of the City of Gilroy is authorized to execute the lease covering the said premises on behalf o€ the City of Gilroy.
