This regular monthly meeting of the Common Council is called to order
by His Honor Mayor George C.Milias.
Present :Councilmen Carl W.Pate,Courtland M.Rush,J.Hughes Kennedy,
Charles Ga11o,George W.Wbite,Jack W.Ronald.
Minutes of the regular monthly meeting of May 4th and the regular
adjourned meeting of IVlay lbth,1953 are pead.and ,approved..
A communication is read from G.B.Carr,Deputy Tax Collector,with
reference to the payment of Sales and Use Tax by the Gilroy 1iotor
Company. Copies of letters addressed to tdss.C.Quin~,Office .Manager,
of the Gilroy Motor Company ,dated April 15,1953 and one addressed
to Mr.Alfred C.Humbarger,Manager,Gilroy Motor Company,dated May 20,
1953, with reference to exemptions calimed on sales, are presented
and read.
A comnunication is read from G.B.Carr,Deputy License Collector,
with reference to Willi~ns Shoe Repair non-payment of both City
License and Sales ffild Use Tax for the past three quarters.
kotion by Councilman Kennedy,seconded by Councilman Rush and carried
that the books of Gilroy Motor Company and Williams Shoe Repair be

audited by the city auditors,Logan and Frazer, and a report to the
Council on their findings and the Clerk be instructed to notify
the auditors of the Council's action.
A communication is read from the City Manager of the City of
Santa Rosa asking if this city would be interested in subscribing
to Motor Registration News the publication which supplies infor-
mation on all used cars sold and giving names and addresses of pur-
chasers.
Motion by Councilman Ronald,seconded by Councilman White and
carried that the City Clerk be inst~~cted to sign the cornmunication
from the City Manager of the City of Santa Rosa indicating that
this city is interested in securing information on used cars sold
to residents of the city by outside dealers.
A communication is read from Renz and Renz requesting the
acceptance by the city of Carmel Street between El Cerrito Way
and Welburn Avenue. The Building Inspector reports that the street
work has been completed according tb city specifications.
Motion by Counciiliman Pate,seconded by Councilman Kennedy and
carried that Carmel Street between El Cerrito Way and Welburn
Avenue be accepted for maintenance by the city.
A Certificate of Service signed by Dr.E.J.Chesbro,President of
the South Santa Clara Valley Water Conservation District is
presented and read and ordered filed.
A communication from the Gilroy Optimists Club advising the
Council of the success of the circus held in ~beeler Auditoriwn
on April l8th,is presented and read and ordered filed.
A communication is read from Mrs.Alice E.Otto with reference to
and article on the opening of Council meetings be opened with
prayer which appeared in the Gilroy Dispatch. Councilman ~ate
states that he interviewed two ministers with reference to appear-
before Council meetings to open the session with prayer and both
stated that it would be inconvenient. Councilman Pate also de-
plores the manner in which the story was handled by the local
newspaper. The communication is ordered filed.
A cO!illIlunication is read from W.J.Hanna,City Engineer,with
reference to the construction of a bridge across the Llagas
Creek on city sewer farm property,and suggests manner of handling
a portion of the job at a saving to the city.
Motion by Councilman Pate,seconded by Councilman White and
carried that the piling be driven and the rllinps constructed at
the Llagas Creek bridge site at the city sewer farm and that bids
for the construction of the bridge across the Llagas Creek be advertisted

for bids to be opened on J~ 16,1953 at 1 o'clock P.M.at a meeting

of the Council.
A communication is read from the City Marshal with reference to work-
ing conditions, etc. in the Police Department. This comrr.unication is
referred to the Finance Committee to be included in the forthcoming
budget.
A new contra~t from the ~lectrical Products Corporationx for maint-
enance of the "GILR0Ylt signs at the north and south entrances to the
city is presented. It is unanimously agreed that the Finance Committee
study the possibility of changing the present signs and report their
findings to the Council.
Councilman Kennedy presents a letter from the Gilroy Golf Club
requesting financial assistance from the city to improve the barbecue
grounds at the golf course. It is unanimously agreed that club directors
appear before the next regular monthly meeting of the Council imd outline
their plans for improvement of the barbecue area.
Councilman Ronald discusses the matter of the city subscribing to
Motor Registration News ~or current issues and securing information
from the publiShers with reference to automobiles sold to Gilroy
residents by dealers outside the city limits.
Motion by Councilman Honald, seconded by Councilman Kennedy and carr,~ed
that the city subscribe to Motor Registration News and issues of the
publication from April 1,1951.
An inquiry is made with reference to the trimming of trees on the
Eigelberry Street side of the Veterans' Memorial Building. It is stated
that the policy 0' the city is that the trees are the responsibility
of the pro~erty owner;the only time the city will trim trees,'-is when
there is danger of limbs falling from trees which could injure persons
or property.
Councilman Pate presents a prepared motion with reference to the
proposed widening of Monterey Street,'1that the majority of the citizens
of Gilroy,are in favor of the improvement of Monterey Street,and also
realize that there are some who object to this improvement being made
with the plans calling for a center strip or divider dwon the mad~e of
the street.
Endeavoring to have harmony a~ongst all citizens of Gilroy,we,the
Council, will endeavor to obtain this project,~namely )he improvement
of Monterey Street) less the center or divider strip,and will carry

this request to the highest authority of the State of California
Highway Commission,and make every effort to have the center strip
eliminated.
After such a decision is rendered we will ahen abide by their rec-
ommendations,and proceed immediately to enter into a contract with
the High\iay Commission to proceed with the project".
Discussion follows the presentation of this motion and lVir.Justin
Byers appears before the Council to discuss the petition presented
at the public meeting and ~le entire matter ,of the proposed widening
of Monterey Street.
It is suggested by Councilman Rush that when the Council appears
before the State HighvJaYll Commission that there be complete agreement
on their stand on this matter,namely,the improvement of Monterey
Street without the center or dividing strip.
~~.Dyra,owner of the Palace Motor Lodge, suggests that a pUblic
meeting be held after the meeting with the State Highway Commission.
Mr.Walter Hanna,Jr. of the City Engineers's office now appears
before the Council to discuss the proposed widening of Monterey
Street and states that the State of California has complete control
of Monterey Street, Old Gilroy Street from Monterey Street to the
east city Limits and First Street from Monterey Street to the west
city limits.
It is unanimously agreed that the City Clerk write a letter to
the State Highway Commission requesting a date for a hearing on
the matter of the proposed widening of Monterey Street.
Motion by ~ouncilman Pate ,seconded by Councilman Ronald and
carried that Walter Harma,Jr. of the City Engineers' office b~
authorized to appear before a meeting of Division Engineers of
Division IV,San Francisco,California,and give them the Council's
opinion on the proposed widening of lWionterey Street.
Councilman Pate re-reads his motion and by mutual agreement deletes
the last paragarph of same.
Motion by Councilman Pate, seconded by Councilman Ronald and carried
that the majority of the citizens of Gilroy are in favor of the
improvement of Monterey Street and also realize that there are some
who object to this improvement being made with the plans calling for
a center strip or divider down the middle of the street. Endeavoring
to have harmony amongst all of the citizens of Gilroy,we the Council
will endeavor to obtain this project, namely, the improvement of
Monterey Street,less the divider strip,and will carry this request

The Building Inspector now appears before the Council to discuss the
request of Borden's Dairy Delivery to make certain changes in the
windows of a building known as the old Fook Low Dryer on South ~onterey
Street. No objection is made.
Councilman Kennedy discusses the conditions of the care-takers dwell-
ing at the gmlf course stating that the building is badly in need of
paint.
Motion bJ Councilman Kennedy,seconded by Councilman Ronald and
carried that bids be called for for painting the care-takers dwelling
at the gol~ course.
Councilman Pate discusses the matter of the large amount of rubbish
in the gutters
be depositedJin the front of dwellings by occupants throughout the
city ;that the street deparunent does not have the manpower or equip-
ment to do all of this work.
It is unanimously agreed that the policy previously established by
former Councils shall maintain,namely, that the street depar~~ent
trucks will pick only the grass trimmings,leaves,tree and shrub trim-
mings from the parking area in the residence section of the city and
t~e Clerks is instructed to place an advertisement in the local news-
paper calling to the attention of occupants of dwellings that the
street department will not pick up refuse taken from inside properties
from and after June 10,1953.
Councilman White discusses the matter of the dumping of tin cans
and other refuse in Miller Blough. The Building Inspector is instructed
to inspect the slough and warn those who are depositing tin cans and
other refuse in the channel to stop this practice.
Councilman Pate discusses the matter of motorists running their
automobiles over freshly oiled streets. It is unanimously agreed that
when the oiling of streets is commenced this year that an advertisement
be placed in the local newspaper cautioning all motorists against
runnin~ their vehicles over freshly oiled streets.
A commu.nication is read from the Gilroy City Planning Commission
recommending: that the petition for annexation of a portion of Las
Animas Ranch Lot 16 be returned to the petitioners due to the fact
that no evidence was presented that they had advertised in the news-
paper tenH days days before they circulated the petition that they
were going to circulate the petition; that Horace willard be granted

a Use Permit to erect a warehouse and cabinet shop on the west side
of Swanston Lane between the Gymkhana stables and the property of
Mary Doherty et al, wi th certaL'1 restrictions; that Stanley Karp be
granted a Use Permit to rent his office,formerly occupied by him as
a drafting office,to ~thers as an insurance office.
It is unanimously agreed to accept the recommendation of the
Planning Commission and the Clerk is instructed to return the petition
and other papers to the circulators of the petition to annex to the
city a portion of Las Animas Ranch Lot 16 and explain why the
petition was not accepted.
Motion by Councilman Kennedy,seconded by Councilman Pate and
carried that Horace Willard be granted a Use Permit to erect a
cabinet shop and warehouse on the west side of Swanston Lane bet-
ween the Gymkhana stables property and the property of Mary Doherty
et al,providing,that the property not be used as a storage yard and
the warehouse be used for storage of mete rial pertinent to the
cabinet shop business only..
Motion by Councilman Kennedy, seconded by Councilman Ronald and
carried that Stanley Karp be granted a Use Permit to rent his
office located at 610 First Street,formerly occupied by him as a
drafting office,to others for an insurance office.

The Water Collector's office now presents a list of uncollectible

accounts showing the ammunt due to be $46.30 and deposits to cover
same $36.00,leaving a balance uncollectible of $10.30.
Motion by Councilman Pate,seconded by Councilman Kennedy and
carried the sum of $lO.3~ be written off'the water accounts as
uncollectible.
The May report of the Building Inspector is presented and read
and ordered filed.
The report of arrests and citations issued by the Gilroy police
Department is presented and read and oraared filed.
Reports of city officers are presented and read.
Motion by Councilman Ronald,seconded by Councilman White and
carried that the reports of city officers be accepted as read
and placed on file.
Motion by Councilman Pate,seconded by Councilman White and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
