This meeting called as a public hearing,through publication of
a legal notice,iscalled to order by His Honor Hayor George C.
.
Milias.
Present:Councilmen Carl W.Pate,Courtland M.Rush,J.Hughes Kennedy,
Charles G allo,George W.Vmite,Jack W.Ronald.
The !>layor announces that t he purpose of this meeting is to con-
sider the application for a Use Permit from Robert K. Byers and
Warren L.Byers to to erect and use a building for professional
purposes on the south side of First Street between Miller Avenue

and Princevalle Street,the Gilroy City Planning Commission having
reco~nended in a communication to the Council dated July 3l,1953,that
a Use Permit be granted to the applicants to erect a building on said
property for use as a dentmsts office and lawyers office.
The Mayor now asks if the Council wishes to have the letter from the
Gilroy City Planning Commission read.No request is made by the Council-
men to have the letter read.
The Mayor n~~ asks if there is anyone present who desires to speak
either for or against the recommendation of the Gilroy City Planning
Commission.
Mr.Russell Roessler,attorney, now appears before the Council and
states that he represents a group of property owners and householders
protesting against the granting of a Use Permit to Robert K. and Warren
L.Byers to erect a professional building or lawyers and dentists office
on the property located on the south side of First Street between i
Miller Avenue and ~rincevalle Street.
N~.Roessler now presents a petition against the granting of the Use
~ermit to Warren L. and Robert K.Byers,signed by eighteen property
owners and householders residing in the area.
The Clerk now reads the petition presented by Mr.Roessler.
Mr.Roessler discusses the reasons why his clients are opposing the
granting of the Use Permit and introduces his partner,Mr.George
Barnett,attorney, who discusses the protestants objections to the
granting of the permit,and for reasons given in the petition asks
that the Council deny the application for the Use Permit.
The Mayor now asks if there is anyone present who desires to speak
in favor of granting the Use Permit.
Mr.Robert K.Byers,attorney, one of the petitioners for the Use Permit,
now appears before the Council. Mr.Byers asks what the city's ~ture
plans are for First Street and discusses the application for the permit.
The W~yor now calls on Dr.Elmer J.Chesbro,chairman of th~ Gilroy City
Planning Commission, who gives a brief history of of the planning
commission and:.the time effort .u'se.d,in trying' to'::.project the future
development of the city.Dr.Chesbro states that the comffiission,at its
hearing on the Use Permit, discussed the matter of the way the proposed
building was to be faced.
Mr.Roessler now appears before the Council and ask that the Council
voted against the granting of the Use Permit.

speak ~urther either for or against the granting of the permit. No
person appears to discuss the matter further.
Motion by Councilman Kennedy, seconded by Councilman 1thite and
carried that a Use Permit be granted to Robert K.Byers and Warren L.
Byers to construct a building on the South side of First Street bet-
ween Miller Avenue and Princevalle Street, to be used as a dental
office only,with parking area provided for on the Miller Avenue side
of the property.
Motion by Councilman Kennedy,seconded by Councilman Rush and carried
that the matter of rezoning First Street from the West city limits to .
Monterey Street into a ncn District be referred to the Gilroy City
Planning Commission for study and recommendation to the Counci~.
The Mayor now declares this meeting adjourned.
