A cOMnunicati~n os read from the High School Parents and Teachers Association requestdng use of ~1heeler Auditorium on November 27, 1953 for the purpose of putting on two plays. Motion by Councilman White, seconded by Councilman Rush and carried that the High School Parents and Teachers Association be granted free use of 1Vheeler Auditorium in the afternoon and evening of November 27,1953 for the purpose of putting on two plays. ~~ A communication is read from the Gilroy Gliders Club reqyesting use of \Vheeler Auditorium for the purpose of holding a Regional Folk Dance Festival on October 24,1953. Motion by Councilman Rush,seconded by Councilman Ronald and carried that the Gilroy Gliders Club be granted free use of Wheeler Auditorium for their Regional Folk Dance Festival on i ..... A communication is read from Dunmar Homes offering the city a water well in the Walnut Orchard Tract for the sum of $42 _ _ Mr.Ward Crump one of the promoters of the Walnut Orchard Park subdivision is present to answer questions asked by the Mayor Pro-tem and Councilmen. This matter is referred to the Water Committee f0r investigation and report. """"'\ A corr~unication is read from the Santa Clara County Inter- - City Council inviting the City of Gilroy to join the other cities of the county to increase the membership to all cities in the county. It is unanimously agreed not to join the Council and to convey the thanks of the Council for t he invitation. A corrrounication is read from the Gilroy Garbage Disposal service offering two propositions for the collecting of rubbish through~ out the city- (l() for a flat fee of $400 .00 per month and (2) by adding twenty-five cents to each water bill, the money collected 1439 by the city to be turned o~er to the Gilroy Garbage Disposal-this prop~sition being on the basis of 1600 customers and 25~ for each additional customer-collections to be made once a week from May to September and twice a month for the balance of the months. ~~ssers Acker and Sims,proprietors of the Gilroy Garbage Disposal are IX" esent and answer questions asked by the Mayor and Councilmen. In addition, to the refuse collection proposal the proprietors ask for another five year franchise with the pption of an additional five years. This matter is referred to Councilman Unite and his Sewer Committee for investigation and report. A communication is read from Logan and Frazer,certified public account~lts,city auditors, tran~litting their report of audit for the fiscal year 1952-1953 with balance sheet ,fund accounts, ete. at tached. Motion by Councilman Ronald,seconded by Councilman White and carried that the audit report by Logan and Frazer,certified public accountants, city auditors,for the fiscal year 1952-1953 be accepted and placed on file with the undertsanding that the City Clerk IDld Deputy City Clerk check the report aDd find it satisfactory. A com munication is read from the Pa~ific Telephone and Telegraph Company requesting a permit to instal a 4-way conduit for cOaEial cable on Eigelberry Street. Mr.Blue,representing the Pacific Telephone and Telegraph Company,is present and answers questions asked by the Mayor and Councilmen. W.J.Hanna,Jr. of the City Engineer's office is called upon by the Mayor Pro-tem to discuss the permit requested. Kotion by Councilman Kennedy,seconded by Councilman Rush and carried that the Pa~ific Telephone and Telegraph Company be granted a permit to install a 4-way conduit for coaxial cable on the east side of Eligelberry Street from First Street to Tenth Street and on the south side of Tenth Street from Eigelberry Street to Monterey street, subject to conditions to be drawn up by the City Engineer and approved by the Council. Motion by Councilman Kennedy,seconded by Councilman Gallo and carried that the Mayor and City Clerk be authorized to sigg an agreement with the County Tax Collector with reference to certain delinquent pieces of property in the city now being used by the city as parts of alleys and sewer easements. -1 ;1 /1 ;,) .1.. -:t (t l The Mayor Pro-tem announces that this is the time specified in a legal notice calling a public hearing on the matter of the closing of Maple Street between Seventh Street and Old Gilroy Street and asks if there is anyone present who desires to protest and/or object to the closing of the street. No persons appears to protest and/or object. The City Attorney now presents and reads ORDINANCR NO. 510. Motion by Councilman Rush,seconded by Councilman Gallo that ......... The Mayor Pro-tern states that the agreement between the State of California and the City with reference to the widening of Monterey Street has arrived and after a conference with Mayor Milias the f^"'~ latter requested that this matter be discussed at a meeting to be held Monday evening, September 14,1953. It is agreed to meet on Monday evening,September 14,1953 to discuss the agreement prepared by the State of California with reference to the widening of Mon- terey Street. ........ The matter of posting the newly constructed bridge on the city sewer farm property with signs stating that right to use of the bridge is revocable and the maximum load carrying capacitYli is discussed and the Purchasing Agent is instructed to have the proper signsmade. Motion by Councilman Vlliite,seconded by Councilman Ronald and carried that the City Clerk be allowed his expenses for attending the annual convention of the League of California Cities in San Fr~1cisco on October 19-21,1953. The annual financial report of the Gilroy Public Library is pre- sented and read and ordered filed. '_...r The report of the County Controller on fines collected fDr the month of JUly,1953 is presented and read and oreered filed. Reports of water samples taken by the Santa Clara County Health Department for July and August,1953 are presented and ordered filed. Applications for an On Sale Beer License from Joe Fortino,d.b.a. 1441 Club 14-0,27 S.Monterey Street and Jess Correa,63 S.Monterey Street are presented. No objection is made. The report of the Poundmaster for t he month of August,1953 is pre- sented and read and ordered filed. The report of the Building Inspector for the ill onth of August,1953 is presented and read and ordered filed. The report of the Police Department for the month of August,1953 is presented and read and ordered filed. The Building Inspector now appears before ~he Council with reference to a request to erect fences in front of dwellings being cons~ructed in the Walnut Orchard Park subdivision. Mr.Ward Crump now appears before the Council to discuss the matter of fences stating that this type of construction is c aIled for in the type of homes being built. The matter of a possible amendment to the city ordinance governing the height of fences is discussed and this matter is referred to the Ordinance Corrmittee for study and report to the Council on September 14,1953. Councilman Rush states that he has had several telephone calls and a letter 'vd th reference to cannery sewage flowing in the gutters on Lewis and Alexander streets and that one party stated that t hey had taken a sample of the sewage water in the gutter and forwarded it to the Depart- ment of Public Health. Councilman Rush now exhibits a new map made for the fire department upon which tlley can located fire alarm boxes and hydrants. Reports of city officers are presented and read. Motion by Councilman White,seconded by Councilman Rush and carried that the reports of city officers be accepted as read and placed on file. Motion by Councilman Rush,seconded by Councilman Gallo and carried that bills as presented be allowed and warrants ordered drawn on the Treasurer, Adjourned subject to the call of the chair.
