The Mayor now asks i~ the Councilmen have received copies of the minutes of the regular monthly meeting of March Ist,the regular adjourned meeting of March 15th and the special meeting of March 19th,1954. 1497 "'i""'.; ..... ~n"",- .....I "....,.."4 ~ 1"198 questing that Maple Street between Old Gilroy and Eighth streets be gradG4,gravelled and oiled as t hey intend to build a store building at the southeast corner of Maple and Old Gilroy Streets and will im- prove the east side of the street by having curb and gutter installe~ It is unani{jously agreed that the improvement ot:~Maple_.str~et as requested by Messers.Kong and Conrotto be done during the coming street improvement season. Councilman Rush discusses the matter of installation .of curbs and gutters on Fifth Street between prmncevalle Street and Miller Avenue. It is the unanimous opinion that the improvement would be a great . asset, to the street and it was suggested that all property owners on the north side of Fifth Street join together to secure bids for the work. ] A communication is read from the Southern Pacific Company with reference to protection for the crossing at Ninth Street, the letter referring to a letter written to the Public Utilies Commission and dated January 7,1952. This matter is referred to the Street Cowaittee for further study. A cOlrununicationis read from W~J.Hanna,City Engineer, stating that ~ authority had been granted by the Division of Highways+to call for J bids on the Eighth Street Storm Sewer and giving estimated costs. Motion by Councilman Pate,seconded by Councilman Gal~o and carried that legal advertisement be made calling for bids for the Eighth street stonn Sewer and that bids be opened on Monday,Apri1 19,1954 at 8 o'clock P.M. in the Council Chambers,City Hall~Gilroy,California. A communication is read from Mrs.Edith Ayer thanking the Jiiayor and Council for the resolution which was passed by the Council as a tribute to the memory of her husband,Josiah E.Ayer. This communic- ation is ode red filed. A communication is read from the Senior Class of Gilroy High School taanking the Council for the free use of lfheeler Auditorium on Marbh 26th and 27th. This communication is ordered filed. Reports of water samples taken by the Santa Clara County Health Department during the month of March,1954 are presented and ordered filed. lIIIllII .... RESOLUTION NO. ~1 Q RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY PROVIDING FOR JOINT CONSTRUCTION OF INDUSTRIAL SE.1VER LINE FROM LEWIS STREET TO OLD GILROY STREET IN THE CITY OF GILROY. WHEREAS, the City of Gilroy has for many years and is now maintaining a sanitary sewer extending from the northerly part of the City of Gilroy by or through the FILICE & PERRELLI CANNING COMPAlTY premises on Lewis Street and thence down the alley between Alexander Street and Forest street to Old Gilroy street;and WHEREAS, the said sewer line has been for many years and still is being used for the disposal of waste material from the, cannery operated by the said Filice & Perrelli Canning Company on said LeWis Street in the City of Gilroy,and also for the disposal of sewerage ~rom dwellings located along the said line;and \VHEREAS, the said sewer line does not now have capacity sufficient to care for the disposal of all the said waste materials and sewerage, and because thereof has created a health condition which has been condemned by the County Board of Health of Santa Clara County, and the Common Council of the City of Gilroy after giving the matter extended consideration has concluded that it is necessary and in the public interests that an additional sewer line to be used solely for indust- rial. purposes and for the disposal of industrial waste be constructed HR and installed from the said cannery premises to Old Gilroy Street in the City of Gi1roy,and it has been estimated that the cost of furnish- ing and laying a 15-inch sewer line for such purpose will be the sum of $10,795.00, and the said Filice & Perrelli Canning Company has offered to contribute the sum of $5,000.00 toward the cost of the said sewer line if the City of Gilroy will furnish the balance of the cost and lay the line under conditions hereinafter set forth,and the City of Gilroy is willing to construct the said line under the said conditions. NOW,THEREFORE,BE IT RESOLVED: That the City of Gilroy accepts the said sum of $5,000.00 from Filice & Perrelli Canning Company to be used in the construction of the said sewer line and that the City of Gilroy construct said line and p~ the costs thereof applying the said sum of $5,000.00 toward the cost,under the following conditions: (I) That the said sewer line,wljen constructed, will be the prop- erty solely of the City of Gilroy. (2) That the said sewer line shall be for industrial purposes only, andr-;sha11 connect onto the sanitary line e stending to the Gilroy Sewer Farm. (3) That of and when other industries are located along the said line or suffici~tly close thereto to make it practical to use the same for industrial purposes,they may connect onto the line by paying to the City of Gilroy a sewerage rental charge to be determined by the Common Council of the ,City of Gilroy under such conditions as may be estab- 1ished,but the said sewer line shall not be over1aaded. BE IT FURTHER RESOLVED, That the City of Gilroy enter into an agreement with the said Filice & Perrelli Canning Company accepting the said contribution of $5,000.00 toward the construction of the aforesaid sewer line under the conditions above set forth,and that the Mayor of~the City of Gilroy be,and he is hereby,authorized to execute such an agreement on behalf of the City of Gilroy. Motion by Councilman Pate,seconded by Councilman Kennedy and carried that the recommendations for improvement in street l~hti~ in the residential area of the city,as presented by the Lighting Committee, be accepted and carried out. Councilman Kennedy now discusses the matter of replacing the police cars it being ascertained that by the endB of the month present] of May both cars will have travelled 35,000 miles. The Purch~sing Agent is instructed to contact local automobile dealers to ascertain what deals can be made towards to purchase of two new cars. Councilman Kennedy discusses the conditions of a tree located in the alley between Broadway and La Sierra Way,west of Hanna Street and reports that Davey Tree Surgeons,Inc.had examined the tree and given tJ1~i:r ,:estimated cost of rehabilatJiting the tree and cost of removal. It is agreed that the present condition'af the tree does not warrant rehabilatation and cost of removing the tree should be ascertained. Councilman Rush,Chairman of the Fire Committee, discusses the matter of the city furnishing uniforms for the paid members of the Fire Department.and suggests that the sum of $75.00 be alloted to each paid member of the department for theplrchase of uniforms. Motion by Councilman Rush,seconded by Councilman Kennedy and carried that the sum of $75.00 be alloted to each paid member of the Fire Department to be used for the purchase of uniforms.
