Minutes 1954/05/10 150'8_ Gilroy, California May 10,1954 This regular adjourned meeting of the Common Council is called to order by His Honor Mayor George C.Milias. Present:Councilmen Carl W.Pate,Courtland M.Rush,J.Hughes Kennedy, Charles Gallo,George v-J.White,Jack W.Ronald. The Mayor states that the purpose of this meeting i. to canvass the absentee ballots of the regular municipal election held on May 3,1954. .... I .J The Clerk announces that twenty absentee ballots have been ret- urned. The ~~ now appoints Councilmen Gallo and Ronald as Clerks and the City Clerk proceeds to open the emr:eliopes containing the absentee ballots and proceeds to read same. The City Attorney now presents and reads RESOLUTION NO.323. Motion by Councilman Kennedy,seconded by Councilman Pate that RESOLUTION NO.323 be adopted. RESOLUTION NO.~23 RESOLUTION AND ORDER CANVASSING ABSENTEE VOTES CAST AT REGULAR MUNICIPAL ELECTION HELD MAY ),1954,AND DETERMINING TOTAL VOTE, , AND DECLARING ELECTION OF OFFICERS OF THE CITY OF GILROY. ~ I J WHEREAS, the regular municipal election for the municipal offices of the City of Gilroy was held in said City of Gilroy on May 3,1954, in accordance with the provisions of the City Charter and pursuant tp law and to due and legal notice given of said election;and WHEREAS, the Common Council of the City of Gilroy has on the 4th day of Y~,1954, canvassed the returns of said election except the absentee votes and found and ascertained that the total mumber of votes,exc1uding absentee votes, cast at said election was 1666; that the number of votes cast at Precinct "A" was 529;that the number of votes cast at precinct ttB" was 610;that the nU4Jber of votes cast at Precinct ltClt was 527; and setting forth the names of the candidates for t he respective offices and the number of votes received by each candidate,excldsive of absentee votes;and WHEREAS, it appears that under the law ocr the State of California, .bsentee votes may be received up to seven (7) days after the election, and that the absentee votes must be canvassed not later than the seventh day after the election;and WHEREAS, the ConUIlon Couhcil of the City of Gilroy has this 10th day of May,1954, met in an adjourned session at the hour of 1:00 o'clock p.m. to ca nvass the said absentee votes cast at the afore- said election and has canvassed the said votes and found and ascert- ained that the total number of absentee votes cast at said election was 20; that the total number of votes including absentee votes was 1686, and that the following named persons received the number of absentee votes set opposite the total number of votes,exc1dsive of absentee vo~es as found in the previous canvass and the total number of votesset opposite their respective names for the respective ~Of:fices for which they were candidates, to-wit: IIIItlII\ j 1509 Total Vote Excluding Absentee Vote Absentee Vote Total Votes. GOODRI CH (Write-ins) None and, WHEREAS, it appears from the said canvass and the records of said Common Council of the City of Gilroy that all of the above candidates duly nominated for the respective offices for which they were candidates, and that the said GEORGE .M.MASON received the majority of all votes cast for the office of Mayor of the City of Gilroy; that PHILIP A COX received the majority of all votes cast for the office of City Clerk of the City of Gilroy;that H.R.ESCHENBURG received the majority of all votes cast for the office of City Treasurer of the City of Gilroy; that HAROLD STURLA received the majority of all votescast for the office of City .Marshal of the City of Gilroy, and that. CABL W.PATE,CHAffi.JES GALLO,J. HUGHES KENNEDY,COURTLAND M.RUSH,KENNETH L.PETERSEN and SEGUNDO SANCHEZ received the majority of all votes cast for the offices of Councilmen of the City of Gilroy. It is, therefore, ORDERED and DECLARED that GEORGE M.MASON has been duly elected to the 0 ffic e of lIIlayor of the City of Gilroy; that PHILIP A.COX has been duly elected to the office of City Clerk of the City of Gilroy; that H.R.ESCHENBURG has been duly elected to the office of City Treasurer of the City of Gilroy;that. HAROLD STURLA has been duly elected to the office of City Marshal of the City of Gilroy, and that CARL Y. PATE, CHARLES GALLO,J . HUGHES KENNEDY,COURTLAND M.RUSH,KENNETH L.PETERSEN and SEGUNDO SANCHEZ have been and are duly elected to the office of Councilmen of the City of Gilroy. BE IT FURTHER RESOLVED: That the City Clerk of the City of Gilroy immediately sign and deliver to each person so elected a certificate of election. '-',' 1 ('0 1-~) t A communication is read from the Division of Highw~s,District IV, requesting the sum of $49,000.00 as partial payment of the City's contribution toward Gilroy Cooperative Project No.1-Monterey Street widening. Motion by Councilman Kenn~dy,seconded by Councilman Pate and carried that the City Elerk be instructed to pay the sum of $49,000.00 as part payment toward the Monterey Street widening project as requested by the Division of Highw~s,District IV,in a letter dated May 7,1954,upon the condition that if the work on said project is not initiated and completed the entire sum of $49,000.00 will be returned to the City of Gilroy. There being no further business to come before this meeting the Mayor now declares this m.eeting adjourned. o~_ City Clerk
