Minutes 1954/07/06 1 I I I 1523 Gilroy, California July 6,1954 This regular monthly meeting of the Common Council is called to order by His Honor Mayor George M.Mason at 8:10 P.M. in the CouDcil Chambers in the City Hall,Gilroy,California. Present:Counci1men CarlW.Pate,Char1es Ga11o,J.Hughes Kennedy,Courtland M.Rush,Kenneth L.Petersen,Segundo Sanchez. The Mayor now asks if all Councilmen have received their copies of the minutes of regular monthly meeting held June Jhh,the regular adjourned 1524 meeting of June ~st and the special meeting held on June 29,1954. All Councilman answer in the affirmative. The Mayor now ask if there are any errors noted or corrections to be made. No errors or corrections being noted the minutes of the regular monthly meeting of June 7th,the regular adjourned meeting of June 21st and the special meeting of June 28th,1954 are declared approged. The Mayor states that this is the time specified in a legal notice J in the Gilroy Evening Dispatch and the Morgan Hill Times for the hear- ing on the proposed annexation of Cast1ewood Park Unit No.2. The Mayor now calls upon anyone present to speak for or ~ainst the proposed anne~tion of Castlewood Park Unit No.2. No person appears to speak for or against the proposed annexation. In the absence of the City Attorney the matter of presentation and reading of an ordinance pertaining to the annexation of Castle- wood Park Unit No.2 is deferred. The matter of the request of the Little League for waiving of the fee for the installation of a two inch water meter at the baseball park is discussed along with the matter of the Elementary School using the meter when the Little League is not functioning. Motion by Councilman Sanchez,seconded by Councilman Kennedy and carried that a two inch water meter be loaned to the Little League for use at their baseball park and that any time the Little League J discontinues use of the grounds that the meter be removed. The City Attorney is now present-. The City Attorney now presents and reads ORDINANCE NO.5l9. Motion by Councilman Kennedy, seconded by Councilman Gallo .::&hat ORDINANCE NO.519 be adopted. The matter of the Constitution aad By-Laws of the Gilroy Auxilliary Police is continued to a future date. Councilman Sanchez states that he has no report on the drainage r'~ L 1525 matter on ~ands ~ying southeast of the end of the 8th Street 6utfal1 Storm Sewer at the G entry plant on Pacheco Pass Road. The matter of the agreement between the City and Southern Pacific Company with reference to drainage across the rai 1road yards from Monterey Street to Alexander Street is continued to a later date. A communication is read from the Department of Public Works with reference to the widening of Monterey Street and their decision to in- clude the center or dividing strip in the project is presented and read and ordered filed. A communication is read from the Coast Counties Gas and Electric Co- "...", mpany with reference to the city's requirement for backfilling of ex- cavations made in streets and al~eys is presented and read. It is unanimously agreed that the matter of backfil~ing of excavations and also the matter of new street lights for Monterey Street be taken up at a meeting of the Council and representatives of the Coast Counties Gas and Electric Company on Thursday,Ju1y 8,1954 at 8 o'clock P.M. A communication is read from the Southern Pa~ificCompany with ref- erence the instal~ation of crossing signals at Ninth Street crossing is presented and read. The Clerk is instructed to advise the Southern Pacific Company that the matter of city participation in the cost of crossing signals at Ninth Street will be considered when the 1954-1955 budget is presented I......f for consideration and that the city is definet1y interested in this protection at Ninth Street. A communication is read from the City Engineer recommending that a progress payment in the amount of $36,841.,7 be made to P. & E., Inc. for work completed on the Eighth street storm Sewer Project. Motion by Councilman Kennedy,seconded by Councilman Pate and carried that payment in the amount of $36,841.57 be made to P.& E.lnc.for work completed on the Eighth street Storm Sewer Project upon approval of the payment. by the City Attorney. ,..".:..""'. A'communication is read from the City Engineer recommending payment of $11,349.99 to A.J.Peters & Sons for work completed on the Sanitar.y Sewer from the cannery. Motion by Councilman Pate,seconded by Councilman Sanchez and carried u that the sum of $11,349.99 be paid to A.J.Peters & Sons for work comp~eted on the Sanitary Sewer from the cannery upon approval by the City Attorney. A communication is read from the Board of Trustees of the Gilroy Public' Linrary presenting their budget. request for 1954-1955 and -1l f"" 2 ,r'1l l~r ~J and requesting a meeting with the Buildings and Grounds Committee of the Council,is presented and read. The budget request is referred to the Finance Committee and the Buildings and Grounds Committee chairman states that a meeting will be arr anged. A comLUuhication is read from the Gilroy Recreation Commission recommending that Mr.Ise Ogawa be appointed to the Commission to serve is place of Owen Van BuskirkJresigned. ~ Motion by Councilman Petersen,seconded by Councilman Rush and carried that the recommendation of the Gilroy Recreation Commission be accepted and that Mr.Ise Ogawa be appointed to the Commission to serve until March 3t1958. Mr.Justin Byers now appe ars before the Council to discuss the amount of money the city is to spend on the lli!onterey Street widen- ing project. Mr.F.B.Voorhies,representtng the Gilroy Association of Insurance Agents,now aplE ars before the Council to request permission to make a survey of the city's insurance requirements without cost to the city. This matter is referred to the Finance Committee. Mr.M.J.Filice now appears before the Council to request a joint meeting with the Council the Planning Commission and himself to ] discuss drainage in the terri~ory lying west of Princeva~e Street to the west city limits. The City Attorney now discusses the bond for the developers of the "Fairview Subdivision" and the requirement s for contract. The City Attorney now presents and reads an agreement between the City of Gilroy and Henry A.Smith with reference to the tlFair- view Subdivisionlt. It is unanimously agreed to discuss this matter further at the meeting of the Council on Thursday,Ju1y 8th,1954. An application for fireman from Hershal Wingo is presented and read and ordered filed. The report of the Poundmaster for the month of June,1954 is presented and read and ordered filed. A report of water samples tkaen by the Santa Clara County Health Department on June 2nd and 3rd~1954 are presented and read and ordered filed. ~ Reports of the City officers are presented and read.KKK Motion by Councilman Pate,seconded by Councilman Rush and carried that the reports of city officers be accepted as read and placed on file. 1527 Councilman Rush now discusses the request from the Recreation Comm- ission for a donation of $500.00' to the Little League for rest room facilities at the Little League baseball park. It is unanimously agreed that this matter be taken under advisement by the Recreation Committee. The City Marshal now appears before the Council and presents a work schedule for the Police Department. The Marshal also reports that Partmlman Jack R.Seadler has resigned. Motion by Councilman Pate,seconded by Councilman Sanchez that bills as presented be allowed and warrants ordered drawn on the Treasurer.
