This regular adjourned meeting of the Common Council is called to
order by His Honor Mayor George M.Mason at 8 o'clock P.M. in the Council
Chambers~City Ha1~,Gilroy,California.
Present:Councilmen Carl W.Pate,Char1es Gallo,J.Hughes Kennedy,Court-
land M.Rush,K enneth L.Petersen,Segundo Sanchez.
The Mayor now calls upon Mr.Roy O.Mead,representing the Cpast Counties
Gas and Electric Company, to discuss the matter of new electroliers for
Monterey Street.
Mr.Frank Thomas,representing the Coast Counties Gas and Electric
Company now appears before the Council to discuss the new electro1iers
for Monterey street and exhbits pictures of installations. Mr.Thomas
states that the total cost of the e1ectroliers is $24,600.00 and that
the lighting,payment for the fixtures amortized over a period of 25
years will amount to $459.89 per month, subject to change in lighting
rates. The matter of removing the present electroliers to side streets
is discussed Mr. Thomas stating that this would be rather costly.
Motion b~yCouncilman Pate,seconded by Councilman Kennedy and carried
that the plan for lighting Monterey Street as IX" oposed by the Coast
Counties Gas and Electric Company be accepted with Weld-Rite standards
manufactured in Oatland,Calif.designated as twin-lite anchor base type
with OB-20 incandescent fixture;with 36 twin-lite standards located in
the center or dividing strip; that the old electro1iers be junked with
the exception of salvaging some of the outside globes for fUture use.
The city's requirements for backfilling excavations made in the streets

and alleys is now discussed by Mr.Mead.
The City Bu~lding Inspector'discusses the reasons for requiring
the method used by the city for backfilling excavations.
W.J .Hanna:atJr. of the City Engineers office now presents a model
ordinance relating to backfilling of excavations. This proposed
ordinance is referred to the Street Committee for study and recommend-
ation .
The matter of backfill requirements until the ordinance is adopted
and passed is left in the hands of the Building Inspector.
Mr.James Pr~,representing the Gilroy Recreation Commission, now
appears before t he Council to discuss the commission's request for
a $500.00 donation to Little League for faci1ites at the Little
League baseball park. Mr~ Pr~ presents an agreement between the
Gilroy Elementary School District and the Little League.
The matter of the Pony League sponsored by the Gilroy Recreation
is discussed.
It unanimously agreed that the Gilroy Recreation Commission use
$500.00 of its money as a contribution to the Pony League-a part
of the Gilroy Recreation Commission's recreation program.
The City Attorney now reports he has examined the contracts
between the City of Gilroy and P. & E.tInc. for the Eighth Street
Outfall Storm Sewer and the City of Gilroy and A.J.Peters & Sons
for the Sanitary Storm Sewer for the cannery and that recommendations
of the City Engineer for progress payments are in order.
Councilman Pate di scusses the matter of removing two feet of" the
sidewalk on the north side of Martin Street between the Railroad
tracks and Monterey Street to give additional width to the t:ravelled
w~ of the street.
It is unanimously agreed to permit the contractor for the new
American Traat Building~located at the northeast corner of Monterey
and Lmrtin streets, to cut two feet from the north side of Martin
Street the city to remove the fire hydrant near the al~ey and re-
place it two feet back,from its present position and to reconstruct
the alley approach.
The matter of the aaandonment of an easement along the north ~ine
of Lot 16,Tract NO.725,Rea Subdivision No.3.
Councilman Rush requests permission to absent himself from the
mee't.-ing as he has another engagement. The Mayor grants Councilman
Rushs' request.

The City Attorney now presents and reads RESOLUTION NO.328.
Motion by Councilman Pate,seconded by Councilman Petersen that
RESOLUTION NO.328 be adopted.
RESOLUTION NO.~28
RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY ORDERING VACATION
AND ABANDONMENT OF PUBLIC UTILITY EASEMENT WHICH HAS Nar BEEN USED.
WHEREAS, a map or plat of Tract NO.72"Rea Subdivision No.3, was filed
in the office of the County Recorder of the County of Santa C1ara,State
of California, on the 15th day of May,1951,and is of record in Book 33 of
Maps,at pages 30 and 31 ; and
WHEREAS, there is shown upon the said map or plat of said SUbdivision,
a public utility easement of uniform width of ten (10) feet extending
along the northerly end of Lot 16 as shown upon said plat,the northerly
line of whiYh easement is the northerly line of said Lot 16; and
VmEREAS, the said easement has not been used since the time of the
recordation and acceptance of the said plat, and the land covered by and
included in the said easement has not been used for an~ public purpose for
whiCh it was dedicated at anytime and it is not contemplated that it will
be so used in the fUture,and that said easement should be vacated and
abandoned.
NON ,THEREFORE" BErIT RESOLVED AND IT IS HEREBY ORDERED:
That the said public utility or public service easement over,in and to
the premises hereinbefore described be, and the same is hereby,vacated
and abandoned.
BE IT FURTHER RESOLVED:
That the City Clerk of the City of Gilroy cause a certified copy of
this Resolution and order,attested by him under seal, to be recorded in
the office of the County Recorder of the County 0 f Santa Ckara, State of
California.

The matter of the bond for f'Fairview Subdivision" is now dillcussed.
W.J.Hanna,Jr. of the City Engineers office relates how the amount of
the bond was arrived at in the agreement previously presented. It is
unanimously agreed that the agreement previously presented be approved.
There being no further business to come before this meeting the Mayor
now declares this meeting adjourned.
