This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George M.Mason.

Present:Councilmen Carl W.Pate,J.Hughes,Kennedy,Courtland M,
Rush,Kenneth L.Petersen,Segundo Sanchez. Absent:Counc~~man Charles
Gallo.
The Mayor now asks if all Councilmen have received copies of the
minutes of the regular rr~nthly meeting of September 7th and the
special meeting of September 28th,1954.
All Councilmen answer in the affirmative.
The Mayor now asks if there are any errors or corrections to be

made.
Councilman Kennedy discusses the wording in the minutes of
September 28,1954,page l55l,next to the last paragraPh, lines 3
and 4, stating the the wording "that the Traffic Officers" is con-
fUSing. It is unanimously agreed to strike out the words tlthat the
Traffic Officers'. from the motion to clarify the meaning. With this
correction noted the minutes of September 7th and the special meet-
ing of September 28th,1954 are approved.
The Mayor now asks Councilman Sanchez if he has anything further
to report on the Miller Slough drainage question.

Motion by Councilman Petersen, seconded by Councilman Rush and
carried that the City contribute the sum of $1,OOO.OOt.towards the

the discharge end of the pipe lineand that the city install the

appropriate size andtype of elbow at the discharge end of the pipe lffie
payment of the money to be made upon the understanding that such pay-
ment and work shall not be taken as an admission on the part of the city
for any damage that may occur.
Councilman Rush,chairman of the Finance 66mmittee, is now called on by
the Mayor to report on the matter of fire insurance.
Councilman Rush states that his committee recommends that an appraisal

be made of all city buildings by a recognized appraisal company;that the
hooker of record, be given 20% of the business the remaining percentage
also
to be split up between the other agents and that the broker/be entitled
to his share of the remaining percentage.
Motion by Councilman Pate,seconded by Councibnan Sanchez and carried
that the recommendation of the Finance Committee on t.he appraisal of
city buildings and the division of the business on the fire insurance
policies among the brmkeraaDdagganLs be accepted and the Clerk instructed
to contact appraisal a~:mpa1i.ies and request 8...., bid for this work.
Councilman Pate reports that the City Engineer is to give him further
information with respect to the island on I.O.O.F.Avenue just off Monterey
Street. It is unanlinously agreed to continue this matter.

A co~n~nication is read from the Gilroy Association of Insurance

Agents enclosing/cover notes for two fire insurance policies,is presented
and read.
A communication is read from the American Trust Company thanking the
city for the floral piece sent to the bro1k on the occasion of the opening
in tneir new quarters.
A communication is read from the Public Utilities Commission requesting
that the city have a pepBesentative present at a meeting to be held at
the Pacheco Pass Road crossing to discuss a change in hours during certain
r~ monthss of the year for the tower man as reque sted by the Southern Pacific
~ Company. The Mayor reports. on the meeting stating that in addition to
himself Councilman Pate and Chief Administrative Officer Cox were present.
It is unan~nously agreed to wait for the report from the Public Utilities
Commission.
A communication, addressed to the City Attorney,v!ftbm the Division of
Highways, with reference to trucks parking on Monterey street is pre-
sented and read. It is unanimously agreed to wait for further word from
the Division of Highways on this matter.

A communication is read from the M~or of Turlock suggesting that
with
Council meetings be opened I an invocation. The Mayor appoints
Councilman Petersen to contact the ministerial association to as-
certain the possibility of having an minister or priest present at
regular monthly meetings to give the invocation.
A communication os read from William F.Hall requesting that the
penalty assessed against him for delinquency of a license be re-
funded. The Deputy License Collector now appears before the CounCil,
at the request of the Mayor,to explain the circumstances of the

penalty. It is unanimously agreed to take no action of the request
for a refund of the penalty.
A communication is read from the City Engineer recommending that
the Granite Construction Company be paid the sum of $15,362.40 for
the resurfacing of Hanna and Rosanna streets as part payment on
their contract of $17,967.72 for this work.

Building Inspector Byron/reports that he has inspected the work
and a few minor details of the work are not completed but that the
recofnmendation for payment as recommended by the City Engineer has
hi s approval.

carried that the recommendation of the City Engineer be accepted
and that Granite Construction Company be paid the sum ~f $15,362.40
for work of resurfacing Hanna and Rosanna streets under a contract
between the city and the company.
Building Inspector Brown reports on the finishing of the paving
work on First Street at Hanna Street and Rosanna Street stating
that the Granite Construction Company demands more money for
material for the extra work;that the Division of Highways has
consented to have the extra work done.
Mr.C.W.LeNeave,owner of coin operated music machines,now appears
before the Coun~il to request a reduction in the license fee for
music machines. The Clerk is instructed to ascertain from other
cities what they charge as a license fee for music machines and

the matter of reducing the license fee is referred to the Ordinance
Committee.
Mr.Phil West, secretary of the Chamber of Commerce,now appears
before the Council to invite Council members and the Mayor to
attend the next board of directors meeting.
Cougcilman Kennedy asks if there has been a meeting between
the Council Fire Committee IDld the Gilroy Rural Fire District

Commission to discuss the matter of the rural apparatus attending city
fires. The Mayor answers that no meeting has been held. Councilman Rush
now discusses the matter.

Councilman Sanchez states that he has a request from a resident of
Walnut Orchard Park Subdivision for the completion of an alley.
Motion by Councilman Patetseconded bU Councilman Sanchez and carried
that the City Attorney be instructed to write a letter to the bonding
company for Dunmar Homes,developers of Walnut Orchard Park Subdivision,
and instruct them that the city wants the alley completed in the sub-
division before the rainy season and that a reply to this request should
come within 15 days.
The Mayor discusses a request made of him that Miss.Balanesi,who was
Miss Gilroy at the County Fair, should be given some recognition by the

City. No action is taken.
Councilman Pate discusses the possibility of routing truck traffic
over Eigelberry Street when the Monterey street work is completed.
The Mayor discusses the possible damage to parts of Eigelberry street
during the rerouting of traffic during the Monterey Street widening.
The Mayor announces that the annual Firemen' s-Ci ty Employees banquet
will be held on Friday,October 8,1954 at 7 0 'clock P.M. at the Hotel

to make arrangements.
City Marshal 5)urla now ~pears before the eouncil to discuss com-
plaints he has received from those residing the vicinity of Wheeler
Auditorium and the I.D.E.S.hall about property damage dur~nK dances.
Motion by Councilman Kennedy,seconded by Councilman Sanchez and carried
that the City Marshal be instructed that at all future dances at Wheeler
Auditorium and I.D.E.S.Hall that those conducting the dances be required
to employ four police officers-two to be on duty inside the hall and two

police officers does not stopAifue,.complaints that future dance permits
be denied.
Mr.Albert Gagliardi now appears before the Council to discuss the
matter of requiring four police officers to be on duty during dances
at ~TIeeler Auditorium and I.D.E.S.Hall.
The City Marshal now recommends that Traffic Officer Dan Lemos and
Police Officer Edmund H.Piedmont be made Sergeants.
Motion by Councilman Pate, seconded by Councilman Rush and carried

that the recoIImendation of the City Marshal be accepted and that
Traffic Officer Dan Lemos and Police Officer Edmund H.Piedmont be
made Sergeants effective October 1,1954 to hold office at the will
and pleasure of the Council.
The City Attorney presents and reads RESOLUTION NO.337.
Motion by Councilman Sanchez, seconded by Councilman Pate that
RESOLUTION NO.337 be adopted.

U.S. SERIES '.G" BONDS OF THE 1:1ATURITY VALUE OF $33,000. NaY UN-
ASSIGliED IN THE"WATER LI1~ REPLACE~rT FUND".

WHEREAS, the Common Council of the City of Gilroy has heretofore
by Resolution established and set up a fUnd to be known as nWATER
LINE REPLACEMEl'l'"T FUNDIt into which 20% of total pD'oceeds of water
sales shall be placed annually to be used for the purpose of
repairing,replacing and maintaining water pipe line of said City;
and,
lVHEREAS, the City of Gilroy does now possess and own U.S.Series
,tG" Bonds of the maturity value of $33,000.00 heretofore purchased
with money accumulated from the water department of the City of
Gilroy and it is desirable that the said bonds be earmarked and
placed in the said "WATER LINES REPLACEMENT FUND. It
NON, THEREFORE, BE IT RESOLVED:
That said Series fiG" bonds of the maturity value of Thirty-Three
Thousand ($33,000.00) Dollars purchasedas aforesaid be, and the
same are hereby,earmarked as belonging to and placed in the said
"WATER LINES REPLACEMENT FUNDI' to be used in acccrdance with and
for the purposes set forth in the said Resolution hereinbefore
referred to establishing the said fUnd.

Motion by Councilman Pate,seconded by Councilman Sanch~z and carried

that the reports of city officers be accepted as read and placed on
file.
The City Attorney presents an application from the Southern Pacific
Company to the Public Utilities Commission to construct a spur track
for the Filice Warehouse at Ninth Street,the application stating among,
other things, that ,tno protection is needed at Ninth Street Crossing".
Motion by Councilman Pate,seconded by Councilman Rush and carried
that the City Attorney be instructed to file an abjection with the
Public Utilies Commission on the Southern Pacific Companys statement
in their application to the Commission for a spur track at Ninth
street on the statement that uno further protection is needed at
Ninth Street't.
l'vlotion by Councilman Rush, seconded by Councilman Kennedy and carried
that bills as presented be allowed and warrants ordered drawn on the
Treasurer.
Motion by Councilman Kennedy,seconded by Councilman Rush and carried
that this meeting adjourn.
