Present:Councilmen Carl W.Pate,J.Htlghes Kennedy,Courtland.M. Rush,Kellifetp L..Petersen,Segundo Sanchez. Absent:Councilman Charles Gallo. The Mayor now calls ~pon Father David Cosgrove to deliver the invocation. The Mayor now asks if all Councilmen have received copies of the minutes of the regular monthly meeting of October 4th and the special meeting of October bth,1954. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or corrections to be made. No errors being noted and no corrections to be made the Mayor now declares the minutes of the regular monthly meeting of Oct- ober 4th and the spacial meeting of October 8th,1954 approved. I Councilman Sanchez states that he has nothing further to report on Miller Slough drainage;reviews the meeting held recently with the Maintenance Superintendent of the Division of Highways,Div- ision IV,members of t he Council and others at which the Division of Highways representative stated that he feels there will be no danlage at the outleat end of the ~i~ht Street Storm Drain. It is also stated that the Superintendent agreed to send a letter to the 1559 Council advising them of their position in this matter. The Clerk states that no letter on t his subject has been received. Councilman Pate reports on the matter of cuTting back the curb along the rear of the park located in the center of I.O.O.F.Ave. It is unanim- ously agreed that the curbs along both sides of the avehue between Monterey Street and the Railroad tracks should be painted red and that the Street ~'''''' COiIlmittee secure figures on.the cost of cutting the curb. ~"'.- Councilman Pate discusses the matter of a request for an alley in the rear of Bolfings' Freezer and Bob Hollar stating that he believed it would be necessary to secure some land from the Southern Pacific Company. It is unanimously agreed that the Street Corrunittee investigate this matter further with the possibility of constructigg the alley without using Southern Pacific Company land and that the Clerk contact the Southern Pacific Company and have them send one of their engineers to meeti with the Street Committee to discuss the alley. Councilman Pate discusses the resurfacing work done on Hanna,Rosanna and Second streets by the Granite Construction Company and requests that 10% of the contract be withheld until the work is completed sat- isfactorily. Councilman Pate reports on his investigation of license for coin operated music machines and states that from his OVffi personal invest- igation and requests for information on license from other cities on licenses for music machines that he believes no change should be made in the present 1 icense for these machines. It is unanimously agreed that no change be made in the present license for coin operated Inusic machines. City Attorney Johnson reports that he has contacted the bonding company for the developers of Walnut Orchard Park Subdivision with reference to -."". I ..,,"... to construction of an alley and demanded that something be done. Motion by Councilman Pate,seconded b~ Councilman Sanchez and carried that the City Attorney be instructed to advise the bonding company for the developer of Walnut Orchard Park ~ubdivision that the alley be constructed wi thin fifteen days or the city will construct the alley and bill the bonding company for the work. A cOlllillunication is read from the Public Utilities Commission with . reference to a request from the Souther~acific Company to change 1560 the hours of the towerman at the Sixth Street crossing during cer- tain months of the year. fuotion by Councilman Pate,seconded by Councilman Petersen and carried that the request of the ~outhern Pacific Company through the Public Utilities Commission to change the h ours of the towerman at the Sixth Street crossing from the present schedule to 11:00 am. to 7:00 p.m.from November 1 to April 30th,six d~s a week and the flours for the balance of the year be 7:00 a.m. to 11:00 p.m. seven ] days a week, be granted. A communication from the Regional Water Pollution Control Board is referred to the Water Committee for study. A communication is read from the Superintendent of the Gilroy PUblic Schools requesting certain restricted or no parking in the vicinity of the high school. The ~ayor calls upon the City Marshal to discuss his conversation with the Superintendent of Schools with reference to no parking on Forest Street in the vicinity of the playground. Motion by Councilman Pate,seconded by Councilman Petersen and carried that the City Administrator be instructed to purchase UNo Parking " signs to be erected on both sides of Forest Street ~ between 1.0.0 .!i' .Avenue and Swanston Lane and parking limit signs- 8:]0 A.M. to 4:30 P.M.-be erected along the north side of I.O.O.,F. Avenue between Forest Street and the Rai~road tracks; that the Ci ty Attorney be instructed to draw up the amendment to the llTraffic Ordinance" to provide for the placing of these signs. A cO~llunication from the State Department of Public Health commending the city on the steps that have been taken to insure potable water suprly for the city is ordered filed. A communica~ion !ncluding forms for appointment of f1Broker of Record" for the city's fire insurance, the communication explain- ing the situatiop. with reference to "Temporary Broker of Record" and "Broker of Record". is read from the Pacific Fire Rating Bureau. ~ Motion by Councilman Pate,seconded by Councilman Rush and carried that the Pacific Fire Rating Bureau form appointing a Broker of Record for city fire insurance business be executed, by the Mayor. A communication from the Southern Pacific Company enclosing a traffic count made at the Kinth Street crossing from lL.O:OO A.M. Ootober 7th to 10:~~ A.M. October 8th,1954 is presented and read. fIIII"'.>,"". 1561 The count shows that a total of 10<)1 vehicles crossed this crossing during the counting period. This communication is ordered filed. A communication addressed to the City Engineer from the Senate Interim Committee on streets,Highways and Br:idges stating that the survey on primary and secondary streets had been received but that no traff~c count had been noted. . A notice from the Public Utilites Commission stating that the applic- ation for a spur track at Crossing No.E-bO.8 (Ninth Street) had been approved is presented and read and ordered filed. A communication is read from the Pacific Gas and Electric ~ompany requesting that the new lease for a portion of city property located at the northeast corner of Old Gilroy and East streets be approved" :,. The City Attorney is instructed to prepare the necessary resolution approving the lease. The Mayor now calls for the presentation of bids for appraising city property for fire insurfu~ce.Two bids are presented-General Appraisal Company-$650.00 for all property, excluding sewer farm;sewer farm appraisal only-$250.00; Marshall and Stevens-$600.oo for all city property,excluding sewer farm;sewer farm appraisal only-$200.00. Mr.F.B.Voorhies now requests the Council to ~ommit his name as Broker of Record. Motion by Councilman Kennedy that Marshall and Stevens proposal be accepted including an apprsisal of the sewer farm building. This motion failed for want of a second. Motion by Councilman Sanchez,seconded by Councilman Pate and carried that the bid of Marshall and Stevens of $600.00 for appraising all city buildings,except the sewer farm buildings, be accepted and that appraisal of the sewer farm buildings be considered after the value of these buildings have been checked with the Broker of Record. Motion by Councilman Pate,seconded by Councilman Kennedy and carried values that the Finance Committee be authorized to secure/on all properties including the sewer farm buildings, from the Broker of Record. and reads The City Attorney now presents/a resolution approving the lease between the City of Gilroy atld the Pacific Gas and Electric Company. TI[otion by Councilman Pate,seconded by Councilman Rush that the Resolution as presented and read by the City Attorney be adopted. 1 ~ ,n c\ 'tJn:6 BE IT RESOLVED: RESOLUTION NO. 337A That the City of Gilroy lease unto Pacific Gas and Electric Company, a cor~oration, the premises located at the Northeast corner of Old Gilroy Street and East Street in the City of Gilroy, for a term of ten (10) years, beginning on the first d~ of September, 1954, for the annual rental of Sixty ($60.00) Dollars,payable annually in advance, said premises being the same heretofore leased to the Coast Counties gas & Electric Company, in accordance with the pro- visions of a form of lease submitted by said Pacific Gas & Electric Company; and BE IT FtfrlTHER RESOLVED: That the Mayor and City Clerk of the said City of Gilroy be, and they are hereby, authorized to execute the said lease,as sub- mitted, on behalf of the said City of Gilroy; PASSED and ADOPTED this first day of November,1954, by the following vote. ~ AYES: NOES: ABSENT: Councilmen Pate,Kennedy,Rush,Petersen,Sanchez Councilmen None Councilman Gallo. Atte(1 .~.~ City Clerk ~"V~~.~ A1ayor Mr.Phil West,Secretary of the Gilroy Chamber of Commerce, now appears before the Council to request the closing of Martin Street between Monterey street and the Railroad tracks on December 4th, 1954 for the ChamberE of Commerfe Christmas party. ~ Motion by Councilman Pate,seconded by Councilman Rush and carried that the Chamber of Commerce be granted permission to close Martin Street between 110nterey Street and the Railroad tracks on December 4,1954 between the hours of 6:30 P.M. and 10:00 P.M. for their Christmas party. The matter of transportation for Santa Claus on the city fire truck is placed in the hands of the Fire Committee. di scuss es Councilman Petersen/plans for the Santa Clara County Cattlemen's Association bull sale at the ~ymkhana grounds and the matter of improvements requested by the association is placed in the hands of the Buildings and Grounds Committee. Councilman Sanchez discusses the request of the Junior Chamber ~. of Commerce to place Christmas lights on the redwood tree in the park in the center of I.O.O.F.Avenue. It is agreed that Councilman Sanchez investigate this matter. Mr.F.B.Voorhies now ap~ ars before the Council to request that he be appointed the city's Broker of Record for insurance business through the Gilroy Insurance Agents Association.No action is taken. Councilman Sanchez now discusses the matter of the city pipe line from the dam to the reservoir with reference to the line - I I - ~... I I I I ! Councilman Sanchez states that Dr.Hockenbeamer is preparing to build a dam across the ravmne over which the city pipe line passes and states that the doctor has agreed to remove the present trestle and pipe. It is unanimously agreed that the City Attorney write a letter to Dr.Hockenbeamer asking for his assurance that the city will not lose the easement over his property if the dam to reservoir is moved. Motion by Councilman Sanchez, seconded by Councilman Pate and carried that Dr.E.P.Hockenbeamer be granted permission to cut the city pipe line from the dam to the reservoir whbch crosses his property and any pipe or lumber he can sal~age he can have, providing, the city's easement will not be jeopardized. Councilman Sanchez discusses the matter of the extension of a water line in the rtenz Addition at La Coche Way. It is agreed that the City Building Inspector discuss this matter with Mr.Renz. Councilman Sanchez discusses the matter of cleaning the Llagas Creek at the sewer farm. No action is taken. A deed from the California Pacific Title Insurance Company to the City of Gilroy for an alley between First Street and Broadway is presented. The City Attorney now presents and reads RESOLUTION NO.338. I,lotion by Councilman Pate ,seconded by Councilman Sanchez and carried that RESOLUTION NO.338 be adopted.
