Minutes 1956/02/06 1680 Gilroy, California February 6,1956 This regular monthly meeting of the Common Council is called to order by His Ilonor Mayor George M.Mason. Present:Councilmen Carl W.Pate,Charles Gallo,J.Hughes Kennedy, Courtlahd M.Rush,Segundo Sanchez.Absent:Councilman Kenneth L. Petersen. The Mayor now asks if all Councilmen have received a copy of the minutes of the regular monthly meeting of January 3,1956. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or corrections to be made in the minutes. No errors being noted and no corrections to be made the Mayor now declares the minutes of the regular monthly meeting of January 3,1956,approved. . The Mayor now calls upon Major Harry Nicholson o~ the California National Guard to appear before the Council to di,cUSS the matter of the city's plans to use \Vheeler Auditorium for City Hall purposes and the possibility of the city purchasing a plot of ground to be used as a site for an armory to be constructed by the State. Major Nicholson asks that Colonel Paul R.Teilh appear before the I f""'''' I '-- 1681 Council to discuss this matter. Colonel Teilh discusses,the state's program for the construction of armory buildings and states that Gilroy is on the list for such a building providing the city would furnish the site. Mayor Mason suggests that ,the Guard use the city hall building temporarily i~ the city decides to go ahead with its plans to convert Whe~ler Auditorium. Colonel Teilh states that he believes this plan would work .The Mayor asks the Deputy City Clerk to conduct the Colonel through the building to get his reaction to the suggestion. the city Colonel Teilh is advised that/has selected five possible sites for an armoz:y and would like to have ". him inspect them. The Colonel states that whenever the Council is ready he would be glad to come to Gilroy and view the proposed sites. The Deputy City Clerk reports that the Colonel is pleased with the City Hall building for temporary quarters for t he Guard. The City Attorney presents and reads a letter from the Adjutant General's office relative to the payment of rent on a month to month basis by the Guard and,in view of the objections made by the Depart- /"". ment of Finance to the new lease, suggests that the old lease be , ~ continued on a month to month basis. ......... Mr.L.J . Layne of the Corps of Engineers, now cppears before the Council to discuss payment for material to be used to repair the Llagas Creek levee at the City Sewer Farm,stating that the Government will furnish the hauling and other labor but will not furnish material. Motion by Councilman Rush,seconded by Councilman Pate and carried that the city pay the royalty on the gravel needed to repair the Llagas Creek levee at the Sewer Farm. Mr.Layne requests that the City Engineer be delegated to point out the location on the Uvas Creek where the gravel can be obtained. This reque st is 'granted and the City Jt:illgineer is directed by the Mayor to indicate the location where the gravel should be taken from. A communication is read from the City Engineer's office giving the cost estimate on remodeling of Whee~er Auditorium for city hall purposes. The estimate is $50,930.00. The Mayor directs that the Buildinga and Grounds Committee and the Finance Committee view; the plans as submitted by the City Engineer's office and report t heir findings to the Council at a later date. Owsley Park and recommends that a new dwelling be constructed at OWsley Park instead of repairing and adding to the present structure. Motion by Councilman Sanchez,seconded by Councilman Rush and carried that City Building Inspector Byron Brown discuss the repairing of the present dwelling and sugge sted addition vd th the wife of the occupant of the dwelling and arrive at a conclusion as to what work should be done to satify her;that any work done should come within a reasonable cost. ] Councilman Sanchez reports that the new water well on South Forest Street is e~npleted and that specifications are being prepared for a pump to deliver 1200 GPM and the specifications will be ready for the next meeting. Councilman Pate state s that he has nothing further to report on the matter of the extension o~ Alexander Street south of Ninth Street. The City Attorney reports that as a result of his discussion with the Division of Water Resources he would advise that the city proceed at once to get some water through the Uvas pipe line as the city's right may be placed in jeopardy through, lack of use of the line for a period of five years. It is unanimously agreed that the Water Committee should proceed at once to make a study of this matter. ] The City Attorney reports that he has contacted Mr.Robert Anderson,attorney, with reference to using his services to investigate the Pacific Gas and Electric Company franchise tax payments;that he will submit an opinion and brief for the sum of $750.00. The City Attorney asks Council's permission to call at the League of California Cities office in Ber~eley to discuss this matter with leage officials. It is unanimously agreed that the City Attorney be granted permission to make this trip. A communication is read from the Junior and Senior Classes ] requesting permission to use \Vheeler Auditorium for their annual variety show on February 21st and 22nd. Motion by Councilman K ennedy,seconded by Councilman Gallo and carried that the Junior and Senior classes of the High School be granted', free use of Wheeler Auditorium on February 22nd,1956 for their variety show and the Clerk be instructed to advise the 1683 Senior class secretary that they would have to obtain permission to use the auditorium on February 21st from Colonel Robert Greig. A communication is read from the California State Automobile Assoc- iation advising the Council of a change in policy of ~ing effective July 1,1956. The Clerk is instructed to ascertain from the association the manner in which the hourly time proposed by the association was to be charged. __ A communication is read from Mrs.Edward Peterman submitting her resignation as a member of the Board of Trus~ees of the Gilroy Public Library. Motion by Councilman Pate,seconded by Councilman Kennedy and carried that the resignation of Mrs.Edward Peterman as a member of the Board of Trustees of the Gilroy Public Library be accepted,with regret and the Clerk instructed to write a letter to Mrs.Peterman thanking her for her many years of service as a member of the board. A communication from Logan and Frazer,city auditors, stating that the audit of the city's books of record and acount had been audited to December 31,1955 and everything was found to be in order, is ordered filed. A communication from the Gilroy Police Department requesting a 15% increase in salaries is presented and read. It is unanimously agreed to place this request in t,he hands of the Finance Committee. The City Marshal discusses the matter of officers of the poli~e department being covered b~ insurance for false arrest. It is unan- imously agreed to investigate this matter with the insurance carrier. Councilman Pate discusses the matter of a new wooden polesbeing used in another city for street lights in subdivisions. This matter is referred to the City Attorney for further investigation. The Mayor reports that the city could qualify for P .M.A. assi stance in clearing Miller Slough. Councilman Sanchez agrees to investigate this matter further. f". ,~ Councilman Pate reports that he has a request from the Gilroy Taxi -~ Service to establish a taxi stand at the El Charro Cafe on South Monterey Street. It is unanimously agreed that Councilman Pate investigate this matter. The City Attorney presents and reads an,.. agreement submitted by the Department of Military Affairs with reference to the State's lease on Wheeler Auditorium. RESOLUI'ION NO.~ BE IT RESOLVED: That the City of Gilroy enter into the following agreement relating to the rental of the Gilroy Armory premises to the State of Calif- ornia,to-wit: Pursuant the Paragraph 6 of lease dated 27 October 1944,between the undersigned, as lessor, and the State of California, as lessee,covering premises known as Gilroy City Auditorium,SE corner of 6th and Church Streets,Gilroy,it is hereby agreed that the state of California is authorized to remain in said oremises on a month to month basis beyond 3r'" July 1955,at the same monthly rental of Seventy-five Dollars, and under the same terms and conditions contained in the said lease insofar as applicable. BE IT FURTHER RESOLVED: That the said agreement be executed on behalf on the City of Gilroy by GEORGE M.MASON,Mayor of said City. The Mayor now nmminated John Scherrer and Michael A.Filice to serve as members of the National Guard Commission of Santa Clara County. Motion by Councilman Pate, seconded by Councilman Sanchez that John Scherrer and Michael A.Filice along with Councilman Gallo represent the City of Gilroy as members of the Santa Clara County National Guard Commi ssion. The matter of a request to use the lot at the southwest corner of 6th and Monterey streets to burn out wrecked automobile bodies is discussed. It is unanimously agreed that this type of activity would be objectionable in this area. Councilman Sanchez reports that he has investigated several possible locations for a new armory and has discussed availability and cost with the owners. The petition of the De Bell Corporation and Arnold-Day Corporation to annex to the city a portion of Ranch lot 24 of the Las Animas Rancho as shown on Map No.7 accompanying the report of the Referees in the Las Animas Rancho Partition Suit,Action No.5536 had in the Superior Court of the State of California in and fpr t he County of Santa Clara. This petition is referred to the Gity Planning Commission. The Fire report by the Gilroy Volunteer Fire Department for 1955 is presented and read and ordered filed. The report of the Gilroy Telephone Company on the 1955 franchise tax is presented fu~d read. The franchise tax payment for 1955-$3,516.01. This report is ordered ftled. The report of current taxes collected by the County Controller is presented and read-total collections to Dec.10,1955-$63,B39.46. This report is ordered filed. .
