This regular adjourned meeting of the Common Cou~cil -is called
to order by His Honor Mayor George C.Milias.
Present:Councilmen Sig Sanchez,Charles Gallo,Courtland M.Rush,
Everett C.Wentworth. Absent:Councilmen Carl W.Pate,Kenneth L.
Petersen.
The matter of a request to provide subdivision improvements
under the 1913 Improvement Act is now discussed.
Mr.Kenneth Jones, representing Mr.Ernest Wilson of Kirkbride,
Wilson,Harzfeld andWallace,attorneys,now appears before the
Council to discuss the 1913 Improvement Act. Mr.Jones presents
two letters-one from the City Manager of Santa Cruz and one
from the City Attorney of Watsonville-,two cities in which his
firm has used the 1913 Improvement Act in subdivisions.
Motion by Councilman Wentworth, seconded by Councilman Gallo
that the type of financing under the'1913 Improvement Act be
not accepted.
Attorney John Klarich representing the owners of the property
upon which the proposed financing un~er the 1913 Improvement
Act is being discussed now appears before the Council to discuss
the proposed method of financing.
Councilman Wentworth now agrees to withdraw his motion and
Councilman Gallo,who seconded the motion, agrees K to withdraw
his second.
It is unanimously agreed to postpone the decision on the matter
of financing the proposed subdivision under the 1913 Improvement
Act until September 4,1956.
Building Inspector Byron Brown reports that he does not want to
give a permit to Dalcin Bros.to instal a butane tank on the service
station property at 636 North Monterey Street and would prefer to
leave the decision on this matter to the Council. This matter is
referred to the Fire Committee to investigate and report to the
Council.
The Building Inspector reports that he has nothing further to
report on the East 7th Street drainage matter.
It is unanimously agreed to defer action on the ~eement between
the high school district and the city on the use of school property
for recreation purposes until the September 4th meeting.
Councilman Sanchez presents and reads the new salary and wage
schedule for city employees and discusses the mateer of minimum
and maximum salaries.
Motion by Councilman Rush,seconded by Councilman Wentworth and
carried that Harold Sturla be appointed Inspector of Radar at a
salary of $41.50 per month,effective September 1,1956.
Motion by Councilman Sanchez, seconded by Councilman Gallo and
~arried that the monthly salaries and wages of city employees

RESOLUTION PRESCRIBING STEPS NECESSARY FOR CONDUCT OF A PUBLIC HEARING
AND NOTICE THEREOF ON THE PUBLIC CONVENIENCE AND NECESSITY WHERE
SPECIAL ASSESSMENT PROCEEDINGS ARE PROPOSED TO BE TAKEN FOR THE
ACQUISITION AND/OR IMPROVEMENT OF PROPERTY WITHOUT COMPLIANCE WITH
THE SPECIAL ASSESSMENT INVESFIGATION,LIMITATION AND MAJORITY PROTEST
ACT OF 1931.
BE IT RESOLVED by the Common Council of the City of Gilroy as
follows:
FIRST: Prior to the adoption of any ordinance or resolution by the
Common Council of the City of Gilroy,ordering the construction of any
public improvement or the acquisition of any property for public use,
or both,where the cost of such construction or acquisition is to be
paid in whole or in part by special assessments or through special
assessment taxes upon lands,and it appears that the public convenience
and necessity require such undertaking or improvement and thatproceedings
should be taken therefor without complying with the provisions of the
Special Assessment Investigation,Limitation and Majority Protest Act
of 1931,a.public hearing shall be held on said question of public
-convenience and necessity and notice of said hearing shall be given
in the time and manner as provided in this Resolution.
SECBND: Prior to the adoption of any ordinance or resolution ordering
the construction of any public improvement or acquisition of any prop-
erty for public use,pursuant to any act providing for the levy of
special assessments upon property,a resolution of preliminary deter~-
ination shall be passed and adopted describing the proposed improvement
and the boundary lines of the District proposed to be assessed to pay
therefor,and setting a time and place where and when any person
interested,owning,or having an interest in the real property within
the proposed assessment district,may file written objections and may
appear and show cause,if any they have,why the said Con~on Council
should not find and determine that the public convenience and
necessity require the proposed improvement or acquisition without
compliance with the Special Assessment Investigation,Limitation and
Majority Protest Act of 1931.
THIRD: Notice of the hraring above provided for shall be given to
the owners of the property within the boundary lines of the district
to be assessed to pay for the costs of said acquisition or improvement
as follows:
A. A notice setting forth the time and place of the hearing
on the public convenience and necessity of said improvement shall be
published twice in the newspaper designated in said resolution,the
first of which publications shall be at least fifteen (15) dats prior
to the date fixed. for said hearing. The City Clerk shall give said
notice.
B. Notice of the hearing above proposed shall be posted for
ten (10) days on or near the door of the Chamber of the Common Council
of the City of Gilroy,State of California,the posting of which shall
be completed at least ten ilO) days prior to the date fixed for said
hearing. Roth the notice provided for in this Subdivision B and that
provided for in Subdivision A hereinabove set forth,shall briefly
describe the proposed improvement. The Clerk shall post said Notice.
FOURTH: An~ person interested,owning,or having an interest
in real property within the district proposed to be assessed to pay
for said acquisition or improvement may,on or before the time fixed
for said hearing,file with the City Clerk written objections to
undertaking said proceedings without first complying with the provisions
of the Special Assessment Investigation,L~mitation and Majority Protest
Act of 1931. Said objection shall bear the description of his property,
and a statement of the nature of his objection.
FIFTH: If no objections are filed as provided for herein,or
when said objections shall have been heard and overruled,the Common
Council may adopt a resolution finding and determining that public
convenience and necessity require the proposed acquisition or improve-
ment,or both,and that the Special Assessment Investigation,Limitation
and Majority Protest Act of 1931 shall not apply.

REAFFIRMING RESOLUTION NO.376 OF THE CO~~ON COUNCIL OF THE CITY
OF GILROY DECLARING THAT PUBLIC INTERESTS AND CONVENIENCE REQUIRE
THE ESTABLISHMENT OF THE LIGHTING DISTRICT DESCRIBED IN THE SAID
RESOLUTION NO.376, AND REAPPOINTING OFFICER TO MAKE AND FILE WITH
THE COUNTY CLERK THE REPORT REQUIRED BY SECTION NO.18041 OF THE
STREETS AND HIGHWAYS CODE AND MODIFYING THE DESCRIPTION OF THE
LIGHTING DISTRICT TO BE ESTABLISHED.
WHEREAS, the Common Council of the City of Gilroy did heretofore
and on the 5th day of March,1956,adopt Resolution No.376 declaring
the desirability of establishing a lighting district in a described
PRrtion of the City of Gilroy,and appointing BYRON BROWN, Building
Ihspector of the City of Gilroy,as the officer to make and file with t}
the City Clerk of the City of Gilroy the report required by Section
18041 of the Streets and Highways Codeiand,
WHEREAS, the Common Council of the City of Gilroy does now desire ]
to proceed with the establishment of the said Lighting District, and .1
in accordance with the Street Lighting Act of 1919iand, .
WHEREAS, the territory which the said Common Council declares
should be included in the said District is sIghtly smaller than
that included in the said Resolution No.376,and the said Common
Council believes that the said Lighting District should comprise
the territory as hereinafter described.
NOW,THEREFORE,BE IT RESOLVED:
That in the opinion of the Common Council of the City of
Gilroy the public interests and convenience require that the
Lighting District hereinbefore mentioned be established for the
purpose of replacing the obsolete lighting system now existing in
the said area as hereinbefore described.
BE IT FURTHER RESOLVED:
That BYRON BROWN, the Building Inspector of the City of Gilroy
be,and he is hereby,directed to prepare and file with the City
Clerk a report in writing for the furnishing and installation of
street lights and street lighting standards in the following
described portion of the City of Gilroy,to-wit:
Beginning at the intersection of the center line
of Welburn Avenue with the westerly line of
Wayland Lane as shonw on the Map of Tract 971,
Renz Addition to the City of Gilroy,according to
the map thereof on file in the office of the County

THE CITY OF GILROY. .
That said report shall be prepared in accordance with the
provisions of the Street Lighting Act of 1919 of the State of
California, and shall include the following:
(a) Plans and specifications of the proposed improvement.
(b) An estimate of the total cost and expenses of the
said improvement.
(c) A diagram showing the proposed assessment district
that will be benefited by the said improvement, and
also the boundaries and dimensions of the said
land into lots or parcels,and portions thereof,
within said district,each of which lots or parcels
shall be given a separate number upon the diagram.
(d) The proposed assessment of total amount of costs
and expenses of the proposed improvement upon the
several lots or parcels of land in said District
in proportion to the estimated benefits to be
received by such lots or parcels respectively
from said improvement. The proposed assessment
shall refer to such lots or parcels on the diagram
by the respective numbers thereon, and it shall
show the nammes od the owners,if known,or elsee
designated as unknown.
(e) Any other information required by Section 18041
of the Streets and aHighways Code.
The City Clerk is hereby instructed to deliver to the said
Building Inspector a copy of this Resolution.

\VHEREAS,the City Clerk of the City of Gilroy has,on this
date,presented to the City Council for consideration, that
certain report entitled "Report of City Building Inspector
of the City of Gilroy In The Matter of Furnishing and
Installation of Steel Lighting Poles and Street Lights for a
Street Lighting System For an Improvement District Comprising
Tract No.239 Renz Addition to the City of Gilroy,and portions
of Tracts No.1046,Wayland Lane Tract and Loupe Northern
Adsition to the City of Gilroy,in Accordance with Street
Lighting Act of 1919 of the State of California",made by the said
City Building Inspector in accordance with resolution adopted

WAYLAND LANE TRACT ,AND LOUPE NORTHERN ADDITION TO THE CITY OF GILROY,
AND TO ORDER THE FURNISHING OF STEEL LIGHTING STANDARDS AND STREET
LIGHTS IN SAID DISTRICT.
WHEREAS, the Common Council of the City of Gilroy did,on the 20th
day of August,1956,review and consider that certain report entitled
"Report of the City Building Inspector of the City of Gilroy in the
Matter of Furnishing and Installation of Steel Lighting Poles and
Street Lights for a Street Lighting System for an Improvement District
Comprising Tract No.239 Renz Addition to the City of Gilroy,and
Pdttions of Tracts No.1046,Wayland Lane Tract, and Loupe Northern
Addition to the City of Gilroy,in accordance with "Street Lighting
Act~ of 1919" of the State of California",made by the said Building
Inspector of the City of Gilroy and filed with the City Clerk, and
vffiEREAS,said Common Council found said report to be sufficient
for the purpose of all subsequwnt proceedings, and in due and proper
form as made and presented and has made no modification th~reof.
NOW,THEREFORE,BE IT RESOLVED by the Common Council of the City
of Gilroy that the public interest and convenience require, and it
is the intention of the Council to order, the following improvement
to be made in said City,to-wit:
That the obsolete and inadequate lighting system
in the District and territory hereinafter specif-
ically described be replaced by steel lighting
standards and street lights be installed thereon,
as described and set forth in the said Report of
said Building Inspector,and that said improvement
of the said street lighting system shall be for
a period of time beginning on the 1st day of
November,1956, and ending on the 30th day of June,
1959. Said furnishing and installation of said
lighting poles and installation of lights shall
be done strictly in accordance with the plans and
specifications therefor prepared as heretofore
directed.
Said Common Council hereby determines and declares that sdid
proposed improvement is of more than local or ordinary public benefit,
and will affect and benefit the lands and District herein described,
which said District is hereby declared to be benefited by said
improvement,and that therefore, the cost and expenses of said
improvement including all incidental expenses shall be assessed upon
the lands in said District,which District,to be known as the
Assessment District,is within the City of Gilroy,County of Santa
Clara,State of California, and is particu1arly bounded and described
as follows:
Beginning at the intersection of the center line
of Welburn Avenue with the westerly line of
Wayland Lane as shown mn the Map of Tract 971,
Renz Admition to the City of Gilroy,according to the
map thereof on file in the office of the County
Recorder of Santa Clara County,and running thence

above described may also be referred to as "Street Lighting
District No.l".
The Common Council hereby determines that no part of the
cost of said improvement shall be paid out of the treasury of
the City of Gilroy,from the general funds thereof,provided,
howeyer,that said City of Gilroy may at any time transfer into
the special fund for said improvement district, out of any
money in the general fund, such sums as it may deem necessary,
and the funds so transferred shall be deemed a loan to such
special fund and shall be repaid out of the proceeds of the
assessments.
All proceedings for the aforesaid improvement shall be
taken ~nder and in accordance with the provisions of the
"Street Lighting Act of 1919"of the State of California,as
amended.

AND PARTS OF TRACTS 1046,WAYLAND LANE TRACT AND LOUPE NORTHERN
ADDITION TO THE CITY OF GILROY,AND DESIGNATED AS "LIGHTING DISTRICT
NO.1" IN THESE PROCEEDINGS,AS DESCRIBED IN RESOLUTION OF INTENTION
NO.388.
WHEREAS, the Common Council of the City of Gilroy did,on the 20th
day of August,l956,pass its Resolution of Intention No.388,declaring
the intention of the Council to order the replacing of the obsolete
lighting system now existing in the area comprising Tract No.239
Renz Addition to the City of Gilroy and parts of Tracts No.l046,
Wayland Lane Tract,and Loupe Northern Addition to the City of Gilroy,
by fhefurni:;1hing and installation of steel lighting poles and street
lights, for a period commencing on the 1st day of November,l956,and
ending on the 30th day of June,1959;and
WHEREAS, the said Coujcil did,on the said 20th day of August,1956,
review and consider that certain report entitled "Report of the City
Building Inspector of the City of Gilroy in the Matter of Furnishing
and Installation of Steel Lighting Poles and Street Lights for a
Street Lighting System for an Improvement District Comprising Tract
No.239 Renz Addition to the City of Gilroy,and portions of Tract No.
1046,Wayland Lane Tract and Loupe Northern Addition to the City of
Gilroy,in accordance with"Street Lighting Act of 19l9" of the State
of California",and found the same sufficient and in due and proper
fprm,as presented, and has made no modification thereof,
NOW,THEREFORE,BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF GILROY,THAT Monday,the 1st day of October,1956,at 8 o'clock p.m.
in the Common Council Chambers in the City Hall,Gilroy,California,
is hereby designated as the time and place for hearing protests in
relation to the aforementioned improvement, and
BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby
directed to give notice of said hearing by posting and publication,
as prescribed by the said "Street Lighting Act of 1919",said
publication to be made in the Gilroy Evening Dispatch,a daily news-
paper published and circulated in the City of Gilroy,and the news-
paper hereby designated for that purpose.

RESOLUTION OF PRELIMINARY DETERMINATION THAT PUBLIC CONCENIENCE
AND NECESSITY REQUIRE THE IMPROVEMENT OF STREET LIGHTING FACILITIES
IN A PROPOSED LIGHTING DISTRICT COMPRISING TRACT NO.239,RENZ ADDITION
TO THE CITY OF GILROY,AND PORTIONS OF TRACTS NO.I046,WAYLAND LANE
TRACT,AND LOUPE NORTHERN ADDITION TO THE CITY OF GILROY,DESCRIBING
SAID PROPOSED IMPROVEMENT AND SETTING A TIME AND PLACE OF HEARING
THEREON.
RESOLVED:
That preliminary determination is hereby made that public convenience
and necessity require the following improvements to be made and paid

for by special assessments levied upon the property benefited,
and that necessary proceedings should be taken therefor without
compliance with the provisions of the Special Assessment Invest-
igation,Limitation and Majority Protest Act of 1931,to-wit:
That steel lighting standards amd street lights be furnished and
installed in an improvement district in the City of Gilroy com-
prising all of Tract 239,Renz Addition to the City of Gilroy,and
portions of Tracts 1046,Wayland Lane Tract,and Loupe Northern
Addition to the City of Gilroy~as the District ~s described and
bounded in and in accordance w1th "Report of the City Building
INspector of the City of Gilroy in the matter of furnishing and
installation of steel lighting poles and street lights for a
street lighting system for an improvement district comprising
Tract No.239,Renz Addition to the City of Gilroy,andportions of
Tracts No.1046,Wayland Lane Tract,and Loupe Northern Addition to
the City of Gilroy,in accordance with "Street Lighting Act of
1919",of the State of California.
F~THER RESOLVED:
That Monday,the 17th day of September,1956,at eight o'clock p.m.
is hereby fixed as the day and hour,and the meeting place of the
Common Council located in the City Hall,Gilroy,California,as the
place when and where any and all persons inetrested who have filed
a written objection may appear and show cause why the said Common
Council shpuld not find and determine that the public convenience
and necessity require the said proposed public improvement of said
street lighting facilities in said proposed Improvement District,
without compliance with the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931.
The City Clerk is hereby directed to give notice of the time and
place of said hearing in conformity with the requirements of
Resolution No.385 by posting and by publication in the Gilroy
Evening Dispatch.

The Mayor discusses the traffic situation at 6th & Eigelberry
Streets and it is unanimously agreed that this intersection should
be a four way STOP. The Building Inspector is requested to ask the
owners of property at Leavesley Road and Forest Street to trim
the trees at this intersection to provide anetter view for
vehicles entering Leavesley Road from Forest Street.
Motion by Councilman Rush,seconded by Councilman Sanchez and
carried that this meeting adjourn.
