Minutes 1956/10/15 1775 Gilroy, California October 15,1956 i > I This regular adjourned meeting of the Common Council is called to order by His Honor Mayor George C.Milias. Present:Councilmen Sig Sanchez,Charles Gallo,Kenneth L.Petersen, Courtland M.Rush,Everett C.Wentworth. Absent:Councilman Carl W.Pate. A communication is read from the Board of Trustees of the Gilroy Union High District stating that they have voted to enter into a cooperative project with the city for the construction of a swimming pool on high school property. Councilman Gallo reports that the Ordinance Committee has met and has completed discussions on the proceedural part of a subdivision ordinance. Copies of this portion of the ordinance are passed out to members of the Council. Councilman Sanchez reports that the ~inance Committee has met and recommends that the city contribute the sum of $$0.00 per month, effective October 1,l956, to the Gilroy Auxilliary Police to assist in purchasing uniforms and that this amount be contributed each month to the end of the fiscal year. Motion by Councilman Petersen, seconded by Councilman Wenwworth and carried that the recommendation of the Finance Committee be accepted and commencing October 1,1956 the city contribute the sum of $$0.00 per month to June 30,1957 to the Gilroy Auxilliary Police to be used for replacing uniforms. Councilman Wentworth reports that the bridge across the Llagas Creek at the Sewer Farm is being used by the tenant; that the work on the Carnadero bulkhead is practically complete;that further in- formation will be sought on the matter of securing railroad rails for the upper part of the Carnadero levee;that dirt needed to strenghten the levee on the Llagas Creek at the sewer farm must be obtained and that further investigation will be made on this matter and a r~port will be made at the next meeting of the Council. Councilman Petersen reports that the Buildings and Grounds Committee will meet with the Library Board and the architect on Tuesday,October 16th to go over plans and specifications for library improvement. Building Inspector Byron Brown reports that the roof of Wheeler Auditorium will be repai~ed during the week and the termite control work is practically completed. Butlding Inspector Brown submits a bid from Geo.C.Renz Construction Company of $19$$.00 to place plant mixed surfacing over the south half of Welburn Aven~e between Wayland Lane and Hanna Street. The Mayor suggests that at least two bids shduld be obtained for work costing the amount of money submitted by Renz Construction Company. The M~yor asks W.J.Hanna,Jr.of the City Engineer's office if the figure submitted by Renz Construction Company is within his estimate of cost of the work on Welburn Avenue.Mr.Hanna states that the figure is well wi~in the engineers' estimate. The City Administrator now presents and discusses the possibility of having local householders purchase the type of barrel exhibited to place lawn trimmings and garden refuse in to expidite the work of 17:76 the Street Department in picking up this type of refuse. The matter is referred to the Street Committee. Councilman Sanchez discusses the Recreation Committee's meeting with the trustees of the Gilroy Union High School District with reference to the construction of swimming pool on high school property and suggests that a house to house canvass be made to obtain a cross section of community sentiment with reference to constructing a swimming pool on high school property. Councilman Wentworth discusses his experience in discussing the matter of a swimming pool with a local church group. Councilman Rush states that he has no faith in polls and urges the Council to make its own decision on the matter. Councilman Gallo states that he believes the people of the community prefer a public park in preference to a swimming pool. The Mayor discusses the issue before the Council and urges the the joint venture with the high school to construct a swimming pool on high school property. Motion by Couucilman Rush,seconded by Councilman Sanchez and carried that the City build a swimming pool on the property of the Gilroy Union High School District on a cooperative basis, negotiations between the school district and the City to be started immediately,the Recreation Committee of the Council to represent the City in the negotiations to arrange for joint construction,operation and maintamnence of a swimming pool. The Mayor relates an inspection of Sherwood Park Unit No.1 in which no alleys are provided and remarks about the condition of alleys in the vicinity. The Mayor discusses the matter of parking in the business district and recommends that the Council give some thought to the forming of a Parking Commission to study the matter and discusses the possibility of installation of parking meters to raise sufficient funds the purchase sites for parking lots. Councilman Sanchez discusses the capacity of city sewers and this matter is referred to the Sewer Committee for study. The City Atoorney presents and reads &ESOLUTION NO.398. Motion by Councilman Sanchez,seconded by Councilman Rush that RESOLUTION NO.398 be adopted. RESOLUTION NO.398 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY,PROVIDING FOR NOTICE OF THE PROPOSED ANNEXATION OF UNINHABITED TERRITORY DESIGNATED AS ftFOURTH NORTHERN ADDITION TO THE CITY OF GILROYft. J ~ J WHEREAS,a written petition has heretofore been filed in the office of the Clerk of the City of Gilroy,under the provisions of the "Uninhabited Territory Act of 1939",as set forth within Sections 35300 to 35326 inclusive of the Government Code of the State of California,asking that there be annexed to the City of Gilroy,as uninhabited territory,the following described tract of land contiguous to the exterior city limits of the City of Gilroy, situated in the County of Santa Clara,State of California,to-wit: Being a Portion of Lots 7,8,16 and 17 as shown on map entitled "Map of Henry Miller's Subdivision of Las Animas Ranchlot 23",which map is recorded in Book "Hn of Maps at page 5, Records of Santa Clara County,California,and being more particularly described at follows: Beginning at a 4" x 4" post "S2M" at the corner common to Ranch Lots 23 and 24 in the southerly boundary of Ranch Lot 25 as shown on said map, J aRnd hrunning2thendce2alOng th~ lsine common Eto , ... anc Lots 3 an 4 ,.22 deg.l5' . 1100.29 feet to a buried iron pipe at the inter- section thereof with the line common to Lots 6 and 7 as shown on said map;thence along the line common to Lots 6 and 7 and Lots 15 and 16 No89 deg. l5' W. 835.15 feet to the intersection thereof with the westerly line of Wren Avenue (shown as Avenue H on said map);thence along the westerly line of Wren Avenue N. 0 deg. 47~ E.to the intersection thereof with the southerly line of Ranch Lot 25; thence along the southerly line of Ranch Lot 25, N. 89 deg. 08' E. 406.35 feet to the point of beginning and containing therein 14.43 acres of land, r'" 1 I."."..r r' L r ~ I LJ 1777 and WHEREAS,it appears that said petition has been signed by the owners of all of the area of land in such territory,and that the tract therein and herein described is contiguous with the corporate limits of the City of Gilroy;and, WHEREAS,the proponents of the said snnexation have submitted to the Boundary Commission of the County of Santa Clara the proposal for the said annexation,and the said Boundary Commission has reported to the said proponents approving the definiteness and certainty of the proposed boundaries;and, WHEREAS,the proponents of said annexation have also submitted to the City Planning Commission of the City of Gilroy the proposal for the annexation of the aforesaid territory to the said City of Gilroy,and the said City Planning Commission has reported to the Common Council of the City of Gilroy approving the annexation of said tract;and, WHEREAS,the said "Annexation of Uninhabited Territory Act of 19)~" above referred to, requires that upon the filing of such ~,_peti tion a Resolution shall be adopted by the Common Council giving notice of such proposed annexation and fixing the time and place of nearing, when and where any person owning real property within the territory proposed to be annexed may appear and object thereto;and WHEREAS, the said "Annexation of uninhabited Territory Act of 1939" provides that such hearing may be set not lews than fifteen (15) days after the passage of the resolution fixing the time of hearing in cases where the petition for the annexation is signed by all the owners of the territory sought to be annexed. NOW,THEREFORE,BE IT RESOLVED,AND ITdS HEREBY ORDERED: That the Common Council of the City of Gilroy hereby designates the territory proposed tOQe annexed to the City of Gilroy as "FOURTH NORTHERN ADDITION TO THE CITY OF GILROY",and that Monday,the 5th day of November,1956, at the our of $:00 o'clock p.m. of said day, in the Council Chambers of the City Hall,Gilroy,California,be, and the same is hereby,fixed as the time and place of the hearing of said petition,when and where any person owning real property within such tract proposed to be annexed and having any objections tothe proposed annexation,may appear before the said Common Council and show cause in writing,if any he has, why such territory should not be so annexed,and the City Clerk of the City of Gilroy is hereby directed to cause to have published at least once a week for two successive weeks prior to the hearing,in the GILROY EVENING DISPATCH, a newspaper of general circulation published in the said City of Gilroy,and in the MORGAN HILL TIMES,a newspaper of general circulation published in the County of Santa Clara, but outside of the said City of Gilroy,a copy of the resolution.
