This re~ular monthly meetin~ of the Common Council is called to
order by His Honor Mayor George C.Milias.
Present:Councilmen Carl W.Pate,Si~ Sanchez~Charles Gal~,Everett C.
Wentworth. Absent: Councilmen Kenneth L.P'etersen, Courtland M. Rush.
The Mayor now asks if all Councilmen have received copies of the
minutes of the regular monthly meeting of January 7th, the regular
adjourned meeting of January 21st and the regular adjourned meeting
of January 22,1957.
All Councilmen answer in the affirmative.
The Mayor now asks if there are any errors or corrections to be
made in the minutes as presented.
No errors or corrections are noted.
The Mayor now declares the minutes of the regular monthly meeting
of January 7th, the regular adjourned meeting of January 21st and
the regular adjourned meeting of January 22,1957,approved.
A communication is read from Stokely-Van Camp Inc.requesting a
five year lease on a portion of the city 3ewer farm property for use
as a viner station.
~ouncilman Petersen is now present and occupies his seat at the
Council table.
Councilman Courtland M.Rush is now present and occupies his seat
at the Council table.
The Mayor reviews the Stokely-Van Camp, Inc. request for additional
time on their lease.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that the Stokely-Van Camp, Inc. lease on a portion of the city sewer
farm property for use as a viner station be extended for a period
of one year to November,1957 and the Stokely-Van Camp,Inc.people be
advised that the reason for denying their request for a five year
lease is that the city may have use for the property in the near
future.
A communication is read from the Division of T--lighways advisin.o: the
Council of the amount of gas tax funds estimated to be available for
the fiscal year 1957-1958. This communication is referred to the
Street Committee and City Engineer for study, recommendation and
report to the Council.
A communication is read from the Pacific Gas and Electric Comnanv
f6~>both gas and electricity with checks attached for the gas f~an~hise
tax and electric franchise tax attached, and statements attached to
each with reference to the cashin~ of the checks not jeopardizing
the negotiations between the company and the city with reference to
the gas and electric franchises. The gas franchise tax for the year
1956-)3,163.24;the electric franchise tax for 1956-~4,315.23,total
for both franchises-$7,47S.47.
Councilman Pate, chairman of the Finance Committee, reports that
the city's report on its contention for settlement of the franchises
with Pacific Gas and Electric Company will be ready by the end of
the week and will be presented to the company.
A communication is read from the Santa Clara County Flood Control
and Water Conservation District requesting that the City ~anager,
City Engineer,Planning Director and Building Inspector attend a meet-
ing to be held in San Jose on February 8,1957 to discuss a coordinated
program forseveral matters pertaining the issuance of bu*lding permits,
etc.along major creek channels within the county. Councilman Wentworth
states that he will attend, the City Administrator,the Burnlding Inspector
and W.J.Hanna,Jr. of the City Engineer's office also advise that they
will attend the meeting.
A communication is read from Frank G.Bonelli,Assemblyman-52nd District
with reference to AB-64,which he introduced in the Legislature, which
would ban the sale of crime horror comic books to minors under 18
years of age. A resolution adopted by the City of Bakersfield on this
subject is attached. This matter is referred to the Ordinance Committee
with a request to present a resolution at the next meetin~ of the
Council favoring such legislation.
A communication is read from Islam Temple,A.A.O.N.~I.S. requesting
permission to hold a parade in Gilroy on February 14,1957.
Motion by Councilman Sanchez,seconded by Councilman Wentworth and
carried that Islam Temple,A.A.O.N.M~'S. be granted permission to hold
a parade in Gilroy on February 14,1957,the parade to follow the
route outlined in their letter and that the Shrine officials be
advised to contact the City Marshal and advise him of the exact time
the parade will be held.

This being the time specified in a call for bids for two new
automobiles for use of the Police Department mailed to local auto-
mobile dealers the City Clerk states that there are three bids.
The Mayor now 'or'ders the opening; of the bids.
The following bids are presented and read: Madonna Motors-2
Plymouth Plaza models-6 cylinder- 4 Dr.sedans for $2435.84 cash and
two 1956-6 cylinder Ford Sedans now used by the Police Department;
Culwell Chevrolet Company-Chevrolet,model 1503-6 cylinder-4 Dr.
Sedans for $2516.12 cash and two 1956-6 cylinder Ford Sedans now
used by the Police Denartment;Byers Motor Company-2 Ford 6 cylinder
Custom 4 Dr.,Model 1957 Customline 4 door sedans for ~2237.50 cash 0
and two 1956-6 cylinder Ford Sedans npw used by the Police Department. : ·
Motion by Councilman Rush,seconded by Councilman Sanchez and
carried that the bid of Byers Motor Company for 2-Ford 6 cylinder
Custom 4 Dr.,Model 1957 Customline 4 door sedans automobiles for
~2237.50 cash and two 1956-6 cylinder Ford Sedans now used by the
Police Department,be accepted,after aDproval by the City Attorney
of the bid form,as the lowest and best bid.
Councilman Sanchez discusses the matter of new radios for the
two new nolice cars.
Motion'by Councilman Sanchez,seconeed by Councilman Petersen and
carried that the Purchasing Ag;ent contact the County Communications
Director with reference to securing competitive bids for new radios
for the cars and that the purchase of the radios and the delivery
of the new cars be coordinated.
City Marshal Harold Sturla requests that screens between the front
and back seats of the new cars be provided.
Councilman Sanchez presents a request from the Police Department
to trade the 30-30 rifle now in their possession for a police type
shot gun. It is unanimously agreed that the 30-30 carbine be traded
for a 12 ga.shot gun, this transaction to be handle by the Purchasing
Agent and the City Marshal.
Councilman Sanchez presents and reads portions of a proposed
agreement between the Gilroy High School Trustees and the City with
reference to the proposed swimming pool and its operation. Several
corrections are sug;gested by the Councilmen and it unanimously ~
agreed to have the agreement redrawn with the corrections noted
and that each Councilmen be furnished a copy of the revised agree- :~
ment for study.
Councilman Pate states that he has no report on specifications
for proposed substitute street for Forest Street from I.O.O.F.Avenue
to Leavesley Road.
Councilman Sanchez reports that members of his committee have
viewed the area in which a request has been made for water service
on Forest Street north of Swanston Lane and that no decision has
been reached but suggests that a meeting be held between the property
owners and the Water Committee to discuss the requested service.
Councilman Rush,chairman of the Fire Committee, reports that he has
nothing to report on a suggested ordinance to curb motorists and
other interefering with the fire department when answering calls and
fighting fires but that he has discussed the matter with the Fire
Chief. It is unanimously agreed that city ordinances be searched
for an ordinance covering this subject and that the League of Calif-
ornia eities be requested to furnish copies of ordinances of other
cities that pertain to this matter.
The Mayor reads a letter from Assemblyman Bruce Allen requesting
that the city be represented at a meeting of the Bay Area Rapid
Transit committ~e to discuss proposed legislation. The Mayor urges
that any Councilman who can attend to do so.
Councilman Pate, chairman of the Finance Committee, reports progress
on the negotiations with the Pacific Gas and Electric Company with 0'1"
reference'to the gas and electric franchises now under discussion
and that the city would have some figures to present by the end of
the week.

Couricilman Pate reports that the ~50,000.00 in U.S. Treasury
Certificates now owned by the City mature on February 15,1957 and
recommends that these certificates be llrolled overll, as recommended
by r1r.V.N.Lundy,city investment counsellor,for one year at 3 3/8%
interest,as the committee has determined that the money will not
be needed by the city for another year.
Motion by Councilman Pate, seconded by Councilman Hush and carried
that the ~50,000.00 par value U.S. Treasury Certificates be reinvested
for a period of one year at an interest rate of 3 3/8%,to mature
February 15,1958.
Councilman Pate discusses the investment of ;~15,000.00 in Series

Finance Committee recommends that the bonds be cashed and the~15,000.00
be d~posited in the American ~rust Company in an inactive account
at 3% interest. .
Motion by Councilman Rush,secorlded by Councilman Wentworth and
carr"ed that the~15, 000. 00 in Series "G" War Bonds owned by the
City that have now matured be cashed and the proceeds of the sale
be d~posited in the American Trust Company in an inactive account
at 3,10 interest.
Councilman Pate recommends that the Council call for bids for
wrecking the old Bank of America building located on the east side
of Monterey Street between Martin Street and Lewis Street.
Motion by Councilman Pate,seconded by Councilman Wentworth and
carried that advertisement be made calling for bids for wrecking the
old Bank of America building and that bids be opened on March 4;1957
~t the regular monthly meeting of the Council.
Councilman Pate requests permission to contact the Southern Pacif!i:c
Company to discuss the matter of using a portion of their property
in the rear of the Regal Service 3tation and Safeway Store, for park-
ing lot purposes. It is unanimously agreed that Councilman Pate be
~)iven permission. to contact the Southern Pacific Comn"any.

report to make on a proposal to increase water rates but will have
a report ready for the next Council meeting.
Building Inspector Byron Brown presents a request from Gilroy
Homes,Inc. to place a sign on the property of A.L.Gurries located
on the north side of First Street between Church and Hanna streets.
A communication is read from the City Planning Commission of the
City of Gilroy recommending the approval of the map of "Eschenburg
Park,Unit No.lll with~~ the additional easements as noted on the map.
Motion by Councilman Pate, seconded by Councilman Petersen and
carried that the map of "Eschenbun,; Park,Unit No.lll as presented
and recommended by the City Plannin~ Commission of the City of Gilroy
with the additional easements recommended by the Commission,be aDnroved.
A drawing of the sign propo~ed to be erected by Gilroy Homes,Inc.on
property of A.L.Gurries located on the north side of First Street
between Church and Hanna streets, is now presented and discussed.
Motion by Councilman Petersen, seconded by Councilman Sanchez and
carried that Gilroy Homes,Inc. be f':ranted a permit to place a sign
on the property of A.L.Gurries located on the north side of First
Street between Church and Hanna streets as se.t forth on the drawing
of the sign and location drawing presented and viewed by the Council
the sign to remain at the location designated in the drawing at the
will and pleasure of the Council.

WHEREAS, THE PRESIDENT of the United States has nroclaimed February
10,1957,as "National Guard Recruiting Day",and .
WHEREAS, National Guard Recruiting Day and George Washington's
birthday are to be celebrated during the same month throughout the
United States,and
WHEREAS, George Washington,our Nation's first president, was its
first advocate of s strong militia force, and
WHEREAS, the National Guard has long played a distinguished role
in our history as "America's First Line of Defensell,and
VJHEREAS, the City of Gilroy has derived security and other advantages
through the presence here of units of the 49th Infantry (Argonaut)
Dmvision of the California National Guard:
NOW,THEREFORE,BE IT RESOLVED,that the Mayor and Common C6uncil
commends the California National Guard,with particular emphasis on
the units in Gilroy for the outstanding job it has been doing in
training our young men and helping secure our community and way of
life, and
BE IT FURTHER RESOLVED that February 10,1957, is proclaimed as
llNational Guard Recruiting Day" in Gilroy.
BE IT FURTHER RESOLVED THAT THE Mayor and Common Council urges
all young men who have a military obligation to our country,to
investigate the advantages and opportunities to themselves and to
their community and nation,of service with their hometown unit of
the 49th Infantry (Argonaut) Division of the California National
Guard.
Motion by Councilman Pate, seconded by Councilman Petersen and
carried that the Resolution proclaimin~ February 10,1957 as National
Guard Recruiting Day be approved.
Motion by Councilman Petersem,seconded by Councilman Wentworth
and carried that Certificate No.2 of Higgins and Root,architects,

The December,1956 report of the County Controller on fines collected
for the month of December,1956;the report of the State Board of
Equalization on Sales and Use Tax collections for the month of
October,1956;the January,1957 report of arrests by the Police Depart-
ment;the January,1957 report of the Buildin~ Inspector:the January,
1957 reports of water samples taken by the County f1ealth DeDartment
showin~ all samples satisfactory and the January,1957 report of the
Poundmaster are presented and read and ordered filed.
Applications for an On Sale Beer and Wine license from John M.Costa,
d.b.a.Happy Days Cafe,227 N.Monterey Street and an On Sale General
license from VinCent Villafranca,d.b.a.Central Cocktail,50 N.Monterey
Street, are presented and read.No objection is made.
The reports of city officers are presented and read.

Motion by Councilman Pate,seconded by Councilman Rush and carried
that bills as presented be allowed and warrants ordered drawn on
the Treasurer.
Councilman Sanchez, chairman of the Water Committee, requests
permission to have the City Engineer view a proposed new route for
a water line from Uvas Dam to the city reservoir. It is unanimously
agreed to ~rant permission as requested.
Motion by Councilman Pate,seconded by Councilman Wentworth and
carried that this meeting adjourn to Monday,February lR,1957 at
