This regular adjourned meeting of the Common Council is called to order by
His Honor Mayor George C.Milias.
Present:Councilmen Carl W.Pate,Sig Sanchez,Charles Gallo,Kenneth L.Petersen,
Courtland M.Rush,Everett C.Wennworth.
Councilman Rush,chairman of the Public Health and Safety Committee, reports
that his committee recommends that arterial "STopn signs be installed at all
railroad grade crossings within the city limitsjthat his committee feels that
their first duty is/~Rdeavor to prevent the loss of life at railroad crossings;
that if the arterial "STOP" signs are installed that the railroad company should
be requested to reduce the speed of trains within the city limits.
Motion by Councimman Wentworth, seconded by Councilman Petersen and carried that
the Public Health and Safety Committee contact the Southern Pacific Company and
advise them that the City intends to place arterial "STOP" signs at all grade
crossimgs within the city limits and urge them to consider reducing the speed
limit of trains within the city limits to 25 miles per hour.
The Sewer and Ordinance Committees report that they have agreed upon certain
changes in the resolution requiring subdividers or developers of subdivisions
to pay the sum of $100.00 per lot for drainage.
The City Attorney presents and reads RESOLUTION NO.430.
The matter of a developer putting up a temporary bond for thirty days to cover
the $100.00 per lot for drainage is discussed.
Motion by Councilman Sanchez, seconded by Councilman Pate and carried that
the developer of Park ~~adoW5 Unit No.2 be permitted to put up a bond in the
amount of $5600.00 to cover the $100.00 per lot requirement for drainage for
a period of thirty days, the bond to be approved by the City Attorney.

RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY AMENDING RESOLUTION NO.
382 RELATING TO THE REQUIREMENTS OF THE CITY OF GILROY FOR THE CONSTRUCTION AND
FURNISHING OF DRAINAGE FACILITIES IN SUBDIVISIONS, PROVIDING THAT THE SUBDIVIDERS
OR OWN&~ OF SUBDIVISIONS SI~LL PAY A MINIMUM OF ONE HUNDRED DOLLARS PER LOT TO
THE CITY TO DEFRAY THE COST OF DRAINAGE FACILITIES IN THE SUBDIVISION.

HHEHEAS, the Common Council of the City of Gilroy has heretofore adopted
Resolution No.382 requiring the subdivider or owners of subdivisions of land
within the City of Gilroy to pay to the said City the sum of One Hundred ($100)
Dollars per lot to be applied upon the cost of providing proper drainage
facilities for the subdivision;and,

WHEREAS, the said Common Council now believes that said Resolution No.38a should
be amended as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED,AND IT IS HEREBY ORD~qED:
That Resolution No.382 be, and the same is hereby amended to read as follows:
Prior to the time an~ map or plat of any subdivision of land
within the City of Gilroy as it now exists or may hereafter exist,is
finally approved by the Common Council, the subdivider or owner of
the subdivision shall pay to the City of Gilroy the sum of ~100.00
lot within the subdivision, or such greater sum as the Council shall
determine to be necessary and proper,to defray the cost of proviaing
adequate drainage for the subdivision, including the cost of facilities
construc~ed or installed or enlarged without the subdivision made
necessary in order to secure the proper drainage of the subdivision,
or which are incidenta12thereto.
BE IT FURTHER RESOLVED:
That the said drainage system and/or facilities shall be constructed by the
City of Gilroy,and that the Common Council may,at its option, in lieu of
requiring payment of the said sum per lot as hereinbefore provided, prior
to the approval of said map or ~lat,approve the same upon execution of a
written agreement by the owner or subdivider of the subdivision that it
will pay the said sum upon demand and furnish a bond of a responsible and
acceptable surety company that it will pay such sum upon demand if the
subdivider or owner of the subdivision does not.

A communication is read from the City Planning Commission of the City of

Gilroy reporting and recommending on matters before the Commission at their
meeting of l1ay 17,l957.
The matter of the request of rv'"u-.Joe Leon,544 East Sixth Street, to erect a
grocery store on his property on East Sixth Street, east of the br~dge, is dis-
cussed, the Planning Commission's letter advising the Council that ~~.Leon had
been advised,by letter, the proceedure necessary to request a rezoning of his
property. No action is taken.
Councilman Gallo,chairman of the Ordinance Committee, reports that the matter
of the request of Mr.Elmer J.Serpa,6Il North Hanna Street,to rezone a portion
------ 'of his property located on the west side of Hanna Street, between First Street
"M."".,__,<md Boradway , was discussed by the Planning Commission and that they maintained
.. their previous stand on this matter that the requested rezoning not be granted.
Councilman Gallo reports that his committee has accepted the Planning Commission's
decision on this matter.

matter. No one appears to discuss the matter now before the Council.
Motion by Councilman Gallo,seconded by Councilman Pate and carried that the
request of Mr.Elmer J.Serpa to rezone a portion of his property located on the
west side of Hanna Street between First Street and Broadway be not granted and
the recommendation of the City Planning Commission of the City of Gilroy be
accepted.
Councilman Gallo discusses certain change in the License Ordinance agreed
upon by the Ordinance Committee.
The City Attorney presents and reads ORDINANCE NO.582.

The Mayor now discusses the matter o~ securing the services of a person to
cont~ct the various pwn~estpfcpneperty propo~eg by the Off Street Parking
Commission as desirable locations for parking lots. This matter is referred
to the Building and Grounds Committee to investigate and report to the Council.
Councilman Sanchez, chairman of the Water Committee, discusses the matter of
purchasing a valve and pipe to take care of the city's portion of the work at
the Uvas Dam.

Water Committee be given the authority to meet with the District Engineer of the
South Santa Clara Valley Water Conservation District to discuss the valve and
pipe necessary to make the city's connection at the Uvas Dam and report to the
Council.
Councilman Sanchez, chairman of the Police Committee,reports that the department
has requested thathttYIELD RIGHT OF WAytt signs be installed at Fourth and Church
streets and Fourth and Rosanna streets;that a used panel truck be purchased to
house the city's radar equipment;that a telephone be located in the alley between
Lewis Street the police station;that a pay increase be considered during the forth-
coming budget discussions. It is unanimously agreed to contact the Division of
Highways to ascertain if they have a used panel truck for sale.
Councilman Gallo discusses the purchasing ef a visible index file and a safe
for city ordinances stating that Deputy City Clerk Carr had completed his work
of indexing all city ordinances.
Motion by Councilman Pate,seconded by Councilman Gallo and carried that the
Purchasing Agent purchase visible index equipment for ordinances indexes and
araafe for ordinances books for $646.25 plus tax.
Councilman Petersen discusses the matter of purchasing linolelxm for the
library basement.
Motion by Councilman Petersen, seconded by Councilman Wentworth and carried that
linoleum be purchased for the library basement and laid for the sum of $335.00.
Councilman Rash discusses the possibility of the city purchasing a used spray
rignfrom the Division of Highways and the Clerk is instructed to write to the
Equipment Engineer of the Division of Highways to ascertain if such used equip-
is vailable.
Councilman Sanchez discusses the matter of pensions for city employees and the
City Attorney is instructed to obtain information on this matter and report to
the Council.
Motion by Councilman Rush,seconded by Councilman Wentworth and carried that the
sum of $150.00 be given to the Volunteer Fire Department for their fund to
replace damaged clothing.
Councilman Pate, chairman of the Street Committee,reports that in a call for bids
for street maintenance work for the period June 1,1957 to October 1,1957 only one
bid was received-four bids to local contractors having seen sent out.
The one bid received-that of George C.Renz Construction Company,Inc.-is presented
Councilman Pate stating that there was only a slight change in the amounts from
last year's contract.
Motion by Councilman Pate,seconded by Councilman Wentworth and carried that the
bid of George C.Renz Construction Company,Inc. for street and alley maintenance
work for the period June 1,1957 to October 1,1957, be accepted and the George C.
Renz Construction Company,Inc. be awarded the work for the period specified in
the call for bids.
Councilman Pate reports on the extension of Alexander Street south of 9th Street
and W?J.Hanna,Jr. of the City Engineer's office states that he will contact the -____._._
County Engineer to ascertain their requirements for the proposed street;that
escrow instructions be checked by the City Engineer's office and that the City
Engineer's office, the Street Committee and the City Attorney will see this matter
through.
The City Attorney reports that it appears that the State will accept the deed
to the property purfhased by the City as a site for an Armory.

Motion by Councilman Sanchez, seconded by Councilman Petersen that RESOLUTION

That the City of Gilroy accepts the attached conveyance and consents to

The City Clerk st~tes that l1r.Robert Drewitz, chairman of the V.F .~v.Pre-
Gymkhana Parade had requested him to ask the Council's permission to hold
their annual parade on Saturday,June 15,1957 and that the Mayor,Councilmen
and City officials are invited to ride in the parade.
Motion by Councilman Wentworth, seconded by Councilman Gallo and carried that
the Veterans of Foreign Wars be gaven permission to hold their annual Pre-
Gymkhana Parade on Monterey street on Satueday,JUne 15,1957.
A communication is read from the Gilroy Junmor Chamber of Commerce requesting
financial assistance from the City to conduct their ftMiss,Gilroy" contest.
Motion by Councilman Pate,seconded by Counci~an Wentworth and carried that
the Chamber of Commerce apportion $50.00 of their money to the GilroJT Junior
Chamber of Commerce to be used in defraying expenses of the "Miss.Gilroy"
contest and the city to reimburse the Chamber of Commerce for this amount in
the next city budget.
A communication is read from the trustees of the Gilroy Elementary School
District requesting permission to remove the trees along the west side of
Hanna Street between Second and Third Streets,in front of the Jordan School.
This matter is referred to the Stree~ Committee to advise the school board
that the City Forestry Board has control over the removal of trees along

streets and their permission must be obtained;that the Forestry Board re-
quest the school board to plant other trees in the place of those they seek
to remove.
A communication is read from the Elementary school beard advising the Council
that the matter of removing the trees on the Severance School property that
are causing damage to adjoining property has been referred to the County Counsel
for an opinion. It is unanimously agreed that the City Clerk request a copy of
the County Councel's opinion from the County Counsel.
A comml1ntcation is read from ~1r.Frank Lemos,300 ~liller Avenue,requesting per-
mission to divide his lot in half,leaving the present dwelling on the lot and
turniing it into a rental unit and constructing a dwelling for himslef on the
the remaining half of the lot. This matter is refereed to the City Planning
Commission.
