This regular adjourned meeting of the Common Council is called
to order by His Honor George c. Milias.
Present: Comncilmen Kenneth L. Petersen, Courtland M. Rush.
Everett C. Wentworth, and Sig Sanchez. Absent: Councilmen Carl
W. Pate and Charles Gallo.
A communication from the Board of SUDervisors of San Francisco
is read reque?ting a change in the City of Gilroy's sales tax
ordinance to avoid double taxation between conforming and non-
conforming counties and cities under the uniform Local Sales and
Use Tax Act, San Francisco being a non-conforming city and county.
After discussion the City Clerk is directed to inform the Board of
Supervisors of San Francisco County that the request should go to
the Board of Supervisors of Santa Clara County since any amend-
ment to the uniform ordinance must be made by the County and all
the cities within the county.
A copy of a communication is read from the Southern Pacific
Company to the Public Utilities Commission requesting a change in
the semi-automatic train signals on Lewis, Martin, and Sixth Streets
and Pacheco Pass Road to fully automatic signals. No action is
taken.
A communication from the Public Utilities Commission is read
requesting the City to list the railroad crossings in Gilroy that
should have grade separations. No action is taken.
Councilman Petersen states that Mrs. Harold Johnson and another
lady are present representing the Gilroy Nursery School and that
they request the Council's approval for moving a building belonging
to Dick Driscoll onto the Forest Street playground for nursery
school use.
Motion by Councilman Petersen, second by Councilman Wentworth
and carried that the City Clerk place this request before the
Recreation Commission for approval and ask the Commission to reply
on the request as quickly as possible, also that Byron Brown,
Building Inspector, inspect the building to see that it conforms
with the City ordinances.
The City Clerk now reads a report from the Planning Commission
Secretary, Byron Brown, making several recommendations, one being
that the proposed abandonment of a portion of certain streets in
the Sherwood Park area be held over for further study.
It also recommends that the school property and the Armory
site on Wren Avenue and Eschenburg Park be zoned as "AIf Districts
and a use permit be granted for the construction of the armory
and the School.
It also recommends that the Howson Tract, bounded by Seventh
Street on the north and Eighth Street on the south and on the east
by the alley between Dowdy and Carmel Streets and on the west by

Princevalle Street, be rezoned from liB" District to "A" District.
The communication states that a hearing before the Planning Com-
mission was set for October 28, 1957, on this rezoning.
Motion by Councilman Sanchez, second by Councilman
Petersen and carried that the City Attorney be instructed to draw
up the necessary papers and set a hearing date before the Council
on the schoOf property and the Armory site on Wren Avenue, Eschen-
burg park, and the Howson Tract.
The Planning Commission also recommends that the new
zone map be changed from the present coloring and markings to the
original solid colors because the present map is confusing and hard
to read. The City Engineer explains the purpose of the present map
markings is for economical reproduction. It is suggested by Council-
man Sanchez that the City Engineer confer with the Planning Com-
mission for a satisfactory map after which time he can report back
to the Council for approval.
It is also recommended that a rubber stamp of "APPROVED"
be obtained for the approving of subdivision maps, one copy of which
should be placed on file in the City Hall for reference purposes only.

man Petersen that the City Clerk obtain a stamp marked "APPROVED"
for the approval of subdivision maps.
A communication from W. J. Hanna Jr. to the Planning
Commission is read stating that a proposed map of "Castlewood Park,
Unit No.3" is attached and all imurovements will be bonded for and
installed in accordance with the requirements of the City of Gilroy.
This map of Castlewood Park is referred to the Planning
vommission for study. and zoning.
The matter of obtaining rights of way for a proposed
alley between First and Second Streets, and Eigleberry and Monterey
Streets is discussed by Coundilman-'Petersen. He expressed the will-
ingness of the property owners in that area to give the necessary
rights of way for said alley. This matter is referred to Byron Brown,
Building Inspector to obtain the rights of way and to complete the
alley.
The problem of the disposal of garden refuse is tabled
until a future meeting when Councilman Pate, Chairman of the Street
Committee is uresent.
The matter of the proposed City Employee's Retirement
plan is to be brought up at a future meeting as Councilman Sanchez
states that it is still under study.
The proposed moving of the City Hall offices is brought
up at this time. The City Clerk reports that a meeting between
Major Wright of the National Guard, the local National Guard officers,
and the Building and Grounds Committee can be arranged for sometime
next week. Councilman Petersen, Chairman of the Buildings and
Grounds Committee, states that he will make arrangements for a meet-
ing.
The City Clerk now reads a progress report from Mr. W.
E. Jordan, Chairman of the Off-Street Parking Committee which enumer-
ates available land for off-street parking lots. Councilman Peter-
sen instructs the City Clerk to write to Ben Levin, who represents
owners of property on South Monterey Street, regarding the use of
this property for off-street parking.
Councilman Rush reports that the property owned by the
Richfield Corporation at 265 N. Monterey Street may be used for a
parking lot, but no signs may be installed to limit park ing time.
The Mayor asks Councilman Rush to contact the property
owner, Mr. Wilkinson, for the possibility of installing an "0ff-
Street Parking" sign on the lot.
Councilman Rush instructs Byron Brown to see that the
lot adjacent to the Richfield Service Station property and owned
by Mike Filice is cleaned up.
Mr. W. E. Jordan, Chairman of the Off-Street Parking
Committee, is instructed to contact Councilman Pate so that the City
Attorney, Mr. Jordan, and Councilman Pate can negotiate a lease for
the property between Mitchell's Garage and Purity Stores on Eigle--
berry and Fourth Streets and owned by Mr. Bettancourt for a possible
parking lot.
Councilman Wentworth instructs Mr. Jordan to contact
Mr. Bettancourt and inform him that the City intends to take further
steps in preparing this lot for off-street parking.
At this time there is a discussion on the vfueeler Aud-
itorium's present appearance and upkeep. No action is taken.

Councilman Wentworth suggests that a Fire House be built on
the east side of town because of the possible obstruction of rail-
road crossings by trains during a fire in that area.
This matter is referred to Councilman Rush, Chairman of the
Fire Committee, for further study.
The Mayor now commends Mr. W. E. Jordan on his splendid
work in preparing the Off-Street Parking progress report.
RESOLUTION NO.452 is presented by the City Attorney. Motion
by Councilman Petersen, second by Councilman Wentworth that
Resolution No. 452 be adopted.

WHEREAS, the City Planning Commission of the City of Gilroy
has heretofore filed with the City Clerk its recommendation that
the present width lines of Church Street in the City of Gilroy
be extended and prolonged to the northerly City limits of the City
of Gilroy so that when and if the said street is extended northerly
it shall have the same width to its northerly end which the street
now has; and
WHEREAS, the Common Council has duly considered the recom-
mendation of the said City Planning Commission and believes any nor-
therly extendion of Church Street should be at least as wide as
the present street and that the recommendation of the said City
Planning Commission should be adopted;
Now, The ref 0 r e, BE IT RESOLVED, by the Common
Council of the City of Gilroy that the said recommendation of the
City Planning Commission of the City of Gilroy be and the same is
hereby approved, and that there is hereby established as the future
width line of the northerly extension of Church Street the present
width lines of said street.
PASSED AND ADOPTED this 21st day of October, 1957, by the
following votes:

The City Clerk is instructed to notify all of the property
owners that Resolution No. 452, establishing the future width line
for the extension of Church, has been adopted and is in effect,
and that no building can be erected on property within such width
line.
At this time there is some discussion over the legal aspects
on the control of property within such future width and the matter
is referred to the Cit~ Engineer.
The City Attorney states that he will obtain this informa-
tion for Mr. Hanna.
The matter of the petition for annexation from property
owners on Miller Avenue is discussed. The City Attorney reports
that the Gilroy Planning Commission has approved~ and now the
Santa Clara County Boundaries Commission must be notified before
any further action can be taken on the proposed annexation.
Councilman Rush reports that the City's employees banquet
was previously set for October 24th, but has been changed to
October 22nd, 1957 at 7:00 p.m.
Reports on water samples taken by the Santa Clara County
Health Department for October 10th are read. These reports are
satisfactory and are ordered filed.
At this time there is some discussion by Byron Brown wQether
or not the City would have to buy property on which a building
permit is refused because of future plan lines on said property.
There being no further business the meeting of the Common
