Minutes 1959/01/05 ~1951- Gilroy, California January 5, 1959 This re~ular monthly meetin~ of the Common Council is cal- led to order by His Honor Sig Sanchez. Present: Councilmen Carl W. Pate, Courtland M. Rush, Ken- neth L. Petersen, Everett C. Wentworth, and Wilford E. Jordan. Absent: Councilman Charles Gallo. The Mayor now asks if all Councilmen have received copies of the minutes of the regular monthly meeting of December-1st, and the regular adjourned meeting of December 15th. All Council- men answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor now declares the minutes of the regular monthly meeting of December 1st and the re~ular ad- journed meeting of December 15, 1958 approved. The Mayor now asks that the bids for installation of new doors for the west entrance to the auditorium be opened. The bids are opened and read as follows: George C. Renz Construc- tion Company - $1395.00, Gordon E. Farotte - $1344.00, and Wm. Radtke - ~1199.00. The bids are turned over to the City At- torney for inspection. The City Attorney reports that the low bid is in order. Motion by Councilman Petersen second by Council- man Jordan that the work for the installation of new doors for the west entrance to the auditorium be awarded to ':lilliam Radtke for his bid of $1199.00. At this time there is a hearing on rezonincr of Park Mea- dows, Units 1 and 2.", The Mayor asks if anyone in the audience wishes to speak for:a~ainst this matter. There are no comments. TJ1:11, owner of the property on North Monterey Street, has accented $20,000.00 for the Welburn Avenue Right of Way, with the City payin~ all title expenses. Mr. Uhl has also agreed to allow the City to take possession of the nroperty on March 1, 1959. All Councilmen agree on the March 1, 1959 compromise and to allow the two months rent from the tenant to go to Mr. Uhl. Resolution No. 49~ is presented by the City Attorney. Stubnitz-Greene requests that the City de- lay any further action until one of their representatives arrives in Gilroy in the early part of February. The Mayor suggests that the City hold any further action to be taken, until no later than February 15, 1959. All Councilmen agree and instruct the City Clerk to reply to the letter from Stub- nitz-Greene. A letter is read from the Attorney-General's Office re- plying to Councilman Jordan's request for a legal opinion con- cerning city employees representing others who may have con- flicting interests. Councilman Jordan suggests that the City of Gilroy go on record that their emnloyees could not repre- sent conflicting interests. Discussion is had on the matter. It was ~enerally a~reed that when conflicting interests arise employees should withdraw from other interests. Right of Way AO"ent KYudt states that he has just received - a telephone call from Edward Uhl concerning the Welburn Avenue right-of-way stating that he has a~reedto allow the City to take possession of the property on February 1, 1959 instead of March 1, 1959 previbusly agreed upon. A letter is read from William Davis, Mercury Reporter, requesting notification of all meetin~s of 1e~islative bodies. This letter is ord~red to be placed on file. . A letter is rea'd from the Feather River Project Associa- tion asking participation by the city in the F.R.P.A. program. The Mayor recommends that this letter be referred to the Water Committee for study and recommendation. Chief Administrator Carr reports on the progress of the Employee Retirement Plan stating that twenty-nine employees are eligible for the plan at this time and twenty-five employees have signed up for the plan. The City Clerk requests that the Council meet as a committee of the whole next Monday night January 12th at 7:30 P.M. to hear a report from the two insur- ance companies to be considered. All Councilmen present a~ree on this meeting date. Letters are read from the Police and Fire Denartments re- commending that Gus Steele be appointed as regula~ police officer and re~ular fireman-engineer as he has completed his six months probationary period. Motion by Councilman Rush second by Councilman Wentworth and carried that Gus Steele be appointed as regular police officer as of January 1, 1959. Motion by Councilman Pate second by Councilman Petersen and carried that Gus Steele be appointed re~ular fireman-engineer as of January 1, 1959. Chief Administrative Officer Carr requests a transfer of $2094.00 from the Gas Tax Fund to the 3uecial In Lieu Fund. Motion by Councilman Pate second by Councilman Petersen that :~2094.00 be transfered from the Gas Tax to'the Special In Lieu Fund. Reports of the Building Inspector, Police Department, and Poundmaster are presented and read. Motion by Councilman Pate second by Councilman Jordan that the reports of the Building Inspector, Police Department, and Poundmaster be accepted as read. Reports of the City Officers are presented and read. Motion by Councilman Jordan second by Councilman Wentworth that the reports. of the City Officers be accented as read. Motion by Councilman Pate second by Councilman Petersen and carried that bills as presented be allowed and warrants drawn on the Treasurer. Motion by Councilman Pate second by Councilman Rush that the Purchasing Agent be allowed to attend the purchasing agent's convention in Berkeley on January 28th, 29th, 30th, and 31st, as recommended by the Finance Committee. Motion by Councilman Pate second by Councilman Jordan that the City Engineer and Director of Public Works be allowed to attend the Streets and Highways Convention durin~ January 59th, 30th, and 31st for two days. Councilman Petersen instructs the City Clerk to write a [ -..., ....... ~..1956. letter of acknowledgement to the Junior Chamber of Commerce for decorating the tree on I.O.O.F. Avenue. Mayor Sanchez states that he received a letter from Judge Thomas thanking the City for the plaque and document of his faithful service as Jud~e in the City of Gilroy. Purdhasing Ar:rent Reinsch requests approval to purchase twenty water meters for $~02.34, Motion by Councilman Jordan second by Councilman Petersen and carried that the purchasin~ a~ent be allowed to purchase twenty water meters for ~~02.34. The Mayor announces a Lea~ue of California Cities dinner meetin~ in Los Gatos at the Lyndon Hotel an January 22nd at 7:30 P.M.
