Minutes 1959/02/16 I 1960 Gilroy, California February 16, 1959 This regular adjourned meeting of the Common Council is called to order by His Honor Sig Sanchez. Present: Councilmen Carl W. Pate, Courtland M. Rush, Everett C. Wentworth, Charles Gallo, and Wilford E. Jordan. Absent: Councilman Kenneth L. Petersen. At this time there is a hearing on the abandonment of a portion of Welburn Avenue adjacent to Wayland Lane. The City Attorney presents and reads Ordinance No. 597. Councilman Petersen takes his seat at the Council table during the reading of this ordinance. The Mayor asks if anyone in the audience wishes to speak for or against the matter. There is no comment. Motion by Councilman Rush second by Councilman Pate that Ord- inance No. 597 be adopted. \ , 1961 ORDINANCE NO. 597 AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING A PORTION OF lNELBURN AVENUE ADOPTED AND PASSED this 16th day of February, 1959, by the following votes: AYES: COUNCILMEN: Pate,Hush,Petersen,T:lentworth,Gallo, Jordan. NOES: COUNCILMEN: None ABSENT:COUNCIU~EN: None \~-,1. A letter from Elliott P.T.A. is read requesting the City to open the Forest Street playground after school and on Sat- urdays. The Mayor asks the women who are present and who are representatives of the Elliott P.T.A., if they would like to speak on the matter. One of the ladies states that the Elliott P:T.A. is very much in favor of opening the playground in question. Councilman Petersen suggests that this matter be taken un with the Recreation Commission. At this time there is discussion on the matter. The Mayor suggests that this matter be brought to the attention of the Recreation Commission ask- ing them for notification of their next meeting. A represent- ative from the Elliott P.T.A. states that the Recreation Com- mission is having their next meeting tomorrow at Chris' Fine Foods at noon. The City Clerk is instructed to call the Rec- reation Commission notifying them that representatives from Elliott P.T.A. and members of the City Recreation Committee will be present at their meeting on February 17th. A recommendation from the City Marshal is read to allow Herbert Lillard, George Rosario, and Andy Nebesnick to obtain a card room license for Club OK and to allow Floyd and Opal Clanton to obtain a card room license for Club 14-0. Motion by Councilman Gallo second by Councilman Wentworth and carried that card room licenses be granted to Herbert Lillard, George Rosario, and Andy Nebesnick for Club OK and Floyd and Opal Clanton for Club 14-0. A letter from C. R. Acker of the Gilroy Garbage Disposal Company is read, requesting to negotiate a new franchise with the City of Gilroy. This matter is referred to Councilman Wentworth Chairman of the Sewer Committee. A letter is read from the Planning Commission accompanied by a resolution recommending the granting of a use permit to Frank Reinosa for an auto repair shop, and stating that they have denied a request for a variance from Mr. L. Saccullo to build a residence on the rear of his lot. Resolution No.497 is presented by the City Attorney. Councilman Petersen recommends that we pToceed with plans that would incorporate a garage and shop facilities. Director of Public Works Kludt is instructed to proceed with the plans and report to the Council on the final plans. Purchasing Agent Reinsch requests the purchase of a hose washer to be installed at the Fire House in lieu of the hose wash rack at the City Yard. Motion by Councilman Rush second by Councilman Wentworth and carried that a hose washer be pur- chased for the Fire Department. Chiesa regarding possible mov- ing of curbs, gutters and sidewalks on Welburn Avenue at Wayland Lane. Discussion is had on the matter. Motion by Councilman Pate second by Councilman Petersen and carried that the agree- ment between the City of Gilroy and M. Chiesa be approved subject to certain corrections as advised by the City Council. Ordinance No. 598 is presented by the City Clerk. This ord- inance controlling the collection of garden refuse was .read at the regular meeting of February 2nd. Motion by Councilman Pate second by Councilman Jordan that Ordinance No. 598 be adopted. -- ORDINANCE NO. 598 AN ORDINANCE DEFINING AND PROVIDING FOR THE SYSTEMATIC COLLECTION OF GARDEN REFUSE: DEFINING AND PROHIBITING THE PLACING OF OTHER REFUSE ON THE STREETS OR AREAS BETWEEN THE STREETS AND SIDE~~LKS AND PROHIBITING THE PLACING OF ANY REFUSE, GARBAGE OR RUBBISH RECEPTACLES OR OTHER MATERIALS IN ALLEYS. Director of Public Works Kludt reports on the overflow from the City Reservoir. He reports that the property owners con- cerned are prepared to put in the necessary pipe line through the lands developed by them adjacent to the Llagas Creek to take care of the excess waters from the reservoir. The City Clerk reads a report from the Chamber of Commerce Secretary, Kenneth Murdoch, who conducted a survey concerning parking meters in the City. The City Clerk reports that two questions were asked and the votes were tabulated as follows: Do you favor parking meters on Monterey Street? 39 yes, 4 abstained, and 46 no. Should parking meters be installed on parking lots? 57 yes, 31 no, and 1 abstained. There is discus$ion on the mat- ter but no action is taken. The City Clerk reads a letter from Don Reindohl, consulting engineer, regarding financeing of the Los Altos Parking Plaza. This information was obtained at the request of the Mayor. A letter is read from the Chamber of Commerce inviting the City Council on a bus trip to Los Altos and South Palo Alto to investigate their parking facilities. The Mayor thanks Mr. Kenneth Murdoch for conducting the parking meter survey and instructs the City Clerk to write a letter of thanks to the Chamber of Commerce. Chief Administrative Officer Carr reads a report on the proposed City Retirement Plan, states that further progress can not be made until a company is selected and requests permission to recommend the company, wqrk out the details of the plan, and present it to the Council. vouncilman Pate suggests that an in- surance company be selected and that the Council await the rec- ommendation of the Chief Administrative Officer. A letter from the California National Guard is read in reply to the City's letter expressing concern over the newspaper article proposing moving of our National Guard Unit to Hollister. The letter states that the newspaper article was in error. The City Attorney submits an agreement with the subdivider for installation of utilities and improvements in Park Meadows, Unit No.2. He suggests that the Planning Commission hire someone to~contact prospective property owners regardin~ annexation. Councilman Pate sug- gests that a joint meeting be arranged 0ith the Planning Com- mission and the Council on this matter. Max Kludt is inst- ructed to arrange the meeting. . Councilman Rush instructs the City Clerk to find out if there is an ordinance controlling the closing hours of card rooms. Gouncilman Pate reports that Graydon Carr, Max Kludt and himself attended the recent Inter-City Council meeting and states that there will be a meeting soon on the redistrict-. ing of Supervisorial Districts. The City Clerk reports that the National FiberGlass Company has made plans to erect a building on a lot on Ninth Street and at present there are no sewer facilities on Ninth Street. Max Kludt explains the problem further. Firman Voorhies states that these people would like to proceed as soon as possible and would like to know if sewage facilities will be available. The Mayor states that sewage facilities will be available at a reasonable cost. Councilman Pate reports on the meeting with Mr. Stub- nitz from Stubnitz-Greene Corporation. He states that it is the intent of the Council to allow Stubnitz-Greene to keep the deed to the Gymkhana Grounds property until Mayor June when they will be able to give a definite answer on whether or not they will build a plant in Gilroy with the understand- ing that the City may recall the deed at anytime. Council- man Pate recommends that a letter be written to Stubnitz- Greene Corporation stating that the Council is in accord with their thinking. The City Attorney states that he will pre- pare the letter. Purchasing Agent Reinsch reports that he has prepared specifications for new police cars and that he is ready to advertise for bids. Motion by Councilman Rush second by Councilman Wentworth and carried that the specifications for police vehicles be approved and that the Purchasing Agent be allowed to advertise for bids. Motion by Councilman Pate second by Councilman Gallo and carried that this meeting be adjourned to Monday, March 2, 1959 at 8 o'clock p.m., in the Council Chambers, Wheeler Auditorium, Gilroy, California.
