Minutes 1959/04/06 1968 L. Gilroy, California April 6, 1959 This regular monthly meeting of the Common Council is cal- led to order by His Honor Sig Sanchez. Present: Councilmen Carl W. Pate, Courtland M. Rush, and Everett C. Wentworth. Absent: Councilmen Ienneth L. Petersen and Wilford E. Jor- dan. The Mayor now asks if all Councilmen have received conies of the minutes of the regular monthly meetin~ of March 2nd"and the regular adjourned meeting of March lAth. All Councilmen answer in the affirmative. T':1e Mayor now asks if there are any errors or omissions in the minutes as nresented. No errors or omissions are noted. The Mayor now declares the minutes of the regular monthly meeting of March 2nd and the regular adjourned meeting of March 16, 1959 approved. At this time there is a hearing on the rezoning of proper- ty on Forest Street belonging to Filice and Perrelli Canning Company. The Mayor asks Peter Filice, representative from Filice and Perrell~ Canning Company, to explain the use of the proposed building in back of Miller Slough. The Mayor asks if any of the property owners in Walnut Lane across the street from the Filice and Perrelli Canning Company wish to express their opinion on the proposed rezoning. Robert K. Tremblay, Donald Martin, and Charles F. Parker give their opinions on the matter. Joe Per- relli discusses further the nlans of Filice and Perrelli Can- ning Company. Motion by Councilman Pate second by Councilman Rush and carried that the City Attorney be instructed to read Ordinance No. 599 and that a motion be made rejectin~ or grant- ing the ordinance. The City Attorney presents and reads Ordinance No. 599. Mrs. Richard Platt states that the property owners of Walnut Lane would like more assurance than just verbal, that Filice and Perrelli will stucco the proposed building, erect a fence, and plant trees in front of the building. Mrs. Platt states that they would like this done by a restriction in the ordinance ap- plying to Filice and Perrelli Cannin~ Company. The City Attorney reports that this cannot be done unless the restriction applies to all zoning of this type. Motion by Councilman Pate second by Councilman Rush ~nd carried that Ordinance No. 599 be adopted." Purchasing Agent Reinsch recommends that the next to the lowest bid of Holloway Garage for equipment maintenance be accepted. He explains that the Gilroy Gara~e and Machine has the lowest bid but that Holloway Garage is able to give twenty- four hour service. Discussion is had on the matter. The Mayor states that the low bid should be awarded to the Gilroy Garage and Machine Shop since the specifications did not call for twenty-four hour service. Motion by Councilman Wentworth second by Councilman Gallo that Gilroy Garage and Machine Shop be awarded the bid for equipment maintenance for a six months period. The motion was passed by majority vote. Councilmen Pate and Rush votinG a~ainst the motion. Purchasinrr, A~ent Reinsch is instructed to award the bid to Gilroy GaraGe and Machine Shop. ' The Mayor asks for a report on the survey of mileage all- O\Nance for use of private automobiles for city business. Pur- chasing Agent Reinsch reports that the average amount allowed for milea~e for use of private automobiles i~ ~.Og5. Motion by Councilman Pate second by Councilman Rush and carried that ~.08 per mile be allowed for individuals using their private automobiles on City business and that such use shall have the approval of the Chief Administrative Officer. The Council accepts the Charter Committees invitation and will meet with them at their pleasure. A letter is read from the District School Superintendent regatding street improvements adjacent to Glenview School. The City Engineer states that this project will cost.approxi- mately )5,400.00. Motion by Councilman Pate second by Council- man ~entworth and carried that the Chief Administr~tive Officer and Director of Public Works be authorized to proceed with the street improvements if they have an agreement between the City 19'70 and the School District stating that the school will pay for the project over a two year budget period. Chief Administrative Officer Carr reports that there is a notice of a l1earin,O: before the Public Utilities Commission on proposed increase in rates for gas service on April 13th at 10:00 a.m. in San Francisco. No action is take~ on the matter. Director of Public Works Kludt reports that the improve- ments in Eschenburg Park No. 2 are complete. Resolution No. 502 is presented and read by the City Attorney. RESOLUTION NO. 503 A RESOLUTION OF THE CITY OF GILROY AMENDING ORDINANCE NO. 422 BY FIXING A PUBLIC HEARING FOR HE 30NING FROM ZONE "8" DISTRICT TO ZONE "CTI DISTRICT. PASSED and ADOPTED this 6th day of April, 1959. AYES: Councilmen Pate, Rush, Wentworth, and Gallo NOES: Councilmen None ABSENT: Councilmen Petersen and Jordan Chief Administrative Officer reports that the County Traffic Engineer has requested to sign the portion of Leaveslev Road through Gilroy as a County Route. Hotion by Councilman Rush second by Councimman Pate and carried that the County be allowed to sign a portion of Leavesley Road as a County Route. Chief Administrative Officer Carr explains a request for a nroposed agreement between the City and State Board of Equaliza- tion for accelerated payment of local sales tax. T~e City Attor- ney is instructed to study the agreement and report back at the next Council meeting. Reports of the Building Inspector, Police Department, Pound- master, and receipts of City Officers a~e presented and read. Motion by Councilmari Rush second by Councilman Wentworth and carried that these renorts be accented as read. Water samples taken by the 3a~ta Clara County Health Depart- ment on March 19t~ are read. Two samples are satisfactory and one sample sho1:13 slight contamination, the reason being that the samDle was taken before the reservoir was cleaned. The Mayor asks Max Kludt about the progress of the subdivi- sion ordinance. He reports that the ordinance was ready for sub- mission at a joint meeting with the Council and PlanninG' Commis- sion. The meeting is scheduled for April 13th at 8:00 p.m. Councilman Rush renorts that the Fire Denartment will be having meetings once ~very three months and would like the Fire Committee to meet with them. Councilman Pate reports that Filice and Perrelli Canning Company recently entertained a Chinese delagation from Formosa and took them on a tour of their nlant. He su~ge3ts that the Chief Administrative Officer write a letter co~~ratulatin~ Filice and Perrelli for entertaining these people and recognizing that their cannery was the only one visited in California. C~ief Administrative Officer Carr is instructed to write the letter. j\Tax Kludt reports that'" the program for spraying of elm trees has been comoleted. The City Attorney reports that a better description of OHsley Park will have to be obtained be~ore annexation proceedures can begin. 1e states that the description of that property which he now has would probably not be accepted by the Boundaries Commis- sion.
