This regular adjourned meeting of the Common Council is
called to order by His Bonor Sig Sanchez.
Present: Councilmen Carl W. Pate, Courtland M. Rush,
Everett C. Wentworth, and Wilford E. Jordan.
Absent: Councilmen Kenneth L. Petersen and Charles Gallo.
The Mayor now states that there is a hearing on the.re-
zoning of property on North Railroad Street. He asks if anyone
in the audience wishes to speak for or against the rezoning.
There is no comment.
TI1e City Attorney presents and reads Ordinance No. 600.
Motion by Councilman Rush second by Councilman Pate that Ordinance
No. 600 be adopted.

A letter is read from Elmer Younr-r, requesting a permit at
895 North Monterey Street to erect a billboard for advertising
Durposes on property belonging to North Side Market.
Councilman Petersen takes his seat at the Council table.
Discussion is had on Elmer Young's request. Motion by
Councilman Wentworth second by Councilman Petersen that Elmer
Young's request to erect a bill board for advertising purposes
on property belonging to 'N orth Side Market be granted. The Motion
was defeated by majority vote, Councilmen Pate, Rush, and Jordan
voting a~ainst the motion.
A letter is read from Gilroy PlJblic Schools requesting the
use of ~lheeler Auditorium free of charge for graduation exercises
on June 10th and 11th. Motion by Councilman Petersen second by
Councilman Rush and carried that the Gilroy Public Schools be
granted their request to use 'rvTheeler Auditorium free of charse
on June 10th and 11th.
A letter is read from the Auxiliary Police requesting the
use of T,.'Jheeler Audi tori urn free of charge on May 9th for their ann-
ual dance. Motion by Councilman Rush second by Councilman Pate
and carried that the request from the Auxiliary Police for the
use of ~~eeler Auditorium on May 9th be granted free of charge.
The Mayor asks the City Attorney~for a Resolution from the
Planning Commission recommending that'Ordinance No. 422 be amended
to increase the size of building lots from 5,000 to 7,000 sq. ft.
The City Attorney reports that this matter must be referred to the
Planning Commission because there are no records avaiffiable when
this matter was first initiated.
The City Attorney presents awl reads Hesolution No. 504.

Elmer Ydung asks the Council 1.rvhy his request to erect a bill-
board fo~ advertising purposes was denied. The Mayor explains
that the request was denied because a previous request from Foster
and Kleiser had been denied.

Robert A. r1iller, Supt. of the Southern Pacific Railroad Com-
pany, appears before the Council and requests that they be released
from the ~entlemen's agreement between the City of Gilroy and the
Southern Pacific to reduce the sneed limit of trains throu~h Gil-
roy to 25 miles per hour and thab they be allowed to incre~se'the
speed to 35 miles ner hour as provided for in the City ordinance.
Discussion is had ~n the matte~. Councilman Wentworth su~O"ests
that this matter be referred to the Public Health and Saf~~y Com-
mittee. The Committee meetin~ is arranged for Anril 29th at 10:00
a.m. Mr. Miller states that he will be-nresent ~t the meetin~

r,1r. James 'iJorkman, representative of Pacific Mutual Company, ......
explains the chan~e in benefits of the proposed City Retirement
Plan. Administrative Assistant Reinsch requests the Council to
set a policy for employees who have a past part time service with
the City and those employees who have a break in their employment.
Chief Administrative Officer Carr and Administrative Assistant
Reinsch are instructed to present a list of the employees in ques-
tion who have past service on a weekly basis and those who have
a break in service with the City of Gilroy. Mr. Workman requests
that the application for group retirement policy.be si~ned by
the proper authority and that a binder check of ~1,000.00 accom-
pany the application. qe also states that a copy of the Ordinance
be sent to Pacific r1futual after its adoption. Motion by Council-
man Pate seconJ by Councilmanj'J'entworth and carried that the T1avor
be authorized to sign the application for the ~roup retirement"
policy and that a check for 1l,000.00 accompany the application
with the understanding that the application is not bindin~ until
the contract is approved and accepted by the Council.
Chief Administrative Officer Carr reports that the City was
unable to negotiate with the Gilroy Public Schools for street im-
provements adjacent to Glenview School.
The City Attorney states that he approves the proposed agree-
ment between the C~ty and State Board of Equalization for accele-
rated payment of sales tax. r~otion by Councilman Rush second by

RESOLUTION PROVIDING FOnTHE ACCELLERATED TRANSMITTAL OF SALES
AND USE TAX COLLECTIONS TO THE CITY OF GILROY.

Chief Administrative Officer Carr requests confirmation by
the Council for his aDnoi~tment of Dale Connell to take charge of

the annexation program. Motion by ~ouncilman Pate second by
Councilman Petersen and carried that Dale Conn~ll be appointed
~o take charge of t~e annexation program and that he bd paid
~3.00 per hour and $;O~ per mile for auto allowance.
A letter is read from the Charter Committee suo;gestincr dates
for a joint meeting with the Council to review the propos~d new
charter. It is decided that the joint meeting will be on May 14th.
A letter is read from Stubnit~-Greene Corp. re~ardin~ their
intentions in Gilroy. Mr. 3tubnitzwill be in Gilroy on Anril
24th to discuss further the plans of his company.
A letter is read from De Leuw Cather and Company amplifying
their recommendations for a South County Freeway. The Mayor sug-
gests that the City Council have a meeting with Morgan Hill con-
~ernin~ the proposed freeway.
A letter is read from the State Compensation Insurance Fund
congratulating the City on its safety record. The letter vIas

accompanidd by a check for pl17.05.
Councilman Rush reports that the fire department horn is
not sufficient and he vlould like additional horns installed at
the pump houses in the City of Gilroy. Chief Administrative
Officef Carr is .instructed to investigate the cost of a tele-
phone fire alarm system.
Councilman Pate renorts th8.t at the time of the salary in-

Carr were overlooked. Motion by Councilman Pate second by
Councilman Petersen and carried that Harold Sturla and Graydon
Carr be given consideration for a salary increase and that
the increase be retroactive to March 1, 1959. This matter is
referred to the Finance Committee.
Councilman Pate also asks if the Auxiliary Police are
covered in the insurance plan for employees. Mr. Reinsch re-
ports that they are covered under the Disaster Control Plan up
to )2,500.00. Motion by Councilman Pate second by Councilman
Jordan and carried that Chief Administrative Officer Carr be
instructed to notify each Auxiliary Officer that he is required
to si~n a loyalty Oath as required by the Disaster Control
Office.
Councilman Pate reports that there should be a stop si~n
on Carmel and Fourth Streets as there has been too many acci-
jents on those streets in the past. Hax Kludt is instructed to
contact the police department on this matter and report back
at the next meetin~.
Chief Administrative Officer Carr reports that he w~~IN
IIX~XX~X~~*MN~XXaXsIN~~aIX has contacted our Assemblyman and
Senator on le~islation effectin~ cities.
Director of Public ]orks Kludt reports that he would like
to conduct a sidewalk survey. Request is granted.
Max Kludt also reports that the Welburn Avenue Bridge is
ready for bid and that he would like permission to advertise
bids on May 4th. He also reports that the plans and specifica-
tions have been approved by City Engineer, W. J. Hanna Jr.
Motion by Councilman Pate second by Councilman Jordan that the
plans and specifications for the ~elburn Avenue Bridge be ap-
proved upon recommendation of the City En~ineer and Director of
Public Works and that the request for bids be advertised.
Max Kludt reports that the water line on Princevalle Street
for servicing Park Meadows is going to need a ten inch main
instead of the six inch main and the approximate cost to the City
will be about ~l,JOO.OO. Motion by Councilman. Jordan second by
Councilman Wentworth that the City negotiate with the Park ~1ea~
dow develoners to install, a ten inch main for aDDroximately

. Purchasing Agent Reinsch requests permission to advertise
for bids for paintin~ of Wheeler Auditorium, the Library, and
the electroliers on Monterey Street. Motion by Councilman
~entworth second by Councilman Petersen and carried that Pur-
chasing A~ent Reinsch be allowed to advertise for bids for the
painting of jmeeler Auditorium, the Library, and the electroliers
on ~onterev Street.
Resolution No. 506 is nresented and read bv the Citv Att-

Th'e City Attorney presents and reads an agreement' between
the City of Gilroy and the Grange which accompanies Resolution
No. 506. Motion by Councilman Jordan second by Councilman Peter-
sen and carried that the agreement accompanying Resolution No.
506 be approved and the Mayor be authorized to sign it.
The Mayor reports that the Filiceo{, Perrelli Cannery vJant
to construct their new warehouse to a five foot set-back instead
of the 100 foot set-back as originally planned. ITe states that
Filice ~ Perrelli Cannery will contact the Walnut Lane property
owners for approval before changing their original plans. The
Mayor also reports that the Cannery intends to plaster the nGrth
side of the b~ildin~ as well as the east side.
The Tlayor states that a committee of the whole and the
Planning Commission will have a study session on the subdivision
ordinance on April 27th.

The r'layor also states that there will be a Re,a;ional 'Hater
Pollution Boarj meeting; at Santa T.Iari~ rezardin~ discharge of can-
nery and Gentry industrial waste in M~ller Slough on April 22nd.
Motion by Councilman Pate second by Councilman Rush and car-
ried that this meetin~ be adjourned to Monday, May 4, 1959 at
8 o'clock p.m., in the Councilmens Chambers, ~vneeler Auditorium,
Gilroy, California.
