Minutes 1959/08/24 1 19~)f) -, Gilroy, California August 24, 1959 This adjourned meeting of the Common Council is called to order by His Honor Siv Sanchez. Present: Councilmen Carl W. Pate, Courtland M. Rush, Everett C. Wentworth, Charles Gallo, and Wilford E. Jordan. Absent: Councilman Kenneth L. Petersen. This being the date specified in the law for canvassing of the ballots cast at the special municipal charter election of August 18, 1959, the Mayor now appoints Councilman Courtland M. Rush as Inspector and Councilmen Everett C. Wentworth and Carl W. Pate as Clerks of the canvassing board and orders that the canvassing of the special municipal charter election returns proceed. The City Attorney now announces that he has completed the totalling of the votes cast in the special municipal charter election of August 18, 1959, and presents and reads Resolution No. 522. ' Motion by Councilman Wentworth second by Councilman Pate that Resolution No. 522 be adopted. RESOLUTION NO. 522 RESOLUTION OF TI{E COr~ON COUNCIL OF THE CITY OF GILROY CANVASS- ING THE RESULTS On. RETUR:'JS OF SPECIAL MUNICIPAL ELECTION :{ELD AUGUST 18, 1959, UPON THE QUESTION WHETHER THE CITY OF GILROY l ~ .......... r , r lJ 1997 SHOULD ADOPT A PROPOSED FREE HOLDERS CHARTER. WHEREAS, on August lR, 1959, a Special Election was held in the City of Gilroy to determine whether a proposed charter should be adopted by the said City of Gilroy for the said city; and, WHEREAS, the law requires that a canvass be made of the returns of said special election by the Common Council of said City and that the results of said election be entered in the minutes of the Common Council and that a resolution be adopted by the said Common Council declaring the results of the can- vass; and, WHEREAS, the said Common Council has duly canvassed the returns of said election in accordance with law at this, an adjourned meeting of the said Common Council, including the absentee votes, and found and ascertained that the total num- ber of votes excluding absentee votes cast at said election was 737; that the number of votes cast at Precinct "A" was 222; that the number of votes cast at Precinct "B" was 237; that the number of votes cast at Precinct "C" was 155; and that the number of votes cast at Precinct "D" was 123; and, WHEREAS, the following measure was voted upon at said special election: "Shall the proposed City Charter of the City of Gilroy which was filed in the office of the City Clerk of the City of Gilroy on the 15th day of June, 1959, be ratified and adopted?" That the City of Gilroy was divided into four (4) elec- tion precincts and that the number of votes cast in each precinct for and against said measure was as follows: YES NO TOTAL 195 27 222 212 25 237 138 17 155 104 19 . 123 649 -ss- 737 That all absentee voters' ballots have been duly receiv- ed and canvassed in the time and manner required by law, and the results of same is as follows: Number of Absentee Ballots 2 Number of Votes 'Yes' 2 Number of Votes 'No' 0 Total number of votes 2 That more than a majority of all the votes cast at said special election were in favor of said measure and that said measure has been adopted by the said City of Gilroy. Payne Deputy City Clerk Motion by Councilman Pate second by Councilman Wentworth and carried that the election board be paid $15.00 per person for their services rendered at the special municipal charter election. A letter is read from Ralph I. Gustavson requesting a card room license for a business to be located at 19 South Monterey Street. The Mayor asks Marshal Sturla if he is completed inves- tigating the matter. Marshal Sturla reports th~t he is still checking out Mr. Gustavson and will report back to the Council when he has completed his investigation. A letter is read from the Gilroy Golf and County Club re- 19B8 questing the City to prohibit the hauling of loam from the Golf Club property at Burchell Road and Hecker Pass Highway as the removal of loam is causing erosion resulting in destruction of some of the oak trees. Motion by Councilman Pate second by Councilman Wentworth and carried that the Chief Administrative Officer be instructed to notify Mr. D. L. Taylor that the City is cancelling their arrangements with him for hauling loam at Burchell Road and Hecker Pass Highway. Director of Public Works Kludt reports that he has instruct- ed the Street Department to clear out the under brush at the reser- voir. All Councilmen have no objection. Councilman Rush reports that the road to the reservoir at the golf course fairway is in need of repair and should be moved closer to the reservoir without disturbing the ditch, rather than being repaired. Max Kludt reports that he will investigate this matter. The Mayor instructs the City Attorney to prepare a resolu- tion thanking the board of free holders for preparation of the new charter. Polite Sgt~, Ed Piedmont, reports that Miller Slough at North Monterey Highway should be cleaned. The Mayor instructs Max Kludt to check out this matter. The City Attorney presents and reads Resolution No. 523. Motion by Councilman Pate second by Councilman JQrdan that Re- solution No. 523 be adopted. RESOLUTION NO. 523 RESOLUTION DECLARING THE INTENTION OF THE COMMON COUNCIL OF THE CITY OF GILROY TO INITIATE ON ITS OWN MOTION PROCEEDINGS TO ANNEX CERTAIN UNINHABITED TERRITORY.
