Present: Courtland M. Rush, Everett Wentworth, Kenneth L. Petersen, Charles Gallo and Wilford E. Jordan. Absent: Councilman Carl W. Pate. The Mayor states the reason for holding this meeting is because the annexed territories since 1954 have been paying a tax assessment to the Gilroy Rural Fire District and the Council must take official action to remove this taxation from these districts. Discussion is held on this subject. City Clerk Carr is asked to read a copy of the letter dated September 15, 1950, from the County Council, Spencer M. Williams, by Selby Brown,Jr., Deputy County Council, addressed to Mr. Hans Harder, Sr. Map Draftsman, Office of County Assessor, County of Santa Clara, San Jose, California, which explained that resolutions must be adopted, as governed in the Health and Safety Code, section 14540 and enact- ed in 1937 and amended in 1957, prior to September l~, 1959 re- questing exemption from the Rural Fire District taxations other- wise the City would need to obtain petitions initiated by free- holders in the district or by a majority of voters at a City elec- tion as outlined in Section 14560 of the Health and Safety Code amended by the 1959 Regular Session of the State Legislature. There is a general discussion by the Council on the letter. Resolution No. 524 is presented and read by City Attorney Johnson. Motion by Councilman Rush second by Councilman Peterson that Resolution No. 524 be adopted. The Council discusses the newly adopted resolutions. Mayor Sanchez now instructs the City Clerk to contact the County Assessor and investigate the possibility of a refund of the taxes paid to the Gilroy Rural Fire District by the property owners in the annexed territories.
