Thia regular monthly meeting of the Common Council i~ called
to order by Hi~ Honor Sig ~anchez.
Present: Councilmen CarlW. Pate, Courtland M. Ru~h, Kenneth
L. Peter~en and Wilford E~ Jordan.
Ab~ent: Councilmen Everett C. Wentworth and Charle~ Gallo.
The Mayor now a~k~ if all Councilmen have received copie~ of
the minute~ of the regular monthly meeting of September 8th, the
apecial meeting of September 17th, and the regular adjourned meet-
ing of ~eptember 21st. All Councilmen an~wer in the affirmative.
The Mayor now a~k~ if there are any error~ or omi~~ion~ in the
minute~ a~ pre~ented. No error~ or omi~~ion~ are noted. The May-
or now declare~ the minute~ of the regular monthly meeting of
September 8th, the 'pecial meeting of September 17th and the re-
gular adjourned meeting of ~eptember 21, 1959 approved.
It is recommended by the Planning Commi~~ion that the prop-
o~ed annexation at Whitehur~t Avenue be held in abeyance until
drainage and ~ewer problem~ could be qolved.The Planning Com-
mi~~ion further recommended that a larger area be taken in and an
a~~e~~ment diqtrict be formed to finance ~torm drainage and ~ani-
tary ~ewer~. No further action i~ taken by the Council.
Recommendation for rezoning of property on Princevalle Street
adjacent to ByerS' Profes~ional Building i~ accompanied by a re-
~olution of the Planning Commi~~ion.
Mr. Walter Hanna Jr., City Engineer, now arrive~ and take~
hi~ ~eat.
Motion by Councilman Jordan, ~econd by Councilman Pate and
carried that October 26th be ~et a~ the date of Public Hearing for
the rezoning of property adjacent to the Byer~' Profe~~ional
Building.
The Planning Commi~~ion ha~ ~tarted procedure and ~et a Pub-
lic Hearing date of November 16th for the rezoning of the area
ea~t of the Southern Pacific Right of Way from "E" to "D" Dis-
trict. The Council voiced no proteSt to thi~ action.
The Planning Commi~~ion report~ that a reque~t from John A.
Hauff for a u~e permit to operate a whole~ale nur~ery at 141
South Hanna is held over until an evidence is pre~ented to the
Council by Mr. Hauff that there i~ no objection from re~ident~
in the area.
The City Attorney pre~ent~ and read~ Re~olution No. 535.
Motion by Councilman Pate, ~econd by Councilman Jordan that
Re~olution No. 535 be adopted.

A recommendation is read, from the Department of Public
Works, that Sylvio Dal Bon and Jeaus Ramirez be advanced to
the next ~tep in the ~alary range. Motion by Councilman Peter-
~en ~econd by Councilman Pate and carried that Sylvio Dal Bon
and Jeaus Ramirez be advanced from $295.00 to $310.00 per month.
Max Kludt, Director of Public Work~, report~ that Dan
Matteucci ha~ re~igned from the Street Department and the Per-
aonnel Department iS~eeking a replacement.
A recommendation is read, from the City Marshal, that George Comin be
reappointed Special Police Officer, Motion by Councilman Pate, second by
Councilman Jordan and Carried that George Gomin, night watchman at the Filice
and Perrelli Cannery, be reappointed Special Policeman.
A letter is read submitting a resolution adopting a memorandum of
agreement for expenditure of gas tax engineering funds.
The City Clerk presents and reads Resolution No. 537. Motion by
Councilman Petersen, second by Councilman Pate and carried that Resolution
No. 537 be adopted.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ADOPTING BUDGET AND
APPROVING MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF FUNDS ALLOCATED UNDER
SECTION 21Cfl.5 OF THE STREETS AND HIGHWAYS CODE.

A letter is read from E. E. Eustice advising an increase in the tire
insurance program. Motion by Councilman Pate, second by CounCilman Petersen
and carried that the increase in the insurance program be approved.
A letter is read from Children's Hospital and Health Center requestiing
endorsement ot their organization. The City Clerk is instructed to investi-
gate this organization betore indorsement is given.
A letter is read from the Superintendent ot Schools offering to lease
the Cattle pens at the Gymkhana Grounds for agricultural classes. After dis-
cussion, the City Clerk is directed to inform the Superintendent of Schools
that they may cc;ntinue to use the cattle pens without charge rot that a lease
would not be advisable because ot possible sale for industrial purposes.
A letter is read from the Director of Finance regarding a proposed pop-
ulation estimate for Gilroy. Motion by Councilman Petersen, second by Coun-
cilman Jordan and carried that the Clerk be allowed to proceed with the pop-
ulation estimate.
Reports of the Building Inspector, Police Department, Poundmaster,
and reports of receipts of City Officers are presented and read. Motion by
Councilman Pate, second by Councilman Jordan and carried that these reports
be accepted as read.
Water samples taken 'by the Santa Clara County Health Department are
read and are satisfactory.
Motion by Councilman Pate, second by Councilman Petersen and carried
that bills as presented 1::e allowed and warrants ordered drawn on the
Treasurer.
Councilman Pate requests that the City Clerk write Mr. Sinclair of
Division of Highways, notifying him ot the proposed annexation on White-
hurst Avenue.
Councilman Pate suggests that a letter to the Hospital Board would be
in order, acknowledging their action on obtaining fuhds for a new hospital
building. The clerk is insturcted to prepare a letter.
Counci 1tJ"m Jordan inquires as to progress on the alley between Hanna
and Dowdy and 7th and 8th Streets. The Director of Public Works states the
work on this alley would begin immediately.
Councilman Jordan asks it Council members are protected with insurance
whUe on City business. The City Clerk is instructed to check on this matter.
Max nudt, Director ot Public Works, states that building permit fees
bave exceeded the total of 1958 this month. The amount tor 1959 is now over
$100,800,000.00
Max nudt, as South County's representative to the Trafficways Sub-
Committee requests the Council's approvalot the general location ot the free-
way east of the City. Motion by Gouhcilman Pate, second by Councilman Jor-
dan and carried that the freeway location in general be approved.
W. J. Hanna Jr., City Engineer, requests that the Welburn Avenue Bridge
be accepted and the final payment be made to William Radtke and Son atter
thirty-five days. Motion by Councilman Pate, second by Councilman Jordan and
carried that the Welburn Avenue Bridge be accepted and final payment be made
after thirty-five days.

Purchasing Agent, Cecil Reinsch, states that the library roof vill be
patched for the present and reroofed in the spring before the interior dec-
orating is begun.
Motion by Councilman Pate second by Councilman Jordan and carried that
this meeting be adjourned to Monday, October 26, 1959, at 8:00 p.m., Coun-
cil Chambers, City Hall, Gilroy, California.
