This adjourned meeting of the Common Council is called
to order by His Honor Sig Sanchez.
Present: Councilmen Carl W. Pate, Kenneth L. Petersen,
Everett C. Wentworth, Charles Gallo, and Wilford E. Jordan.
The Mayor states that this is the time for opening of
bids for comprehensive liability and auto insurance and reports
that he heard from one of the local insurance agents that the
Council did not allow sufficient time for preparation of the
bids. The Mayor also reports that he contacted several other
local insurance agents to find out if they had sufficient time
and they all felt that they weuld like to have had more time
however, they were able to submit a bid. The Mayor states un-
less there is further comment on the subject we will proceed
with the openin~ of bids. After some further discussion con-
cerning the specifications the Mayor asks the ~ity Clerk to
open the bids. The bids are opened and read as follows: Zurich

Insurance Company, local broker Voorhies Insurance Company, for
three years $11,733.24 or $3,911.08 per year; Pacific Indem-
nity, local broker E. E. Eustice Insurance Company, $4,210.92
yearly; Truck Insurance Exchenage, local broker Farmers Insur-
ance Group, $3,962.94 per year. Discussion is had on the bids.
Mr. Firman Voorhies explains that the policy is subject to an
annual audit. The Mayor refers the bids to the Finance Com-
mittee and the City Attorney for study and recommendation for
awarding of the bids at the next meeting.
Chief Administrative Officer Carr submits a proposal for
codification of City ordinances. Mr. Carr explains and reads ~
his report. The Mayor states that Chief Administrative Officer I
Carr did a thorough job on his report. Councilman Pate recom- ~
mends that the Council accept Chief Administrative Officer Carr's '
recommendation. Councilman Wentworth states that he would like
to see this matter referred to the Ordinance Committee and City
Attorney for study and recommendation. The Mayor refers this
matter to the Ordinance Committee for study with the Chief Ad-
ministrative Officer and the City Attorney for recommendation
at the next regular Council meeting. .
The City Attorney presents and reads Resolution No. 551.
Motion by Councilman Wentworth second by Councilman Petersen
that Resolution No. 551 be adopted.
RESOLUTION NO. 551
RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY
THE COMMON COUNCIL OF THE CITY OF GILROY TO ANNEX TO SAID CI~Y
CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED
"GILROY SEWER FARM ANNEXATION NO.2." AND GIVING NOTICE OF
THE PROPOSED ANNEXATION.

City Clerk Carr presents petitions from Kay's Fashions,
Hecker Pass Pharmacy and Simmons Home Furnishers, in the Hecker
Pass Shopping Center and reads the petition from Simmon's Home
Furnishers requesting improvement of the alley in the rear of
the shopping center. Discussion is had on the matter. Motion
by Councilman Pate second by Councilman Wentworth and carried
that improvement of the alley be referred to Director of Public
Works Kludt for doing the minimum to the alley until such time
as the weather and budget permits.
A letter from W. J. Hanna Sr. is read requesting an anti-
litter ordinance. This matter is referred to the Ordinance Com-
mittee for investigation.
Director of Public Works Kludt presents and explains the
final map of Miller Park and requests approval without elimina-
tion of any portion of the plan. Discussion is had on the plan.
Motion by Councilman Petersen second by Councilman Jordan and
carried that the plan as presented be adopted for Miller Park.
Mr. Kludt requests permission to use the money budgeted for rest-
rooms on other improvements in Miller Park if the restrooms will
cost more than anticipated. All Councilmen agree. Max Kludt
also requests permission to contact the service clubs for tree
donations. Permission is granted.
The Mayor instructs Director of Public Works Kludt to in-
vestigate the possibility of placing plaques in concrete by
trees to identify them as being donated by service clubs and
or~anizations.
. A letter is read from the Department of Finance certifying
that the estimated population of Gilroy is 6,920.
A letter is read from the Public Utilities Commission regard-
ing the City'S request for allocation of crossing protection
funds for signals at the Ninth Street railroad crossing. Chief
Administrative Officer discusses all previous correspondence
with the Public Utilities Commission concerning this crossing
and states that he does not have final word from the Commission
that the funds would be granted. The agreement with the Southern
Pacific Company for installation of signals at the Ninth Street
railroad crossing is submitted and referred to the City Attorney
for approval.
City Clerk Carr presents and reads a resolution requesting

a special session of the legislature for controlling exhaust
fumes on moving vehicles. No motion was made for the adoptiop
of the resolution.
The City Attorney presents and reads Ordinance No. 616.
Motion by Councilman Pate second by Councilman Jordan that
Ordinance No. 616 be adopted.

AN ORDINANCE AMENDING ORDINANCE NO. 611 OF THE CITY OF GILROY
WHICH PROVIDED FOR THE ALTERATIONS OF THE BOUNDARIES OF SAID
CITY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TBRRITGRY
OWNED BY THE CITY OF GILROY DESIGNATED AS "GILROY SEWER FARM
ANNEXATION NO.1", UNDER THE ANNEXATION OF UNINHABITED TERRI-
TORY ACT OF 1939 AND FOR THE INCORPORATION OF SUCH TERRITORY
IN AND AS A PART OF SUCH MUNICIPALITY, BY CORRECTING THE DES-
CRIPTION OF THE PROPERTY AS DESCRIBED IN SAID ORDINANCE ANNEXED
TO SAID CITY.

The Mayor reports that the Director of Public Works Kludt.
has recommended that Refugio Ramirez be placed on permanent em-
ployee status. Chief Administrative Officer Carr requests that
this recommendation be postponed. Permission is granted by
approval of the Council.
The City Attorney presents and reads an opinion of Mr.
Carpenter, Attorney for the League of California Cities', con-
cerning the legality of contributions that may be made from
City funds. He states for an example the City could not contri-
bute to the proposed New Wheeler Hospital without a special
benefit to the City other than being hospital facilities for
the citizens of the community. The Mayor asks if it would be
legal for the City to donate to the Santa Clara County Survey
Committee on Children and Youth. The City Attorney states that
the City could not legally donate to this organization.
A letter is read from Filice and Perrelli requesting a
meeting with the Council to discuss the Industrial Sewer Ordin-
ance. The Mayor instructs Chief Administrative Officer Carr
to set up a noon meeting after January 1st on a Thursday with
the Sewer Committee and Filice and Perrelli.
A letter is read from W. J. Hanna Sr. calling attention
to hedges causing obstruction to vision at Fifth and Rosanna
Streets. Discussion is had on the matter. Motion by Council-
man Pate second by Councilman Wentworth and carried that this
letter be placed on file.
Councilman Jordan states that in his opinion high hedges
are hazardous. Discussion is had on the matter. The Mayor
refers this matter to the Ordinance Committee for investigation.
Water samples taken by the Santa Clara County Health Depart-
ment on December 3rd are read and are satisfactory.
The Mayor asks for a recommendation from the Finance Com-
mittee on~a request for a donation to the Santa Clara County
Survey Committee on Children and Youth. Councilman Pate reports
that the City Attorney answered this request earlier in the
meeting and states that the Finance Committee recommends that
no action be taken on this matter.
The Mayor requests a recommendation from the Water Committee
on charges for installation of water meters in subdivisions.
Chief Administrative Officer Carr reports that the Water Com-
mittee has revised the Water ordinance and recommends that it be
adopted.
The City Attorney presents and reads ordinance No. 617.
Motion by Councilman Jordan second by Councilman Gallo that Or-
dinance No. 617 be adopted.

OF WATER SUPPLIED BY OR THROUGH THE WATER DEPARTMENT OF THE CITY
OF GILROY BY AMENDING SECTION 5 OF SAID ORDINANCE RELATING TO
RATES AND CHARrnES.

Councilmen Wentworth reports that he and Roy Mead and Max
Kludt met to discuss the lighting problem on north Monterey Street.
Councilman Wentworth reports that Roy Mead suggested that two ~
lighting standards be installed on the last island on north Mon- I
terey Street or to extend the center strip to the north City --
limits. Max Kludt suggests that the City wait to see what the
State anticipates for p~oposed crossings and a stacking lane at
Leavesley Road before planning additional lighting for the north
City limits. The Mayor instructs Director of Public Works Kludt
to follow up on this matter.
Councilman Wentworth compliments Chamber of Commerce Secre-
tary, Kenneth Murdoch, for answering requests about City of Gil-
roy climate which led to a large $300,000.00 chicken business in
this area. He states that several cities were contacted before
this chicken business developed and Gilroy was the only city who
answered their request.
Councilman Petersen Asks Director of Public Works Kludt
about Mr. Fred Padilla's proposed car port. Mr. Kludt reports
that the car port was in violation of the ordinance and that the
Planning Commission denied the permit.
Councilman Petersen remarks that Morgan Hill approved cor-
ridor annexation with San Jose and states that he believes the
City of Gilroy should encourage annexation as far as the golf
course and provide water for the property owners.
Councilman Jordan agrees with Councilman Petersen however,
he feels that the north is one of the areas that the City ~hould
investigate for corridor annexation also.
Councilman Jordan suggests that the City watch the movements ~
of the County and see that the County buildings are built in an ,.1
area that could be annexed to Gilroy. ..
The Mayor asks Chief Administrative Officer Carr if he has
set a meeting date with the County on the location of the County
building. Mr. Carr reports that because of the holidays no meet-
ing has been set. The Mayor suggests that a meeting be set for
the second Monday in January.
Chief Administrative Officer Carr reports that it is not
practical to store rubber solvent under ground, because it is
very volatile and evaporates quickly in a vented tank and that
several merchants find it impractical to comply with the present
ordinance governing storage of this liquid. Mr. Carr suggests
that one solution for fire protection of the hydrocarbon would
be .. storing it in proper cradles on wheels which could be easi-
ly rolled out of a building in case of fire. The City Attorney
suggests that the ordinance be amended. The Mayor refers this
matter to the Ordinance Committee for study and Chief Administra-
tive Officer Carr is instructed to assist in the matter.
Purchasing Agent Reinsch reports in the proposed installa-
tion of two new fire horns at the fire hou~e.
The City Attorney reports that the agreement with the Southern-
Pacific Company for installation of signals at Ninth Street rail-
road crossing is in order. Discussion is had on the matter. Mo-
tion by Councilman Jordan second by Councilman Petersen and carried
that the City enter into agreement with the Southern Pacific Com-' .,
pany for installation of signals at the Ninth Street railroad · I

The Mayor states that he and Chief Administrative Officer
Carr attended a meeting of the Board of Supervisors for proposed
consolidation of fire districts in the County.
The Mayor wishes everyone a merry Christmas.
Motion by Councilman Wentworth second by Councilman Jordan
and carried that this meeting adjourn to January 4, 1960 at $:00
p.m., in the Council Chambers, City Hall, Gilroy, California.
