Minutes 1960/02/03 2081 Gilroy, California February 3, 1960 This special meeting of the Common Council is called to order by His Honor Sig Sanchez. The Mayor states that the purpose of this meeting was to award the contract for removal of structures at the Gymkhana Grounds. He states that two Representatives from the Union recently discussed this matter with Chief Administrative Officer Carr and stated that the bids are illegal. Present; Councilmen Carl W. Pate, Courtland M. Rush, Ken- neth L. Petersen, Everett C. Wentworth, and Wilford E. Jordan. Absent: Councilman Charles Gallo. Chief Administrative Officer Carr reports that it was brought to his attention that the City cannot enter into a demolishion contract with anyone who is not a general contractor. The City Attorney states that he believes that if the build- ing was sold the owner would not have to have a contractor's li- cense to demolish the structures. The Mayor suggests that the City reject all bids and have City employees remove the structures. Mr. Edmond Bullard, representative from the schools, states that they could not bid for this contract and that their entire interest was the two bleachers. He also states that if the City had their employees remove all structures that the school would remove the bleachers, the center fence in front~of the bleachers, and anything else that they can use. Discussion is had on the matter. Director of Public Works Kludt asks the Council if the City crew can first clear the area where Republic Powdered Metals, Inc. is going to build and systematically clear tha remaining area. All Councilmen agree. The Coupcil also agree to have the City salvage all material possible. The Union Representative states that they claim demolishion of the project site to completion of the building. He states that he will argue the point if the City employees removing the structures if they are not paid union wages quoting from a sec- tion in the California Labor Code. He also reports that the Union would like to see the contract awarded to a licensed con- tractor due to the fact that they were a part of the community. The City Attorney disagrees with the Union Representatives statement on employees being paid union scale when doing demoli- tion work. The Mayor states that the City did advertise for bids and 0n"'"'' ') {< ,) '.._, J'.J ~ the only contractor who submitted a bid was for $4,200.00 and $3,400.00 and the City can do this job for $200.00. Discussion is had on the matter. Councilman Wentworth reports that he discussed this matter with Dr. H. B. Long who stated that they would be interested in the bleachers if they did not have to pay for them. Motion by Councilman Pate second by Councilman Rush and carried that all bids as submitted for removal of structures at the Gymkhana Grounds be rejected, and that the school be given the two bleachers and any other material at no cost and that the balance of the job be done by the City crew.
