Present: Councilmen Norman B. Goodrich, Wilford E. Jordan. Carl W. Pate, Courtland M. Rush, and Everett C. Wentworth. Ab- sent: Councilman Kenneth L. Petersen. The Mayor asks if all Councilmen have received copies of the special meeting of April 1st, the regular monthly meeting of April 4th, and the regular adjourned meeting of April 19th. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor now declares the minutes of the Special meeting of April 1st, the regular month- ly meeting of April 4th, and the regular adjourned meeting of April 19, 1960 approved. The Mayor states that this is the time and place for a hear- ing on the rezoning of Mr. J. Jung's property on Old Gilroy Street from "Bn to nC-l", and asks if anyone in the audience wishes to speak for or against the matter. There is no comment. The City Attorney presents and reads proposed Ordinance No. 622 for the rezoning of property belonging to Mr. Jung on Old Gilroy Street at East City limits from TTB" to "C-ITT. Discussion is had on the procedure under the new charter for adopting an ordinance. Councilman Petersen arrives and takes his seat at the Coun- cil table. Discussion is had on the annexation of adjoining property belonging to Mr. Jung and also on the possibility of annexing other adjoining properties. The Mayor states that in order to avoid further delay for Mr. Jung that we proceed with the proposed rezoning and consider annexation of the adjacent property at a later date. Motion by Councilman Jordan second by Councilman Goodrich that proposed ordinance No. 622 be introduced and published by title and summary. Motion carried by unanimous vote of the Council present. City Administrator Carr requests that the City Attorney pre- pare a legal notice form for ordinance publication. An application for an on-sale beer license from Tony Marfia for Cannery Cafe at 140 Lewis Street is presented. The Mayor asks Marshal Sturla if he has any objections to the application. Marshal Sturla states that he has no objections. The City Attorney presents and reads proposed Ordinance No. 623 providing for diagonal parking on Eigleberry Street between Sixth and Seventh Streets. Motion by Councilman Pate second by Councilman Wentworth that proposed ordinance No. 623 be introduced and published by title and summary. Motion carried by unanimous vote of the Council present. The City Attorney reports that he does not have an ordinance prepared for establishing a "Cannery Truck Route" on Alexander Street from Ninth to Old Gilroy on Old Gilroy from Alexander to Railroad Street, on Railroad from Old Gilroy to Lewis Street, because using a portion of a highway for a truck route requires permission from the State Department of Public Works and a hear- ing is required when Gas Tax money has been expended on streets to be designated as a truck route. Discussion is had on the matter. The Mayor instructs Director of Public Works Kludt to work with the City Attorney until this matter is completed. All Coun- cilmen have no objections. Director of Public Works Kludt presents pictures of the alley conditions taken one year ago stating that these conditions still exist and suggests that a campaign be proposed through the news- paper to insure the enforcement of Ordinance No. 598. Motion by Councilman Pate second by Councilman Wentworth and carried that Director of Public Works Kludt be authorized to proceed with the proposed program as requested. City Administrator Carr reports that Marshal Sturla has re- quested preparation of an ordinance establishing a 2:00 a.m. clos- ing hour for card rooms and providing a penalty for violation of revocation of license. The Mayor instructs the City Attorney to prepare an ordinance establishing 2:00 a.m. as a closing hour for card rooms and pro- vidingfor violation of revocation of license. City Administrator Carr reports that the fire insurance policy on the barns at the Gymkhana Grounds will expire in June and asks the Council if they would prefer canceling the policy because the barns eventually will be given to the schools. Discussion is had on the matter. Motion by Counilman Rush second by Councilman Pate that the school be notified to pay the premium on the barns and if they do not want to pay the premium the City will cancel the policy. Councilman Petersen suggests that we charge the school rental on the barns and continue to pay the ;;~87 .00 premium for fire insurance on the barns. Councilman Rush and Pate withdraw their motion. The City Administrator is instructed to contact the school to find out if they will pay a rental fee on the barns at the Gymkhana Grounds. City Administrator Carr reports that Fire Chief Ramezane recom- mends that Vernon Naughton be advanced to the next step in the salary range. A letter is read from State Compensation Insurance Fund an- nouncing refund of 43% premium for the 58-59 fiscal year. A letter is read announcing a City Selection Committee meet- ing for the purpose of selecting a member to the Bay Area Pollu- tion Control District. Director of Public Works Kludt reports on the Santa Clara County Traffic Ways Committee meeting of April 13th. Discussion is had on the Hubbard Plan. The Mayor instructs City Administrator Carr to write a letter to Mr. StClair to find out when the survey crew will be in Gilroy concerning the proposed freeway in Gilroy. The Mayor states that the Council is geoerally in favor of the Hubbard Plan and instructs Director of Public Works Kludt to brief Councilman Goodrich on the matter. The Mayor also instructs City Administrator Carr to write directly to the legislature concerning the proposed freeway in Gilroy. All Councilmen agree to the adoption of the Hubbard Plan. Water Samples taken by the Santa Clara County Health Depart- ment on April 13th are read and are satisfactory. Reports of the Police Department, Building Inspector, Pound- master, and City Officers are presented and read. Motion by Councilman Rush second by Councilman Wentworth and carried that reports be accepted as read. Motion by Councilman Rush second by Councilman Wentworth and carried that bills as presented be accepted and warrants drawn on the Treasurer. Councilman Rush asks if there is still a thirty day moratorium for parking in the alley between Monterey and Eigleberry Streets. The Mayor suggests that this matter be postponed to find out if the diagonal parking on Sixth and EigleberD' Streets helps the situation in the alleys. Councilman Rush also asks if the City has heard anything from Howard Campen on the proposed South County Building. Discussion is had on the matter. The Mayor instructs City Administrator Carr to contact 40ward Weichert for a meeting on May 9th with the Council to discuss the South County building and find out the chances of having this matter put on the agenda at the Soard of Supervisors meeting. The ~1ayor instructs City Administrator Carr to contact ~oward Smith to find out when the option expires on the property next to the City offices belonging to Floyd Jones. Discussion is had to delete the process of the Council si~n- ing claims for payment of bills. It is decided to have all pav,- ments authorized by the City Administrator and paid at the first of the month and a list of the payments submitted to the Council on the second Council meeting of the month. City Engineer Hanna Jr. reports that there will be a hearin~ with the Santa Clara County Flood Control on flood control projects and that someone representing the City should be present. The City Attorney asks the Council if they would like copies of the proposed ordinances at future meetin~s. The Mayor states that the Council should have copies of pro- posed ordinances f~ following when they are being read. The Mayor also su~~ests that the City should investi~ate more up to date duplicating equipment because of the added amount of work to be duplicated. City Administrator Carr announces the Mayors' and Councilmen's Institute in Berkeley on May 26th and 27th, and the Public Yearin~ on Flood Control Projects on May 23rd in San Jose, and also the meeting with the Off-Street Parking Committee on May 5th. All Councilmen ask to be reminded of the meeting on May 5th.
