Pate, Kenneth L. Petersen, Courtland M. Rush, Everett C. Wentworth and Sig Sanchez. Absent: Council members: Norman B. Goodrich The Mayor states that this is the time and place for the Public Hearing on the annexation of the IIJung Eastern Addition.'1 The Mayor asks If anyone in the audience has anything to say for or against annexation of IIJung Eastern Addition.1I There Is no response. The City Attorney presents and reads Ordinance No. 629. Motion by Coun- cilman Rush, second by Councilman Wentworth, that Ordinance No. 629 be adopted. ORDINANCE NO. 629 AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY, TO BE KNOWN AS IIJUNG EASTERN ADDITION'I TO THE CITY OF GILROY, AND FOR THE INCOR- PORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRITORY. AYES: NOES: ABSENT: COUNCIL MEMBERS: COUNCIL MEMBERS: COUNCIL MEMBERS: Jordan, Pate, Petersen, Rus~, Wentworth, Sanchez None Goodrich A letter is read from the Planning Commission recommending that the cor- rected final map of Sherwood Park Unit No.3 be approved by the Council. Max Kludt, Director of Public Works, explains the corrections which have been made. Mr. Jack De Bell' and his Attorney, Robert Byers, are present to contest the additional off-site charges for storm drainage on property which he pre- viously Improved. Mr. Byers states that the City has not complied with the several require- ments necessary to make the Subdivision Ordinance constitutional. After a lengthy discussion, Mr. De Bell agrees to pay the additional charge under protest so that construction may begin. At a later date he will meet with the Council to test the constitutionality of the Ordinance. Motion by Councilman Jordan,seconded by Councilman Pate that Trace No. 2774, Unit No.3 be approved subject to all conditions pertaining to the Sub- division Ordinance. 2070 A letter is read from Hahn, Wise and Barber regarding a parking study which is to be made by them. The letter is ordered filed. The City Attorney introduces and reads an ordinance establishing sewer charges for labor camps. Motion by Wentworth, seconded by Rush and carried that the ordinance be published. Discussion is had on the extension of the water line to the Jung Eastern Addition. Max Kludt, Director of Public Works explains the extension plan, stating that the cost to the City in this project will be $4,200. Motion by Petersen, second by Councilman Pate and carried that this ex- penditure be made from the reserves in the Water Fund for the water main ex- tension. The City Attorney reports that a survey is necessary on the property ad- jacent to Wheeler Auditorium in order for the City to obtain a proper title. The City Engineer is instructed to carryon with the survey. A letter is read from the California State Automobile Association setting Tuesday, August 2, 1960, as the time and date for a street stop sign survey. A letter is read from the Superintendent of Sch~ols stating that there was a misunderstanding between the City and School District as to the location of the new school site. After some discussion on the school site, the City Administrator is in- structed to write to the County Planning Department requesting that the City be notified when a use permit is issued and zoning takes place. A letter is read from the Wheeler Hospital Board requesting use of the Council Chambers for one evening for opening of bids on the new Wheeler Hospi- tal Building. Motion by Councilman Petersen, second by Councilman Wentworth that the Wheeler Hospital Board be granted permission for use of Council Cham- bers. The date is undetermined. Councilman Pate reports on the Trafficways Committee meeting. Councilman Rush states that older boys have been playing football with cleats at Miller Park and also using abusive language. This matter is refer- red to the Recreation Director for action. Councilman Pate was informed by the County Executive that Gilroy will be notified when the County Building is on the agenda for the Board of Supervisors. Mayor Sanchez reports on the Freeway meeting held in Morgan Hill. The City Administrator is instructed to reserve 3 double rooms for the Annual League of California Cities Conference. City Attprney reports that the White guest house building has been re- moved and that the trial set for Wednesday, July 20, will be dismissed. The Council is invited to sit in on the organization of the Recreation Commission, Personnel Commission and Library and Culture Commission on Tuesday, Wednesday and Friday evenings of this week. The Planning Commission will meet for the first time on August 5th. The City Administrator explains the appointments and terms of office.
