Minutes 1960/09/06 I ! 2075 Gilroy, California September 6, 1960 This regular monthly meeting of the Council is called to order by his Honor Sig Sanchez. Present: Council Members: Wilford E. Jordan, Carl W. Pate, Kenneth L. Petersen, Courtland M. Rush and Sig Sanchez. Absent: Council Members: Norman B. Goodrich and Everett C. Wentworth. The Mayor asks if all Councilmen have received copies of the minutes of the regular monthly meetings of August 1st and August 15, 1960. All the Council answer in the affirmative. The Mayor now declares the minutes of the regular monthly meet- ings of August 1st and August 15, 1960 approved. A claim is read from the De Bell Corporation for a refund of fees paid under protest for Sherwood Park Unit #3. This claim is ordered filed. Mr. De Bell and Mr. Byers, his Attorney, are present and state that they are willing to come in with Unit #4 on the same basis as Unit #3. The City Attorney is not agree- able to this basis due to the fact that the City is in the pro- cess of working on a master plan and that the purpose of the fee is to pay for the drainage of the lots. After discussion is had on this matter it is Mr. Byers~ decision to work the prob- lem out in some other way. The Planning Commission is to be informed by letter of the Council's authorization to proceed with adoption of the tenta- tive map of Sherwood Park Unit #4 subject to execution of an agreement with the De Bell Corporation. A request is read from J. F. Flautt for the extension of sewer line to his property on Murray Avenue. This line will also pass property belonging to Mrs. Garbini, Mrs. Godani, and Be Ge Mfg. Company. The City'S cost for the line will be taken from the Capital Outlay, Revolving Fund. The City will be reim- bursed at the rate of $2.80 per foot by those who connect to the line. Motion by Councilman Petersen, second by Councilman Pate and carried that the sewer line extension on Murray Avenue be approved subject to the Department of Public Works determination as to the size of line to be laid. The Director of Public Works is authorized to ,proceed with this project. A letter is read from the Parks and Recreation Commission recommending that signs "This park is for leisure and quiet ae- tivities. Team games such as baseball and football are prohi- bited," be erected on three sides of Miller Park and request- ing permission to spearhead a movement to acquire land for a future park for combined recreational facilities. The size to be a minimum of twenty-five to thirty acres. Motion by Councilman Petersen, second by Councilman Pate and carried that three attractive and appropriate signs be ob- tained for M~ller Park with the suggested wording in a more com- pact form. __ .--..M 20rlo Cecil Reinsch, Recreation Director, explains that the Com- mission would like to look for property and work with the Plan- ning Commission for future park and recreational facilities. City Administrator Carr is instructed to send a copy of the Recreation Commission's letter to the Planning Commission and to write the Recreation Commission stating that they are to work with the Planning Commission in promoting a future park site. The report from the Planning Commission is read. It is recommended that the Council zone Jung Addition ftC_1ft restricted commercial. Motion by Jordan, second by Councilman Pate and carried that a public hearing for the zoning of Jung Addition be set for September 19, 1960. The submission of a tentative map of Sherwood Park Unit #4 was taken up by Mr. De Bell previously. The Planning Commission has discussed in general Mr. M. J. Filice's request for information on the development of Christ- mas Hill, such as water utilities, etc. They also discussed his tentative proposal for development of Castlewood Park Unit #4 and a shopping center east of Wren Avenue. No action was taken by the Council on these subjects. Director of Public Works Kludt presents the plans for resi- dence and carport at the golf course, and request permission to advertise for bids. Motion by Councilman Rush, second by Councilman Petersen that bids be advertised for residence and carport at the Gilroy Golf Course. The matter of lifting the ninety day moratorium on dances in the Wheeler Auditorium is discussed. A letter is read from Al Gutierrez requesting permission to hold a dance on Saturday, October 1, 1960. The Mayor explains the reason for the present moratorium to the new Chief of Police, C. J. Laizure, who is present in the audience. Chief Laizure suggests a dance permit regulating the number of police officers required at each public dance. Motion by Councilman Pate, second by Councilman Jordan and carried that the moratorium be lifted as of October 1, 1960, if the details can" be worked out by the City Administrator. Also the City Attorney is to draw up a resolution regulating public dances in the City of Gilroy. City Administrator Carr presents and reads emergency Ord- inance No. 633. Motion by Councilman Rush second by Councilman Pate that Ordinance No. 633 be adopted. NOES: COUNCIL MEMBERS: None ABSENT:COUNCIL MEMBERS: Goodrich, Wentworth The introduction of a health ordinance prescribing rules and regulations for restaurants and food establishments was postponed until the City Administrator can discuss further the fee for a health permit with the County Health Officer. - . It is suggested by the Mayor that ordinances for introduc- tion be mailed to the Council before the meeting of its intro- duction in order to save the time of reading during Council meet- ings. An ordinance on weed abatement was distributed among the members of the Council to be read before the next regular meet- ing. The City Attorney gives a progress report on acquisition of the Jones' property adjacent to Wheeler Auditorium. Motion by Councilman Pate, second by Councilman Jordan and carried that the City Attorney be authorized to proceed with negotiations with Mr. Floyd Jones for purchase of the property adjacent to Wheeler Auditorium. A request is made for Council approval to advertise for bids on Church Street improvement. The City Engineer is not present to explain this project to the Council. Director of Public Works Kludt gives a general explanation. Motion by Councilman Rush second by Councilman Petersen and carried that Director of Public Works Kludt be authorized to ad- vertise for bids for Church Street Improvement. ~ W 20'77 Director of Public Works Kludt requests that the curb be set back two feet on the north side of Sixth Street between Eigleberry Street and the alley west of Monterey Street. He presents two bids on this project: Wm. Radtke and Son - $690.00 and Geo. C. Renz Construction Company - $733.00. After discussion, motion is made by Councilman Pate, second by Councilman Jordan and carried that the City Administrator and Director of Public Works be authorized to proceed with this pro- ject. No action is taken on the amendment to the Street Maintenance Budget of $1,148.75 for paving parking areas on Pacheco Pass High- way due to the fact that this project has been completed. A request is made for an amendment to the budget for addi- tional expenditure from the General Fund of $1,088.00 for work at the Sewer Farm. Motion by Councilman Pate, second by Councilman Rush and carried that an additional expenditure of $1,088.00 from the General Fund, be allowed. The Mayor states that a strong odor comes from the Sewer Ponds in the early evenings. This condition will be corrected by the Director of Public Works as soon as the pools dry up. Reports of the Police Department, Building Inspector, and reports of receipts of City Officers are presented and read. Motion by Councilman Rush,second by Councilman Petersen and carried that these reports be accepted as read. Councilman Pate comments on the State H~ghway street paving taking place on Monterey Street during the holiday season. Assistant City Administrator Reinsch reports that a total of $360.00 was spent on both barbecues given by the City. City Administrator Carr requests authorization to contact the State Personnel Board for Assistance with Police Patrolman examination. Motion by Councilman Pate second by Councilman Jordan and carried that the City Administrator be authorized to contact the State Personnel Board for assistance with the Police Patrolman examination. Discussion is had on the reopening of Forest Street. The' Mayor suggests that the City make a proposal to the School Board that some agreement be reached for the reopening of Forest Street.
