Minutes 1961/03/20 211B G i 1 roy, Ca I i forn i a March 20, 1961 i ~ This regular monthly meeting of the City Council is called to order by His Honor Sig Sanchez. Present: Council Members: Norman B. Goodrich, Wilford E. Jordan, Carl W. Pate, CourtlandM. Rush, Everett C. Wentworth and Sig Sanchez. Absent: Council Member: Kenneth L. Petersen. A letter is read accompanied by a resolution from the Building Industry Conference requesting adoption of certain uniform codes throughout Santa Clara County. Discussion Is had. A recommendation concerning this matter from Director of Public Works Kludt is read recommending that the Council wait until the codes are published before adopting them. Discussion is had and the matter is tabled. The Mayor states that Mr. Robert Miller and Mr. Emmett Fitzspatrick representing the Southern Pacific are present to explain why Southern Pacific's proposal to control Western Pacific best serves the public interest and calls on them to address the Council. Mr. Fitzspatrick 'comes forward and gives an explanation and requests the Council to adopt a resolution endorsing the Southern Pacific's plan. The Mayor states that the resolution will be held for study and action can be taken at the next Council meeting. A report from the Planning Commission is read notifying the Council of a publ,ic hearing before the Planning Commission on z'oning of the First Southern Addition, notifying the Council of a public hearing before the Planning Com- mission on official plan lines for Miller Slough and recommending that a date for a publ ic hearing before the Counci I be set for zoning of the First S'outhern Add i t i on. The City Attorney presents and reads Resolution No. 609. Motion by Councilman Goodrich second by Counci lman Jordan that Resolution No. 609 be adopted. ~;.;;; RESOLUTION NO. 609 - RESOLUTION FIXING TIME AND PLACE OF HEARING RECOMMENDATION AND REPORT OF CITY PLANNING COMMISSION"UPON PROPOSAL INITIATED BY CITY COUNCIL TO AMEND ZONING ORDINANCE NO. 480 BY ZONING FIRST SOUTHERN ADDITION TO THE CITY OF GILROY AND REZONING CERTAIN ADJACENT TERRITORY ALONG TENTH STREET FROM ZONE "B" TO ZONE "C". NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: Petersen '~# Director of Public Works Kludt reports that the Southern Pacific offi- cials have stated that they will give the City right-of-way at the Leavesley Road intersection and that they will recommend the Tenth Street Crossing and the closing of the Ninth Street crossing. The final map of Eschenburg Park, Unit No.4 is presented for approval. Motion by Councilman Pate second by Councilman Wentworth and carried that the final map of Eschenburg Park, Unit No.4 be approved subject to the filing of a plan for improvements and furnishing a bond for their'Installation. A letter is read from the Division of Highways regarding the South County Freeway requesting the City to inform them of any construction within the South County Freeway route. City Administrator Carr requests Council recommendation on the proposals submitted by the Planning Commission which are to be embodied in an off-street Parking Ordinance. Discussion is had. Motion by Councilman Pate second by Councilman Jordan and carried that the Planning Commission be given authorization to embody the proposed parking regulations in an ordinance and submit it to the Council for adoption. City Administrator Carr presents Ordinance No. 646 for adoption. ORDINANCE NO. 647 AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 646 AND FOR THE FURTHER REGULATION OF SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MERCHANTS, PHOTOGRAPHERS, AND TRANSIENT VENDORS OF GOODS, WARES, AND MERCHANDISE BY PROVIDING FOR THE REGI- STRATION AND IDENTIFICATION OF SUCH PERSONS. Motion by Counci lman Pate second by Counci Iman Rush, and carried that the contract with the Gilroy Golf and Country Club be approved, that both parties be authorized to sign the 'agreement with added provisions of a five year option for renewal and that the Club provide a watchman for the reservoir. The City Attorney presents and reads Resolution No. 610. Motion by Councilman Rush second by Councilman Wentworth that Resolution No. 610 be adopted. - .. RESOLUTION NO. 610 A RESOLUTION ESTABLISHING FOUR NEW FUNDS TO BE KNOWN AND DESIGNATED AS OFF- SITE STORM DRAIN FUNDS A, B, C, AND D, IN CONFORMITY VITH AND AS A PART OF THE DRAINAGE ELEMENT OF THE GENERAL OR MASTER PLAN, PROVIDING FOR THE TRANS- FER OF MONEYS IN WESTERN AND CENTRAL OFF-SITE STORM DRAIN FUNDS AND THE ABOLISHMENT OF SAID FUNDS. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: Petersen The City Attorney presents and reads a proposed ordinance which re- peals Ordinance No. 504A providing for: the moneys now in the Annexed Terri- tory Sewer Connection Fund to be transferred to the Outfall Sewer Fund. Motion by Councilman Pate second by Councilman Goodrich and carried that the ordinance be introduced, and that it be published by title and summary. Motion carried by unanimous vote of the Council present. The City Attorney presents and reads a proposed ordinance which amends Ordinance No. 398 regulating solicitation of funds within the City of Gilroy. Motion by Councilman Goodrich second by Councilman Jordan and car- ried that the ordinance be introduced, the reading waived, and that it be published by title and summary. Motion carried by unanimous vote of the Council present. . Counci lman Pate commends the Library and Culture Commission for the presentation of the Cantata at the Wheeler Auditorium on June 19, 1961. The Mayor reports that under our present fire prevention ordinance sparklers are prohibited and requests 'Council decision whether to allow the local businesses to sell these sparklers. Discussion is had. The Mayor instructs the City Attorney to prepare an ordinance dele- ting the prohibition of sparklers from the present ordinance. IIIlll .... 211fl The Mayor reports that he will be calling a meeting in the near future to determine from local citizens their opinions on circulating a petition re- questing location of the Gilroy Justice Court within the City of Gilroy. The Mayor asks If anyone in the audience has anything to discuss before the Council. There is no comment.
